ORDINANCE NO.
AN ORDINANCE AMENDING SECTION 5 OF ORDINANCE
NO. 6145, ADOPTED MARCH 19, 1958, AS AMENDED,
WHICH ESTABLISHED FEES FOR BUILDING,
PLUMBING, ELECTRICAL, MECHANICAL (INCLUDING
BOILER AND ELEVATOR) INSPECTION, PERMIT
AND CERTIFICATE FEES, BY ADDING, INCREASING
AND REDEFINING REQUIRED FEES TO COVER THE
INCREASED COST FOR THE ENFORCEMENT OF THE
SOUTH FLORIDA BUILDING CODE; PROVIDING A
PROCEDURE FOR FUTURE INCREASES OF SAID FEES;
CONTAINING A REPEALER PROVISION, A
SEVERABILITY CLAUSE AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, new building, plumbing, electrical and mechanical
(including boiler and elevator) inspection, permit and
certificate fees need to be established and certain existing fees
need to be increased in order to cover operational costs,
primarily for the enforcement of the South Florida Building Code;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. Section 5 of Ordinance No. 6145, adopted
March 19, 1958, as amended, which provides fees for building,
plumbing, electrical and mechanical (including boiler and
elevator) inspection, permit and certificate fees, is hereby
amended in the following particulars: .1/
Words and/or figures stricken through shall be deleted.
Underscored words and/or figures shall be added. The
remaining provisions are now in effect and remain unchanged.

Section 2. All ordinances or parts of ordinances
insofar as they are inconsistent or in conflict with the
provisions of this Ordinance are hereby repealed.

Section 3. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 4. This Ordinance shall become effective thirty
(30) days after final reading and adoption thereof.

In July of 1993, as a result of Hu.-ricane Andrew, the Building
and Zoning Department increased its fees in order to better
enforce the South Florida Building Code . Since that time, the
aftermath of the hurricane has brought on additional changes to
the code which affected the number of required inspections to
complete certain jobs.
The Building and Zoning Department has reviewed its fee schedule
and determined to bring the cost up -to the level of service that
is being provided and in accordance to the fees of other
municipalities.
Ordinance 6145, amended by Ordinances 11078 and 10608, gives the
City Manager the authority to increase the fees, as necessary, to
enforce the code. Attached please rind the list of fees that
should be increased and become effective within thirty (30) days.

Recommendation
It is respectfully recommended that the City Commission adopt the
'amendment to Section 5 of Ordinance No. 6145, adding, increasing
and redefining required fees to cover the enforcement of the
South Florida Building Code.
BacKground
In order for the City of Miami to continue to protect the life,
safety and public welfare of its citizens, these proposed
amendments increasing and clarifying fees are required. The
requirements of the South Florida Building Code, and the
personnel necessary to properly enforce the Code, have increased
as a result of Hurricane Andrew. Additional inspections are
required, particularly for roofing permits. Many fees listed
in this ordinance are only shown as clarifications of existing
fees, which are not properly defined in the Code.
New fees being added are as follows:
RECERTIFICATION - The recertification fee for 40-year old and
older buildings to establish their safety is being added to this
ordinance. This has been charged by all other local
municipalities, yet the City has been providing this service at
no cost to the public.
MECHANICAL FEES - New and increased fees will cover the cost of
inspections now required for this type of work.
ELECTRICAL FEES - The fee schedule has been updated to
correspond w 1 tfi the new equipment being inspected. The
additional fees will cover the cost of inspections.

It is respectfully recommended that the City Commission adopt the
amendment to Section 5 of Ordinance No. 6145, adding, increasing
and redefining required fees to cover the enforcement of the
South Florida Building Code.
BacKground
In order for the City of Miami to continue to protect the life,
safety and public welfare of its citizens, the proposed amendment
adding, increasing, and clarifying fees is required. The cost of
properly enforcing the South Florida Building Code continues to
increase, yet the fees for the services provided remain the same.
The Planning, Building and Zoning Department has reviewed its
fee schedule and determined that, after many years of trying to
Keep the cost of services to the public at a minimum, it has
become necessary to bring the fees up to the level of service
that is being provided. It has also found that some fees are not
properly defined and the department is taxing this opportunity to
clarify them.
The recertification fee for 40-year old buildings being added to
this ordinance is being charged by all local municipalities, yet
the City has been providing this service at no cost to the
public. The cost of the paperworK and follow up involved leaves
the City with no other option than to add these fees.
