RESOLUTION 9 4 - 857
A RESOLUTION APPROVING THE FINDINGS OF THE
COMPETITIVE SELECTION COMMITTEE AS TO THE
MOST QUALIFIED TEAMS, IN RANK ORDER, TO
PROVIDE PROFESSIONAL SERVICES IN CONJUNCTION
WITH THE PREPARATION OF THE COCONUT GROVE
PLANNING STUDY; AUTHORIZING THE CITY MANAGER
OR HIS DESIGNEE TO UNDERTAKE NEGOTIATIONS
WITH THE MOST QUALIFIED TEAMS, IN RANK ORDER,
UNTIL HE ARRIVES AT AN AGREEMENT WHICH IS
FAIR, COMPETITIVE AND REASONABLE, AND FURTHER
DIRECTING THE CITY MANAGER TO PRESENT THE
NEGOTIATED AGREEMENT, IN A FORM ACCEPTABLE TO
THE CITY ATTORNEY, TO THE CITY COMMISSION FOR
ITS RATIFICATION AND APPROVAL.
WHEREAS, the City of Miami, pursuant to Resolution

No. 93-639, adopted October 21, 1993, designated as a

Category "B" Project, the acquisition of professional planning
services for the Coconut Grove Planning Study; and
WHEREAS, pursuant to Resolution No. 93-693, the City
Commission appointed Sergio Rodriguez, Assistant City Manager
I
(or his designee) as chairperson of the Competitive Selection
Committee, and established a Certification Committee of not less
than three professionals in the fields of endeavor or practice
involved, to review the qualifications, performance data, and
I related information provided by those responding to the City's
Request for Qualifications; and
WHEREAS, the City of Miami issued a I Request for
Qualifications for professional land use planning, urban design,

historic preservation, architectural, landscape architectural,
implementation planning and transportation engineering and
planning services on September 1, 1994; and
WHEREAS, the Certification Committee met on September 26th
and October 6th, 1994 and certified four teams as being
responsive to the City's Request for Qualifications; and
WHEREAS, the Consultant Selection Committee, consisting of
twenty (20) members, with four (4) employed by the City of
Miami, four (4) being professionals from the practices involved,
heard presentations and interviewed three certified teams on
October 17, 1994; and
WHEREAS, the selection procedures were performed in
accordance with the Consultants Competitive Negotiation Act as
set forth in Section 287.055 of the Florida Statutes and
Ordinance No. 9572, adopted February 10, 1983 and codified as
Section 16-52.3 of the Code of the City of Miami;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The City Commission hereby approves the
findings of the Competitive Selection Committee of the following

professional land use planning, urban design, historic
preservation, architectural, landscape architectural,

Section 3. The City Manager or his designee is hereby
authorized`/ to negotiate a professional services agreement on
behalf of the City of Miami with the team ranked first as set
forth in Section 2 herein. In the event that the City Manager
or his designee cannot negotiate an agreement which, in his
opinion, is fair, competitive and reasonable with the team
ranked first, then he is hereby authorized to formally terminate
such negotiations. The City Manager or his designee shall then
undertake negotiations with the team ranked second. In the
event that he fails to negotiate a satisfactory agreement with
the second team, then the City Manager or his designee is
authorized to undertake negotiations with the third most
qualified team.
Section 4. The City Manager is hereby directed to
present the negotiated agreement, in a form acceptable to the
City Attorney, to the City Commission for its ratification and
approval.
The herein authorization is further subject to compliance
with all requirements that may be imposed by the City
Attorney, including but not limited to those prescribed by
applicable City Charter and Code provisions.

immediately upon its adoption.

I. PUBLIC NOTICE:
CITY OF MIAMI, FLORIDA
REQUEST FOR PROFESSIONAL SERVICES
COCONUT GROVE PLANNING STUDY
The City of Miami, is seeking the professional services of a qualified and
experienced consulting team, with a general planning firm as the prime
consultant, for the planning and preparation of a comprehensive plan for
theCoconut Grove neighborhood in the City of Miami.
The consulting team must have the ability to provide professional land use
planning, urban design, historic preservation, architectural, landscape
architectural services, implementation planning, and transportation
engineering and planning. The professional services agreement for this project
will result in a document which will assess current conditions and propose
recommendations for an overall general plan for Coconut Grove.
Interested firms must contact Joseph W. McManus, Deputy Director of the
Planning, Building, and Zoning Department for the City of Miami located at
275 NW 2nd St., 3rd floor, Miami, Florida, 33128, telephone (305) 579-6086 for
the Request for Qualifications Document (RFQ) which will be issued September
1, 1994. The RFQ contains detailed and specific information about the scope
of services, submission requirements and selection procedures.
Minority participation is required persuant to the City of Miami's Minority
Procurement Program, Ordinance No. 10062, as amended by Ordinance No. 10538.
Minorities are expected to be an integral part of the consulting team through
the ownership of the planning or architectural firms providing the required
expertise as prime or subconsultants, as well as through the participation of
minority individuals assigned to the project. For the purpose of the proposal
evaluation, significant minority participation will be defined by the
occurrence of a Black, Hispanic and/or Female owned firm as the prime
consulting firm in the participation of minorities assigned to the project or
subconsulting firms that are part of the team.
Submission packages must be delivered to the City Clerk's Office, first floor
counter, City Hall, City of Miami, 3500 Pan American Drive, Miami, Florida,
33131, not later than 3:00 PM on September 21, 1994. The City Clerk's clock
will be used as the official time of submission.
The City of Miami reserves the right to accept any proposal deemed to be in
the best interest of the City, waive any irregularities in any proposal,
reject any proposal, and to re -advertise for new proposals if necessary.

