ORDINANCE NO. 11080
AN ORDINANCE AMENDING ORDINANCE NO. 10938,
ADOPTED DECEMBER 5, 1991, AS AMENDED, THE
CAPITAL IMPROVEMENT APPROPRIATIONS ORDINANCE,
BY REVISING PREVIOUSLY APPROVED SCHEDULED
CAPITAL IMPROVEMENT PROJECTS AND ESTABLISHING
NEW CAPITAL IMPROVEMENT PROJECTS TO BEGIN
DURING FISCAL YEAR 1992-93 IN THE PROGRAM
AREAS OF TRANSPORTATION AND PHYSICAL
ENVIRONMENT; CONTAINING A REPEALER PROVISION,
SEVERABILITY CLAUSE.
WHEREAS, the City Commission adopted Ordinance No. 10938 on
December 5, 1991, to establish appropriations for capital
improvements, continue previously approved capital improvement
projects, and establish new capital improvement projects to begin
during fiscal year 1991-92; and
WHEREAS, the disruption in routine services provided by the
City of Miami due to Hurricane Andrew has delayed the adoption of
a master Capital Improvement Appropriations Ordinance for fiscal
year 1992-93; and
WHEREAS, it is now in order to revise previously approved
scheduled capital improvement projects and establish new capital
improvement projects to begin in fiscal year 1992-93 in the
program areas of Transportation and Physical Environment;

NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. Section 1 of Ordinance. No. 10938, adopted
December 5, 1991, as amended, is hereby further amended in the
following particulars: 1/
"Section 1. The herein appropriations are hereby
made for implementation of all municipal capital
improvements of the City of Miami, including new
capital improvement projects scheduled to begin
during fiscal year 1991-1992. The herein
appropriations which are hereby designated by
reference to descriptive project title and number
also include appropriations for previously approved
scheduled projects as well as reappropriat ions of
prior fund appropriations. The source of revenues
to support the herein appropriations is hereby
identified by fund and project with the project
appropriations with revenues therefor being set
forth for seven program (I-VII) areas based upon use
or functional category within said areas, as
follows:

Section 2. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 3. All Ordinances, or parts of Ordinances insofar as
they are inconsistent or in conflict with provisions of this
Ordinance are hereby repealed.
Section 4. This Ordinance shall become effective 30 days
after final reading and adoption hereof, pursuant to law.

It is respectfully recommended that the City Commission adopt the
attached Ordinance amending the Capital Improvement
Appropriations Ordinance No. 10933 to establish a fiscal year
1992-93 funding appropriation for Transportation and Physical
Environment Improvements.
BACKGROUND:
The disruption in routine services provided by the City of Miami
due to Hurricane Andrew has delayed the adoption of a master
Capital Improvement Appropriations Ordinance for fiscal year
1992-1993. Several previously approved and new capital
improvement projects scheduled for fiscal year 1992-1993 in the
program areas of Transportation (Streets) and Physical
Environment (Storm Sewers) involve Community Development Block
Grant Funds, Surface Water Improvement and Management grant funds
and Stormwater Utility Trust Funds with specific completion
deadlines and commitments. The appropriation of funding for
these projects is essential for their timely completion in
accordance with the grant guidelines and to provide the necessary
services to the citizens of Miami.
