ORDINANCE NO. 11065
AN EMERGENCY ORDINANCE ESTABLISHING INITIAL
RESOURCES, APPROPRIATIONS AND A SPECIAL
REVENUE FUND ENTITLED "HIDTA/SIDEARM";
ACCEPTING A GRANT IN THE AMOUNT OF $10,000
FROM THE U.S. DEPARTMENT OF JUSTICE, AS
ADMINISTERED BY THE FLORIDA DEPARTMENT OF LAW
ENFORCEMENT, AND AUTHORIZING THE CITY MANAGER
TO EXECUTE ANY AND ALL DOCUMENTS, IN A FORM
ACCEPTABLE TO THE CITY ATTORNEY, NECESSARY TO
ACCEPT SAID GRANT; CONTAINING A REPEALER
PROVISION AND A SEVERABILITY CLAUSE.
WHEREAS, the City of Miami Police Department continues to
investigate narcotics trafficking; and
WHEREAS, there is a need to target specific geographical
areas; and
WHEREAS, the Department of Justice, Office of Justice
Programs, through the Florida Department of Law Enforcement has
approved the award of $10,000 toward the payment of overtime,
with no matching funds from the City of Miami to accomplish these
investigations;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.

Section 2. The following Special Revenue Fund is hereby
established and resources are hereby appropriated as described
herein:
FUND TITLE: HIDTA/SIDEARM
RESOURCES: U.S. Department of Justice $10,000
APPROPRIATIONS: Total Personnel $10,000
Section 3. The City Manager is hereby authorized to accept
the grant as set forth in the Preamble to this Ordinance and to
enter into the necessary contract(s) and/or agreement(s), in a
form acceptable to the City Attorney, I/ for the acceptance of the
aforesaid monies for the compensation of personnel.
Section 4. All ordinances or parts of ordinances insofar as
they are inconsistent or in conflict with the provisions of this
Ordinance are hereby repealed.
Section 5. If any section, part of section, paragraph,
clause, phrase, or word of this Ordinance is declared invalid,
the remaining provisions of this Ordinance shall not be affected.
Section 6. This Ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety, and property of the City
of Miami, and upon the further grounds of the necessity of the
City of Miami to make the required and necessary payments to its
employees and officers, payment of its debts, necessary and

required purchases of goods and supplies, and to carry on
generally the functions and duties of municipal affairs.
Section 7. The requirement of reading this Ordinance on two
separate days is hereby dispensed with by an affirmative vote of
not less than four -fifths of the members of the Commission.
Section 8. This Ordinance shall become effective immediately
upon its adoption.

It is respectfully recommended that an Ordinance establishing a
Special Revenue Fund entitled: "HIDTA/SIDEARM," accepting a grant
from the Florida Department of Law Enforcement, in the amount of
$10,000 and appropriating funds for the operation of same, be
adopted.
The Miami Police Department is continuing its efforts at
combatting narcotics trafficking and has received assistance in
this endeavor from the federal government, through a High
Intensity Drug Trafficking Area Grant. This is third year
funding for the grant, however, this year it will be administered
by the Florida Department of Law Enforcement, rather than the
U.S. Department of Justice, Office of Justice Programs. The
grant provides an additional incentive for the City of Miami
Police Department to target organizations involved in narcotics
trafficking based on geographic location. No matching funds are
required by the City.