It is respectfully recommended that the City Commission adopt the attached
resolution approving the findings of the Competitive Selection Committee as to
the most qualified teams, in rank order, to conduct the Coconut Grove Planning
Study; authorizing negotiations with the most qualified teams, in rank order
and further directing the City Manager to present the negotiated agreement, in
a form acceptable to the City Attorney, to the City Commission for its
ratification and approval.
BACKGROUND:
At the City Commission meeting of October 27, 1994, (Agenda Item 43) the
Commission continued this item to November 17th, and requested three -minute
presentations by the consultants. Teams will present in recommended rank
order as follows:

Study as a Category B Project and appointed a Certification Committee and
Chairperson of a Competitive Selection Committee. The Request for
Qualifications (RFQ) to provide Professional Services was released on
September 1, 1994; 30 RFQ's were mailed out and four teams responded by the
deadline on September 21, 1994. The Certification Committee met on September
26 and subsequently on October 6, 1994, and qualified four teams. The
Competitive Selection Committee met on October 17, interviewed three teams,
and found the following teams in rank order, as the most qualified to provide
professional land use planning, urban design, historic preservation,

BACKGROUND
By Motion 93-211, on March 25, 1993, the Commission directed the
Administration to engage consultants to conduct a planning study for Coconut
Grove and to work jointly with the Cocoanut Grove Village Council but the
Commission was to retain control of funds.
By Resolution 93-639, October 21, 1993, the City Commission authorized the
acquisition of professional services, designated the Coconut Grove Planning
Study as a Category B Project and appointed a Certification Committee of
Joseph W. McManus, Deputy Director, Planning, Building and Zoning Department,
Chairman; Santiago Jorge -Ventura, Deputy Director, Planning, Building and
Zoning Department and Margot Ammidown, at that time with Metro Dade County,
Historic Preservation Division, and appointed Sergio Rodriguez, Assistant City
Manager (or his designee) as chairperson of the Competitive Selection

Committee. Other public agenccy members of the Committee were designated by
City procurement procedures; 15 members from Coconut Grove were also
designated by the Commission at that time.
The Competitive Selection Committee reviewed drafts of the Request for
Qualifications (RFQ) on March 10, July 28th and August 3, 1994.
Availability of the RFQ was advertised in the Herald on August 28, 1994 and
the Florida Planner (September 1994).
-The RFQ to provide Professional Services was released on September 1,'1994.
30 RFQ's were mailed out and four teams responded by the deadline on September
210 1994. The Certification Committee met on September 26, and on the advice
of the Procurement Management Division, GSA, with respect to a protest dated
September 30, reconvened subsequently on October 6, 1994, and qualified all
four teams.
The Competitive Selection Committee met on October 17 and interviewed three
firms and ranked four firms, one firm having declined the interview. (see
example individual scoring sheet and Competitive Selection Committee final
ranking attached). The writer served as the designee of Sergio Rodriguez, who
was alerted for jury duty.

In response to your questions pertaining to the method of appointment of the competitive
Selection Committee for the Coconut Grove Planning Study, please be advised that during
Commission discussion of July 22, 1993, the Commission directed the Administration to limit
the citizen membership of the Committee to 15 persons from among those proposed by the
Cocoanut Grove Village Council. The item was then continued. On October 21, 1993, the
Administration recommended 15 persons from Coconut Grove; five public agency members
were added, as dictated by Section 18-52.3 of the City Code (Agenda Item PZ-11 see memo
dated September 17, 1992, page 2). The Commission then adopted Resolution 93-693
authorizing the study.

BACKGROUND:
The chronology of events has been as follows:
March 25, 1993: A representative of the Cocoanut Grove pillage Council
requested a planning study and development moratorium during the study The
Commission directed the Administration to prepare a moratorium and study
which could serve as the basis'for-a possible moratorium and by Motion 93-
211 instructed the City Manager to identify sources of funds for a planning
study to be conducted by consultants while keeping the Commission in control
of the funds.
May 27, 1993: The Administration presented a Resolution of Intent .for' the
Coconut Grove Planning Study and a Moratorium Ordinance.
The Commission continued both items to June 29th or no later than July 22nd;
Out the general direction given the Administration was to retain City
control of both the study and the funds.

