ORDINANCE NO. 11038
AN ORDINANCE ESTABLISHING A NEW SPECIAL
REVENUE FUND ENTITLED "TRANSPORTATION
PLANNING AND COORDINATION"; APPROPRIATING
FUNDS FOR THE OPERATION OF SAME IN THE
AMOUNT OF $155,000 CONSISTING OF A $120,000
GRANT FROM THE METROPOLITAN PLANNING
ORGANIZATION FOR THE MIAMI URBANIZED AREA
"MPO", $35,000 FROM PRIVATE DEVELOPER
CONTRIBUTION, OF WHICH $5,000 IS AN
OVERMATCH; MAKING APPROPRIATION; FURTHER,
AUTHORIZING THE CITY MANAGER TO ACCEPT THE
AFOREMENTIONED GRANT AWARD AND ENTER INTO
THE NECESSARY AGREEMENT(S), IN A FORM
ACCEPTABLE TO THE CITY ATTORNEY, WITH THE
MPO; CONTAINING A REPEALER PROVISION AND A
SEVERABILITY CLAUSE.
WHEREAS, The Metropolitan Planning Organization for the
Miami Urbanized Area ("MPO") is the recipient of federal
transportation planning funds under Section 9 of the Intermodal.
Surface Transportation Efficiency Act; and
WHEREAS, the MPO, by Resolution No. 20-92, adopted June 12,
1992, directed that some of these planning funds be used to
establish a fund to assist the municipalities of Dade County in
coordination of their transportation planning with that of the
MPO; and
WHEREAS, the City of Miami, by Resolution No. 92-715,
adopted November 12, 1992, authorized and directed the City
Manager to apply for a grant of $120,000 from the MPO for the
purpose of enhancing and expanding the City of Miami's
transportation planning and coordinating activities; and

WHEREAS, the MPO has offered the City of Miami a grant of
$120,000 for Fiscal Year 1993, to be matched by at least 20%
local funds; and
WHEREAS, the City of Miami in 1987 accepted $100,000 from a
private developer contribution, of which $65,000 was spent for
traffic studies of Coconut Grove, leaving the sum of $35,000
uncommitted and available for transportation planning studies,
which amount is available for matching purposes, and will provide
a $5,000 overmatch to be applied to a second year grant;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The following Special Revenue Fund is hereby
established and resources are hereby appropriated as described
herein:

Private developer contribution $ 35,000

Section 3. The City Manager
is
hereby
authorized
to
accept the aforementioned grant award
on
behalf
of the City
of

Miami and enter into the necessary contract and/or agreement(s),
in a form acceptable to the City Attorney, with the Metropolitan
Planning Organization for the Miami Urbanized area.
Section 4. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 5. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 6. This Ordinance shall become effective thirty
(30) days after final reading and adoption thereof.

RECOMMENDATION
It is recommended that a grant from the Metropolitan Planning Organization in
the amount of $120,000 be accepted, as matched by $35,000 in private developer
contribution which includes a $5,000 overmatch to be applied toward a second -
year grant, for transportation planning and coordination; that a special
revenue fund "Transportation Planning and Coordination" be established and
funds appropriated, and authorizing the Manager to enter into the necessary
interlocal agreement.
BACKGROUND
The Planning, Building and Zoning Department applied to the Metropolitan
Planning Organization for a grant as authorized by Resolution 92-715, adopted
November 12, 1992. The grant, as awarded, consists of $120,000 from the MPO,
which will be matched by $30,000 plus a $5,000 overmatch from private
developer contribution. The overmatch will apply toward matching the second
year grant.
The funds will be used over the next 12 months for transportation planning
studies within the City of Miami, as outlined in the attached letter of
October 14, 1992 to Jose Luis Mesa, Director of the MPO Secretariat, and the
following specific projects:
1. Charles Avenue one -war analysis
2. Upper East side barricade analysis
3. Local impacts of SR 836 widening
4. South Grove traffic diversion plan

It is recommended that the City Commission adopt on second reading the
Ordinance accepting a grant from the Metropolitan Planning Organization (MPO)
in the amount of $120,000, as matched by $35,000 in private developer
contribution which includes a $5,000 overmatch to be applied toward a second -
year grant. The Ordinance establishes a special revenue fund "Transportation
Planning and Coordination,and appropriates funds to it, and authorizes the
Manager to enter into the necessary agreement with the MPO. The Scope of Work
for the funds has been modified per City Commission instructions at first
reading of the Ordinance.
BACKGROUND
The City Commission passed the subject Ordinance on first reading January 14,
1993, subject to the condition that at least one-third of the grant funds be
utilized for transportation studies through the City's International Trade
Board. Accordingly, the Scope of Work for the grant funds, a copy of which is
attached, has been amended to reflect this condition. The amended Scope also
includes, as item 7, four local projects discussed earlier by the Commission.

MPO MUNICIPAL PLANNING GRANT PROGRAM

SCOPE OF WORK
As amended to January 14, 1993
Attendance by the City's Transportation Planner and other City staff as
appropriate, at MPO meetings of the Governing Board (MPO Board),
Transportation Planning Council (TPC), Transportation Plan Technical
Advisory Committee (TPTAC), and special committees and task forces as
may be engaged in transportation planning, coordination, and
implementation activities within the City of Miami.
2. Preparation of data and analysis, and recommendation reports on
transportation plans, policies, and implementation proposals for projects
within or directly affecting the City of Miami.
3. Response to requests for information by State, County, or municipal
entities regarding transportation activities in the City of Miami.
4. Preparation of analyses and proposals for transportation -related projects
eligible for funding under the federal Intermodal Surface Transportation
Efficiency Act (ISTEA) within the City of Miami.
5. Relate transportation project proposals to the City's neighborhoods under
the Neighborhood Enhancement Team (NET) program, providing
additional opportunity for citizen input on transportation proposals and
support for vital improvements.
6. Perform transportation planning surveys, analyses, and studies in the
Wynwood/Allapattah areas of the City through the City's International
Trade Board and its staff. It is anticipated that approximately one-third of
the transportation planning effort under this grant will be utilized to
formulate these studies, policy recommendations and action plans to
improve transportation access and efficiency in the area.
7. Other specific planning studies and recommendations to be performed
under this grant include Charles Avenue one-way analysis, the Upper
Eastside barricade analysis; study and evaluation of the local impacts of the
proposed S.R. 836 improvements; and the South Grove Traffic Diversion
Plan.
