The city commission has discussed with you on numerous occasions: �-
1. The possibility of not pursuing vehicles at 100 MPH, because
of the inherent dangers to life and property;, usually resulting
from such chases which are sometimes For minor offences.
2. To forbid the use of the Lateral Vascular Restraint, by the
City of Miami Police Department.
A copy of Chief Ross' December 22, 1993 memorandum leaves much to be desired, "we will either adopt the policy in its entirety..,,"

Please provide me with information about your establishing a
policy for the commission to act on at the February 1992,
commission meeting, or have someone explain the status of both
policies/procedures.

Vehicular :pursuit
ME
Since the recent ruling by the Florida supreme Court in the case
of Pinellas Park -vs- Brown, the police department has been in
the process of reviewing vehicular pursuit policies from other
law enforcement agencies.
The new policy of the Florida highway Patrol has been reviewed
and has been found to be a very restrictive one, ostensibly
intended to reduce the possibility of incurring liability
associated with vehicular pursuits.
Presently, the Dade County Associations of chief's of Police is in
the process of formulating a policy for county wide adoption.
Once this task is completed, we will either adopt the policy in
its entirety, or change our present policy to the extent that we
may deem necessary to avert the possibility of incurring pursuit
related liability.
I will advise you of our final decisi6n at such time as one has
been rendered by the Dade County Chiefs of Police and the Miami
Police Department. Should you regvire additional information on

The Miami Police Department is in the process of changing our
Pursuit Policy, in concert with the Dade County Association of
Chiefs of Police. Their Policy Committee submitted a draft of a
recommended policy to all Chiefs in Dade County the week of December
14th and solicited input as to proposed revisions. The D.C.A.C.P.
Committee meets again on January S. 1993, for purposes of finalizing
a recommended policy, which will be reviewed by the Executive Board
on January 20th.
it is our intent to conform with the guidelines gIiven by our
neighboring jurisdictions and we have actively participated in the
development of this revised policy. In the interim, we have
reminded our officers, by official bulletin, to adhere to our
existing policy, which is comprehensive and consistent with the
D.C.A.C.P. policy in, place in Dade County since 1984-yn
anticipation of approval, we have taken the recent draft and are
putting it into Departmental order format for distribution to our
personnel.
