ORDINANCE NO. 11044
AN ORDINANCE AMENDING SECTION 38-73 OF THE
CODE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED, CONCERNING THE BAYFRONT PARK
MANAGEMENT TRUST, BY PROVIDING THAT A CITY
COMMISSIONER, APPOINTED BY THE CITY
COMMISSION, SHALL SERVE EX OFFICIO AS A
VOTING MEMBER AND CHAIRPERSON OF THE BAYFRONT
PARK MANAGEMENT TRUST, FOR A TERM OF OFFICE
AS PROVIDED BY RESOLUTION, WITH SAID TERM TO
BE REVIEWED BY THE CITY COMMISSION ON OR
ABOUT JUNE 1ST OF EACH CALENDAR YEAR,
RESULTING IN THE SELECTION OF A NEW
CHAIRPERSON OR THE REAPPOINTMENT OF THE
EXISTING CHAIRPERSON; CONTAINING A REPEALER
PROVISION, SEVERABILITY CLAUSE, AND PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, Section 38-73 of the Code of the City of Miami,
Florida, as amended, provides for the composition of the Bayfront
Park Management Trust, the method of appointment of Trust Members
and their respective terms of office; and
WHEREAS, the City Commission wishes to amend said Code
Section to provide that a City Commissioner shall serve ex
offioio as a voting member and chairperson of the Bayfront Park
Management Trust; and
WHEREAS, the members of the City Commission desire to
establish a policy whereby the terms of all Commissioners serving
as Chairpersons of City Boards are reviewed on or about June 1st
of each calendar year;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:

Section 1. Section 38-73 of the Code of the City of
Miami, Florida, as amended, is hereby amended in the following
particulars:I/
"Sec. 38-73. Governing body.
(a) Composition; appointments; term of office.
(1) The trust shall consist of twenty-one (21) members,
chaff rrpArson of the trust. Each member of the trust
shall reside or have its principal place of business
in the City of Miami and shall be an individual of
outstanding reputation for integrity, responsibility
and commitment to serving the community. One--(t)
member of tile trust.
(2) The initial appointments to the trust shall be made
in the following manner: Bayfront Park Management
Trust Corporation, an existing not -for -profit
corporation, shall submit a slate of fifteen (15)
names, and the city commission may veto any or all
of the proposed names on said slate. Should the
city commission veto any name, the trust shall
submit an additional name, whose appointment shall
likewise be subject to the city commission's veto
power. In addition, each member of the city
commission shall appoint one (1) additional member
to the trust, and
the term of
the city commissioner serving as the ex officio
a new chairperson or the reappointment of the
existing chairperson. Five (5) of the initial
fifteen (15) members appointed from the slate of
names shall be appointed to serve one-year terms,
five (5) shall be appointed to serve two (2) year
terms, and five (5) shall be appointed to serve
three-year terms. Each initial trustee appointed by
each city commissioner shall serve three-year terms.

Section 2. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 3. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 4. This Ordinance shall become effective
June 1, 1993.

That flies in the face of the Mi-
ami City Commission, which is
scheduled to enact an ordinance
March 11 to have a. commissioner
chair the trust
Commissioner J.L Plummer, a
non -voting or ex oJj'icio trust mem-
ber, has often complained he
doesn't know why he's involved it
he can't vote. The commission
agreed and has extended its policy
to make commissioners chairs for
various city boards and committees
to include the park.
The trust has opposed that move,
saying it wants to keep politics out.
Last week, the nominating com-
mittee met before a regular park
trust meeting to decide new mem-
bers and the slate of officers.
Despite the ordinance, the com-
mittee went ahead with its recom-
mendations.
"We should do what's best fo,
the park," said Alan Weisberg
nominating committee chairman
"If they disagree, the yy disagree."
The slate includes U. Gouraigt
as chairman, Rodney Barreto a.•
vice chairman, Matthew Schwartz
as secretary, and JpAnu Pepper a.,
treasurer.
