A RESOLUTION BY A 4/STHS AFFIRMATIVE VOTE OF
THE MEMBERS OF THE CITY COMMISSION AFTER A
DULY ADVERTISED PUBLIC HEARING, RATIFYING THE
CITY MANAGER'S FINDING THAT AN EMERGENCY NEED
EXISTED, WAIVING THE REQUIREMENTS FOR
j COMPETITIVE SEALED BIDS AND APPROVING THE
LEASE OF EQUIPMENT, INCLUDING GENERATORS,
LIGHT STANDARDS, PORT-O-LETS, AND OTHER
j NECESSARY ITEMS FROM THE HEREIN SPECIFIED
VENDORS, AT A COST OF $50,000 FOR THE
DEPARTMENT OF POLICE; ALLOCATING FUNDS
THEREFOR FROM THE DEPARTMENT OF POLICE,
GENERAL OPERATING BUDGET ACCOUNT CODE NOS.
290201-610 AND 290201-510; AUTHORIZING THE
CITY MANAGER TO INSTRUCT THE CHIEF
PROCUREMENT OFFICER TO ISSUE PURCHASE ORDERS
FOR THIS EQUIPMENT.
WHEREAS, the Department of Police needs to lease equipment
to assist with the instituted pilot program directed at the
reduction of violent tourist crimes; and
WHEREAS, in order to continue the program, until such time
as permanent arrangements can be made, the Department must lease
several pieces of equipment for the two (2) established Tourist
Information Centers located near the expressways; and
WHEREAS, funding for said acquisition is available from the
Police Department's General Operating Budget, Account Code Nos.
290201-510 and 290201-610; and
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:

Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. By 4J5ths affirmative vote of the members of
the City Commission, after a duly advertised public hearing, the
City Manager's written finding that a valid emergency need
{ existed for the lease of equipment, including generators, light
standards, Port-O-Lets, and other necessary items from RB Grove,
Waste Management Company, Neff Rental, Cellular One, and
Zephyrhill, Inc., at a cost of $50,000 for the Department of
Police is hereby ratified, confirmed and approved, with funds
therefor hereby allocated from the Department of Police General
Operating Budget, Account Code Nos. 290201-610 and 290201-510.

Section 3. The requirements for competitive sealed bids is
hereby waived for the Department of General Services
Administration's acquisition of the above equipment.
Section 4. The City Manager is hereby authorized to
instruct the Chief Procurement Officer to issue a purchase order
for this equipment.
Section 5. This Resolution shall become effective
immediately upon its adoption.

It is respectfully recommended that a Resolution ratifying the
City Manager's emergency action authorizing the expenditure of
funds for the lease of equipment, including generators, light
standards, Port-O-Lets, and other necessary items, at a cost of
$50,000, be approved.
BACKGROUND:
The Police Department instituted a pilot program directed at the
reduction of violent tourist crimes. By establishing two Tourist
Information Centers near the expressways, the Department has been
diverting those tourists unfamiliar with the area out of
potentially dangerous situations.
In order to continue the program, until such time as permanent
arrangements can be made, the Department must lease several
pieces of equipment. Establishing formal bids at this time would
be inefficient, since any permanent structures would include all
of these items.
It is, therefore, recommended that the Resolution ratifying the
City Manager's emergency action and authorizing the expenditure
of $50,000 for the lease of this equipment, be approved. Funding
was provided from the Police Department General Operating Budget,
Index Code 290201-610 (appx. $3,680/month), 290201-510 (appx.
$2,000/month).

Your emergency approval authorizing the Police Department to
forego the formal bid process in utilizing equipmentnecessary

NOTICE TO THE PUBLIC
A public hearing will be held by the City Commission of the City
of Miami, Florida on December 1, 1994, at 10:00 a.m. in the City
Commission Chambers at City Hall, 3500 Pan American Drive, Miami,
Florida, for the purpose of considering a waiver of the
requirements of obtaining sealed bids and ratifying the City
Manager's finding of an emergency for the expenditure of funds to
lease equipment, including generators, light standards, Port-0-
Lets, and other necessary items. These items were provided by:
Light Towers - Neff Rental, 4343 N.W. 76th Avenue, Miami, FL
33166, at a cost of $1,000 per month; Generators - R.B. Grove,
Inc., 261 S.W. 6 Street, Miami, FL 33130, at a cost of $2,500 per
month; Port-O-Lets - Waste Management, c/o Marietta Processing,
P.O. Box 105468, Atlanta, GA 30348, at an average cost of $60
per month; Cellular Phones - Cellular One, P.O. Box 9448, Ft.
Lauderdale, FL 33310, at an average cost of $2,000 per month;
Miscellaneous Supplies - Zephryhill, 2000 Westridge Drive,
Irvington, TX 75030, at an average cost of $120 per month.
