A RESOLUTION AUTHORIZING AN INCREASE IN THE
AMOUNT OF $7,227.58 IN THE CONTRACT BETWEEN
THE CITY OF MIAMI, FLORIDA AND MET
CONSTRUCTION, INC., DATED AUGUST 23, 1993,
FOR THE PROJECT ENTITLED BAYFRONT PARK
REDEVELOPMENT -SOUTH END PHASE I, B-2987;
ALLOCATING FUNDS THEREFOR FROM PROJECT
NO. 331305, AS APPROPRIATED BY THE CAPITAL
IMPROVEMENT ORDINANCE NO. 11205; FURTHER
RATIFYING THE CITY MANAGER'S WRITTEN FINDING
THAT THE HEREIN INCREASE RESULTED FROM
EMERGENCY CIRCUMSTANCES BY AN AFFIRMATIVE
VOTE OF FOUR -FIFTHS OF THE MEMBERS OF THE
CITY COMMISSION.
WHEREAS, there exists a contract dated August 23, 1993,
between the City of Miami, Florida, and MET CONSTRUCTION, INC.,
in the amount of $812,779.00 for construction of the project
entitled "Bayfront Park Redevelopment -South End Phase I, B-2987";
and
WHEREAS, on January 13, 1994 and April 14, 1994, the City
Commission approved increases of $46,623.40 and $34,958.27,
respectively, in the contract; and
WHEREAS, the total contract amount presented is $894,360.07
due to the previously approved increases; and
WHEREAS, the Director of Public Works and the City Manager
recommend an increase in the amount of $7,227.58 in said contract
to cover additional work; and

WHEREAS, the new total contract amount will be $901,588.25
due to the increase of $7,227.58; and
WHEREAS, the City Manager has made a written finding that a
valid emergency existed for the work to continue to protect the
health, safety and welfare of the citizens of the City; and
WHEREAS, funds are available to cover said increase under
Capital Improvement Project No. 331305;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The contract between the City of Miami,
Florida and MET Construction, Inc., dated August 23, 1993, for
the project entitled "Bayfront Park Redevelopment -South End Phase
I, B-2987", is hereby increased in an amount not to exceed
$7,227.58, from $894,360.67 to $901,558.25, with funds therefor
hereby allocated from Capital Improvement Project No. 331305, as
appropriated by 1994-95 Capital Improvement Ordinance No. 11205.
Section 3. After a properly advertised public hearing,
the emergency findings of the City Manager set forth in the
Preamble to this Resolution are hereby ratified by an affirmative
vote of four -fifths of the members of the City Commission.
Section 4. This Resolution shall become effective
immediately upon its adoption.

It is respectfully recommended that the City Commission adopt the attached Resolution
authorizing an increase in the contract between MET Construction, Inc. and the City of
Miami for Bayfront Park Redevelopment - South End, Phase I in the amount of
$7,227.58; and further ratifying the City Manager's written finding that the increase
resulted from emergency circumstances.
The Department of Public Works, in an effort to serve all residents of the City of Miami,
has determined that it is now appropriate and in order for the City Commission to ratify
the City Manager's decision to increase the contract dated August 23, 1993 between the
City of Miami and MET Construction, Inc. for construction of Bayfront Park
Redevelopment -South End Phase I, B-2987. The increase in the amount of $7,227.58
resulted from the City Manager's emergency finding that allowed for extra necessary
work.
The City Commission awarded a contract to MET Construction, Inc. for the construction
of Bayfront Park Redevelopment -South End Phase I under CIP Project No. 331305, in
the amount of $812,779.00 on August 23, 1993. On January 13, 1994 and on April 14,
1994 the City Commission approved increases of $46,623.40 and $34,958.27,
respectively in the Contract. Generally, the project consisted of furnishing of all labor,
materials and equipment for the construction of a performance area at the South End of
Bayfront Park including site development.
The extra work consists of four (4) light fixtures, conduit and wiring to complete the
facility. Funds are available for the aforesaid contract increase from monies already
allocated in Capital Improvement Project No 331305.

for discussions pertaining to ratifying the City Manager's
written finding that a valid emergency exists to increase the
contract between the City of Miami and MET Construction, Inc., in

Redevelopment- South End - Phase I, B-2987.
The public hearing has been scheduled for December 1, 1994.

NOTICE OF PUBLIC HEARING
A public hearing will be held by the Commission of the City of
Miami, Florida, on December 1, 1994 at 10:00 a.m. in the City
Commission Chambers at City Hall, 3500 Pan American Drive, Miami,
Florida, for the purpose of hearing objections from any
interested parties affected by the ratifying of the City
Manager's written finding that a valid emergency exists to
increase the contract between the City. of Miami and MET
Construction, Inc., in the amount of $7,227.58 for the project
entitled Bayfront Park Redevelopment South End Phase I, B-2987.
All interested persons are invited to appear and may be heard
concerning the ratifying of the City Manager's written finding
for aforesaid contract increase
Should any person desire to appeal any decision of the City
Commission with respect to any matter considered at this hearing,
that person shall ensure that a verbatim record of the
proceedings is made, including all testimony and evidence upon
which any appeal may be based.
