Dear Mr. Lee:
It was a pleasure meeting you on Monday, May 17, 1993, with
regard to the captioned matter. My clients and I appreciate the
interest and concerns which you have demonstrated to us and your
willingness to assist us with this matter.
As we discussed, when my clients purchased the captioned
property the coral rock wall was already in place. They were not
made aware that the wall was located on the City's right-of-way.
Thereafter, my clients have had other work done to the property
(i.e. building of a brick driveway) and have requested the required
permits without any difficulties. It was only after the recent
hurricane, when they attempted to get a permit to repair the coral
rock wall, did the current problem surface. Their permit request
was rejected, and they were informed that the wall was located in
the City's right-of-way.
I confirm that my clients' sole intention at this time is to
repair the existing coral rock wall, which surrounds the property.
My clients now are aware that this wall, as presently located, is
on City owned property. They are also aware that if the City
decides to either expand the road way or build a side walk, that
they would have to remove said wall. My clients simply want the
property to remain as they purchased it, and enter into an
Agreement with the City whereby they would agree to remove the wall
should the City decide to exercise its ownership of the right-of-
way, in the future.

We would request an opportunity to discuss this matter before
the City commission, in an attempt to find a prompt and amicable
resolution to the ongoing dispute. In the interim, we would request
an abeyance of any and all notices of violation and fines which
may accrue against my clients pending the final resolution of this
matter. Therefore, should an opportunity arise and/or should you
deem it to be advisable, we would request an audience before the
City Commission to discuss this problem.
Again we appreciate the opportunity discuss this matter with
