AN EMERGENCY ORDINANCE ESTABLISHING EIGHT (8) NEW SPECIAL REVENUE FUNDS ENTITLED: "JTPA TITLE I/OLDER WORKER (PY'92)", "JTPA TITLE IIA/NEIGHBORHOODS JOBS PROGRAM (PY'92)", "JTPA TITLE II/"EMERGENCY" JOBS (PY'92)", "JTPA TITLE II STAY -IN SCHOOL PROGRAM (PY'92)", "DHRS/RCA (PY'92)", "JTPA TITLE III HURRICANE ANDREW RETRAINING PROGRAM (PY'927', "JTPA TITLE IIB SUMMER YOUTH EMPLOYMENT AND TRAINING PROGRAM (PY'92)" AND "OFFICE OF INTERGOVERNMENTAL LIAISON (PY'92)" AND APPROPRIATING FUNDS FOR OPERATION OF EACH COMPONENT IN THE RESPECTIVE AMOUNTS OF $19,392, $767,399, $235,480, $14,385, $58,632, $300,000, $685,000, AND $60,000 FROM U.S. DEPARTMENT OF LABOR GRANT AWARDS; AUTHORIZING THE CITY MANAGER TO ACCEPT THE AFOREMENTIONED GRANT AWARDS AND ENTER INTO THE NECESSARY AGREEMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, WITH THE SOUTH FLORIDA EMPLOYMENT AND TRAINING CONSORTIUM; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the Congress of the United States adopted Public Law 97-300, the Job Training Partnership Act (JTPA) on October 13, 1982, to establish programs to prepare youth and unskilled adults for entry into the labor force and to afford job training to economically disadvantaged persons and other individuals facing serious barriers to employment, who are in special need of such training to obtain productive employment; and 11040 WHEREAS, the City operated the Neighborhoods Jobs Program in FY'92 to meet the mandate of the aforementioned Public Law; and WHEREAS, the South Florida Employment and Training Consortium has awarded the City $19,392 to place older workers under Title I of the JTPA Older Workers Program; and WHEREAS, the South Florida Employment and Training Consortium has awarded the City $767,399 under Title IIA to place persons from the general population, ex -offenders, recipients of aid for dependent children, and handicapped persons; and WHEREAS, the South Florida Employment and Training Consortium has awarded the City $235,480 under Title IIB to place youths affected by Hurricane Andrew in temporary jobs; and WHEREAS, the South Florida Employment and Training Consortium has awarded the City $58,632 of DHRS/RCA funds from the Department of Health and Rehabilitative Services to provide employment services to entrants/refugees; and WHEREAS, the South Florida Employment and Training Consortium has awarded the City $300,000 of Title III funds to provide retraining in construction trade areas for those affected by Hurricane Andrew; and WHEREAS, the South Florida Employment and Training Consortium has awarded the City $685,000 of Title IIB funds to operate a Summer Youth Employment Program in 1993; and WHEREAS, the City of Miami is a member of the South Florida Employment and Training Consortium along with the jurisdictions of Hialeah, Miami Beach, Dade County and Monroe County; and 11040 -2- WHEREAS, the South Florida Employment and Training Consortium has awarded the City $60,000 to continue liaison services with the Consortium; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. This appropriation is contingent upon funding by the South Florida Employment and Training Consortium and the City Manager's acceptance thereof. Section 4. The City Manager is hereby authorized to accept the grants and to enter into the necessary agreements, in a form acceptable to the City Attorney, with the South Florida Employment and Training Consortium. Section 5. The herein authorization shall remain valid and outstanding even if the anticipated grant award is reduced or increased. Section 6. All ordinances or parts of ordinances insofar as they are in conflict with the provisions of this Ordinance are hereby repealed. -5- 11040 Section 7. If any section, part of section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 8. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need to implement the proposed programs immediately in order to address the needs of persons participating in the programs; for the preservation of peace, health, safety, and property of the City of Miami; and upon the further grounds of the necessity to make the required and necessary payments to its employees and officers, payment of its debts, necessary and required purchases of goods and supplies, and to generally carry on the functions and duties of municipal affairs. Section 9. The requirement of reading this Ordinance on two separate days is hereby dispensed with by an affirmative vote of not less than four -fifths of the members of the Commission. Section 10. Odio 'City Manager RECOMMENDATION: DATE elf j� d — % 199 3 FILE SUBJECT: Emergency Appropriation Ordinance for JTPA and DHRS Programs REFERENCES commission Agenda Item ENCLOSURES: March 11, 1993 It is respectfully recommended that the City Commission adopt the attached Emergency Ordinance which establishes eight (8) new special revenue funds entitled: "JTPA Title I/Older Worker (PY'92)", JTPA Title IIA/Neighborhood Jobs Program (PY'92)", "JTPA Title II/"Emergency" Jobs (PY'92)", "JTPA Title II Stay -in -School Program (PY'92)", "DHRS/RCA (PY'92)", "JTPA Title III Hurricane Andrew Retraining Program (PY'92)", "JTPA Title IIB Summer Youth Employment and Training Program (PY'92)" and "Office of Intergovernmental Liaison (PY'92)", appropriating funds for the operation of each component in the respective amounts of $19, 392, $767,399, $235,480, $14,385, $300,000, $685,000 and $60,000 from the Department of Labor grant awards and $58,632 from the Department of Health and Rehabilitative Services through the South Florida Employment and Training Consortium. BACKGROUND: The Department of Community Development has prepared legislation appropriating funds and establishing the following ' eight (8) special revenue funds as a result of grant awards from the South Florida Employment and Training Consortium (SFETC): 1. JTPA Title I/Older Workers (PY'92) - The SFETC awarded the City $19,392 to provide employment services to older workers. 2. JTPA Title IIA/Neighborhood Jobs Program (PY'92) - The SFETC awarded the City $767,399 to provide employment services to the general population, ex -offenders, recipients of aid to dependent children and handicapped persons. 3. JTPA Title IIB/"Emergency" Jobs Program (PY'92) - The SFETC awarded the City $235,480 to place youths affected by Hurricane Andrew in temporary jobs. 4. JTPA Title IIB/Stay-in-School Program (PY'92) - The SFETC awarded the City $14,385 to operate the Stay -in -School Program for youths. 5. DHRS/RCA (PY'92) - The SFETC awarded the City $58,632 from the Department of Health and Rehabilitative Services to provide employment services to entrants and refugees. JTPA Title III/Hurricane Andrew Retraining Program (PY'92) - The SFETC awarded the City $300,000 to provide retraining in construction trade areas for those affected by Hurricane Andrew. 7. JTPA Title IIB/Summer Youth Employment and Training Program (PY'92) - The SFETC awarded the City $685,000 to operate a Summer Youth Employment and Training Program. B. Intergovernmental Liaison (PY'92) - The SFETC awarded the City $60,000 to continue liaison services with the Consortium. The aforementioned programs are operated in the Neighborhood Jobs Program of the Department of Community Development. Adoption of the proposed legislation establishes the above referenced new special revenue funds and appropriates funds for each account as outlined above. This legislation also authorizes the City Manager to accept each grant award and enter into agreements with the South Florida Employment and Training Consortium. This is being presented as an Emergency Ordinance in order to immediately implement the proposed programs and address the needs of those unemployed.