June 29, 1993: Representatives of the Cocoanut Grove Village Council again
requested a planning study along the lines of the Resolution of Intent
presented on May 27th. (See attached)
July 22,.-1993:, the Commission re -affirmed its position that the..City should
retain control of 'consultant selection, the study itself, and the funding
-and further, .that . no. formal... agreement would be executed with the Cocoanut
Grove Village Council --as contemplated in Item 7-B of the July *22nd agenda.
For these reasons, Item 7-6 has not been carried forward and Item 7-A of the
July 22nd agenda has been used as the vehicle for the Planning Study.
The -Planning, Building .and Zoning..Department (PBZ) Department will solicit
professional planning services -by means:of a Request for Qualifications (RFQ) to
firms and individuals in Florida, utilizing_ planning consultant *directories.
The RFQ -will=.include a. -:proposed scope O .services responsive to Chapter 163,
Florida Statutes specifically to i.nclude'the substantive Section 163.3161.et.sey

WHEREAS, pursuant to Notion 93-211. adopted March 25, 1993.

WHEREAS, on May 27, 1993, the City Commission Continued both

Commission on June 29th, but no later than July 22; and
WHEREAS, the City Manager recommends that the acquisition of
planning services for the Coconut Grove. Planning Study be
designated a:"Category B Projeot'-C"Project•) in accordance with
the provisions of City Code Section 18-82.3; and
WHEREAS, said City Code Section 18-E2.3 also requires. Inter
aUA, the establishment of a Certification Committee'of not less
than three professionals . qualified in the fields - of endeavor or
practices involved'in'thi Projeot. to review the qualifications,
performance data and related .information ` provided :-'-".by those
responding to the City's Request for-Professionah`gervices; and
WHEREAS, the City Manger recommends that -Sergio "Rodriguez,
Director. Planning, Building -and Zoning Department, be appointed
Chairperson of the Competitive Selection Committee, in accordance
with the _provisions of City of Miami Code Section 18-82.3; and
WHEREAS.. Florida Statutes and the City Code establish
procedures for contracting for such professional services and
also establish negotiation requirements with regard to the
furnishing of such services;
NOW, TEEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI. FLORIDA:
Section 1. The recitals and findings Contained in the
Preamble to this Resolution are hereby adopted by. reference
thereto and lnoorporated herein as if fully set forth in this

Section 2. The acquisition of planning services for the
Coconut drove Planning Study is hereby designated a OC&'t'egOTy B
Project," in accordance with the provisions of the City of Miami
Code Section 16-52.3, which established procedures for"
contracting for certain professional services and also
established competitive negotiation requirements with regard to*
the furnishing of such services.
-Section 3. The Coconut Grove study area .-In -to be
conducted for the area bounded by Biscayne Bay, Ri6keibaoker
Causeway, Peder&I"Eighvay CU.S. It. South Dixie Highway) ImA --the
City limits.
Section 4. The City Manager to hereby authorized to
advertise for the aforementioned professional services: ;- -and `io—
issue a Request for Qualifications document related to.#the
procurement of such services.' in accordance with the City Code.
Section 5. A . Certification Committee in hereby appointed
Consisting of the following City staff: Joseph W. McManus
Arobiteot-Planner, Department of Planning. , Building and Zoning;
John Jackson, Engineer, Department of Public Works, and Margot
AmmidOwn, Preservationist, Metropqlitan OD&de County Historic
Preservation Division..
• Section 6. Sergio Rodriguez, Assistant City Manager and
Director of the Department of Planning; Building and Zoning (or
his designee) in hereby appointed an Chairperson of the
Competitive Selection Committee, in &COOVA&n 0 with the
provisions of City of Miami Code Seotion 18-5a.3.

RE: CONSULTANT SELECTION: Coconut Grove Planning Study
Dear Sergio:
I just wanted you to know that in all of my years in the practice of architecture and planning, I have
never participated or witnessed the type of proceedings which were conducted as part of the
consultant selection process for the Coconut Grove Planning Study.
First, let me say that this letter is not intended to challenge the processor to in any way suggest that
the ranking, as presented in your letter. of October 24, be reconsidered by the city staff or
commission. For one, after hearing the comments from some of the neighbors that participated as
a part of the selection process, particularly the high level of distrust that was expressed with regard
to the City's commitment and sincerity towards the area of Coconut Groveand its interests, it is quite
evident that this is a process that will have a difficult road, at best.,
Simply stated, effective planning cannot take place in an environment that is full of mistrust,
innuendo and sarcasm. There is no doubt in my mind that our company, and our team of
consultants, did not have even the slightest opportunity to receive a fair and objective review from
the neighbors.
It is not by coincidence that if you analyze the score sheets and segregate the voting of the City of
Miami staff from that of the residents, our firm would have received the highest ranking. This is
just a footnote in a process which I'm sure was a difficult one for City staff. I wish you the best
of luck in overseeing this planning effort.
