AN ORDINANCE AMENDING ORDINANCE NO. 11000, AS
AMENDED, THE ZONING ORDINANCE OF THE CITY OF
MIAMI, BY AMENDING: "ARTICLE 6, SPECIAL
DISTRICTS GENERAL PROVISIONS", TO ALLOW AUTO
CARE SERVICE CENTERS BY SPECIAL EXCEPTION IN
SD-14 AND SD-14.1 LATIN QUARTER COMMERCIAL -
RESIDENTIAL DISTRICTS AND AMENDING ARTICLE 25
"DEFINITIONS" TO AMEND THE DEFINITION FOR
AUTO CARE SERVICE CENTERS; CONTAINING A
REPEALER PROVISION, SEVERABILITY CLAUSE, AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Miami Planning Advisory Board, at its meeting
of December 9, 1992, Item No. 5, following an advertised hearing
adopted Resolution No. PAB 43-92 by a vote of eight to zero
(8-0), RECOMMENDING APPROVAL of amending Ordinance No. 11000 as
hereinafter set forth; and
WHEREAS, the City Commission after careful consideration of
this matter deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to amend
Ordinance No. 11000 as hereinafter set forth:
NOW THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:

Section 1. Ordinance No. 11000, as amended, the Zoning
Ordinance of the City of Miami, Florida, is hereby amended by
amending the text of said ordinance as follows: .1/
ARTICLE 6. SD SPECIAL DISTRICTS GENERAL PROVISIONS
Sec. 614. SD-14, 14.1, 14.2: Latin Quarter commercial -
residential and residential districts.

614.3.2.2. Permitted principal uses in the
SD-14 except on ground floor frontage of pedestrian -
oriented streets. In addition to all uses permitted on
ground floor frontage of pedestrian -oriented streets as
indicated in section 614.3.2.1, the following shall be
permitted either above or behind establishments
developed with such frontages, but not within such
ground floor frontage, except as provided in section
614.3.2.3:

sales of merchandise which are not more
objectionable to the public welfare than the
items listed above.
614.3.2.3. Special rules concerning extent and
location of certain uses on ground floor frontage of
pedestrian -oriented streets (SD-14). The following
rules shall apply concerning extent and location of the
following uses on ground floor frontage of pedestrian -
oriented streets:
Words and/or figures stricken through shall be deleted.
Underscored words and/or figures shall be added. The
remaining provisions are now in effect and remain unchanged.
Ellipsis and asterisks indicate omitted and unchanged
material.

Sec. 614.4. Commercial -residential district SD-14.1.

Section 2. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 3. If any section, part of this section,
paragraph, clause, phrase or word of this Ordinance is declared
invalid, the remaining provisions of this Ordinance shall not be
affected.
Section 4. This Ordinance shall become effective thirty
(30) days after final reading and adoption thereof.

ENCLOSURES: Meeting of March 25, 1993
As directed by the Commission during discussion (on first 'reading) February
25, 1993, the Planning, Building and Zoning Department has expanded
definitions of "minor automotive services and repairs" and "major automotive
services and repairs" and these are included in this legislation (on second
reading).
BACKGROUND:
"Minor automotive services and repairs" are limited to:
a. Sales and servicing related to sparkplugs, batteries, and distributors
and distributor parts.
b. Tire servicing and repair, but not recapping or regrooving;
C. Replacement of water hoses, fanbelts, brake fluid, lightbulbs, fuses,
floor mats, wiper blades, grease retainers, wheel bearings, mufflers,
shock absorbers, mirrors, and the like.
d. Provision of water, supplements for radiator fluids, and the like:
e. Washing and polishing, limited to facilities for washing one (1) car at
a time, and sale of automotive washing and polishing materials, but not
the operation of car washes;
f. Providing and repairing fuel pumps and lines;
g. Minor servicing and repair of carburetors;
h. Minor servicing of automotive air conditioners, not involving removal of
units;
i. Emergency wiring repairs;
j. adjusting and emergency repair of brakes;
k. Minor motor adjustments not involving removal of the head or crankcase;

I. Greasing and lubrication; :,
m. Sales of cold drinks, candies, tobacco, and similar convenience goods
for service station customers, but only as accessory and incidental to
the principal business operation; and
n. Provision of road maps and other informational material to customers;
provision of restroom facilities.
"Major automotive repairs and services" pertain to the engine and drive train
(which are typically under manufacturer's warranty), body work, straightening
of frames and body parts, steam cleaning, painting, and welding, or other work
generating undue noise, glare, fumes, smoke, and traffic congestion.

Article 25, Section 2502, "Definitions", to amend the definition for "auto

PLANNING
RECOMMENDATION Approval.
BACKGROUND AND At its meeting of November 12, 1992, the City Commission passed Motion
ANALYSIS M-92-728, instructing the Planning, Building and Zoning Department to prepare
the attached amendments to Zoning Ordinance 11000. These amendments are
intended to allow minor auto repair, specifically excluding the dispensing of
motor fuels incompatible with mixed commercial -residential development, in
the SD-14 Latin Quarter special district. The amendment to the definition of
auto care service center distinguishes it from automotive service stations by
excluding dispensing of fuels. The amendment distinguishes "major automotive
service and repair" from "minor automotive service and repair".
PLANNING ADVISORY At its meeting of December 9, 1992, the Planning Advisory Board adopted
BOARD Resolution PAB 43-92, recommending approval of the above by a vote of 8-0.
CITY COMMISSION The City Commission continued the above on January 28, 1993 and passed the
above on February 25, 1993 on First Reading.
