HomeMy WebLinkAboutO-11052J-93-63 2/5/93 ORDINANCE NO. 11052 AN ORDINANCE AMENDING CHAPTER 35 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "MOTOR VEHICLES AND TRAFFIC" THEREBY ADDING NEW ARTICLE VIII, ENTITLED "COCONUT GROVE PARKING IMPROVEMENT TRUST FUND", PROVIDING FOR ESTABLISHMENT OF SAID FUND, SETTING FORTH REQUIREMENTS FOR PAYMENT OF FEES IN LIEU OF REQUIRED PARKING AND MITIGATION FEES FOR SIDEWALK CAFES, SETTING FORTH THE MANNER IN WHICH FUNDS ARE TO BE DEPOSITED, AND SETTING PROVISIONS FOR EXPENDITURES FROM SAID FUND, CREATING THE COCONUT GROVE PARKING ADVISORY COMMITTEE; MORE PARTICULARLY BY ADDING NEW SECTIONS 35-191, 35-192, 35-193 and 35-194; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Coconut Grove neighborhood of the City of Miami has enjoyed a resurgence of business activity in its downtown area, especially in the evening hours, centered on entertainment and dining activities; and WHEREAS, the increase in the level of activities has generated many additional trips to the Coconut Grove Village Center by residents and visitors; and WHEREAS, the available supply of offstreet parking spaces in close proximity to the center of activities has been exhausted, and a parking deficiency is now commonplace during the evening hours; and 11052 WHEREAS, the City Commission desires to make possible the creation of new offstreet parking spaces, as well as provide for greater utilization of existing nearby spaces; and WHEREAS, the City Commission finds that the establishment of a trust fund to receive and expend funds to create and improve offstreet parking facilities serving the Village Center of Coconut Grove is in the best interest of the citizens of the City of Miami; and WHEREAS, the Miami Planning Advisory Board, at its meeting of December 9, 1992, Item No. 7, following an advertised hearing adopted Resolution No. PAB 45-92 by a vote of eight to zero (8-0), RECOMMENDING APPROVAL WITH MODIFICATIONS (such modifications pertaining to a grandfather clause for sidewalk cafes in compliance) of amending the City Code as hereinafter set forth; and WHEREAS, the City Commission after careful consideration of this matter deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to amend the Code of the City of Miami, Florida, as amended, as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in the Section. 11052 - 2 - Section 2. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section S. It is the intention of the City Commission that the provisions of this Ordinance shall become and be made a part of the Code of the City of Miami, Florida, as amended, which provisions may be renumbered or relettered and that the word "ordinance" may be changed to "section", "article", or other appropriate word to accomplish such intention. 11052 InLim Section 6. PLANNING RECOMMENDATION Approval BACKGROUND AND The proposed amendment to Chapter 35 of the City Code: 1) establishes the ANALYSIS "Coconut Grove Parking Improvement Trust Fund" for the purpose of facilitating public offstreet parking by providing public parking facilities or subsidizing a shuttle to make use of Dinner Key (and other) lots; 2) establishes a Coconut Grove Parking Advisory Committee; and 3) authorizes a fee in lieu of required parking in the SD-2 and SO-17 zoning districts of $10,000 per parking space or $40 per space per month for restaurants and other uses; and $4.80 per sq. ft. annually for sidewalk cafes. For restaurants which provide required parking, but beyond 600 feet, the fee would be reduced by 254. PLANNING ADVISORY At its meeting of December 9, 1992, the Planning Advisory Board W" adopted Resolution PAB 45-92, by a vote of 8-0, recommending approval with modifications regarding inclusion of a grandfather clause for those sidewalk cafes in conformity.
