HomeMy WebLinkAboutR-94-0857J-94-843 i 10/19/94 RESOLUTION 9 4 - 857 A RESOLUTION APPROVING THE FINDINGS OF THE COMPETITIVE SELECTION COMMITTEE AS TO THE MOST QUALIFIED TEAMS, IN RANK ORDER, TO PROVIDE PROFESSIONAL SERVICES IN CONJUNCTION WITH THE PREPARATION OF THE COCONUT GROVE PLANNING STUDY; AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO UNDERTAKE NEGOTIATIONS WITH THE MOST QUALIFIED TEAMS, IN RANK ORDER, UNTIL HE ARRIVES AT AN AGREEMENT WHICH IS FAIR, COMPETITIVE AND REASONABLE, AND FURTHER DIRECTING THE CITY MANAGER TO PRESENT THE NEGOTIATED AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, TO THE CITY COMMISSION FOR ITS RATIFICATION AND APPROVAL. WHEREAS, the City of Miami, pursuant to Resolution I No. 93-639, adopted October 21, 1993, designated as a I Category "B" Project, the acquisition of professional planning services for the Coconut Grove Planning Study; and WHEREAS, pursuant to Resolution No. 93-693, the City Commission appointed Sergio Rodriguez, Assistant City Manager I (or his designee) as chairperson of the Competitive Selection Committee, and established a Certification Committee of not less than three professionals in the fields of endeavor or practice involved, to review the qualifications, performance data, and I related information provided by those responding to the City's Request for Qualifications; and WHEREAS, the City of Miami issued a I Request for Qualifications for professional land use planning, urban design, CITY COP'.i , ISSIODI MEET-111IG OF NMI 1 7 1994 Resolution No, 94- 857 historic preservation, architectural, landscape architectural, implementation planning and transportation engineering and planning services on September 1, 1994; and WHEREAS, the Certification Committee met on September 26th and October 6th, 1994 and certified four teams as being responsive to the City's Request for Qualifications; and WHEREAS, the Consultant Selection Committee, consisting of twenty (20) members, with four (4) employed by the City of Miami, four (4) being professionals from the practices involved, heard presentations and interviewed three certified teams on October 17, 1994; and WHEREAS, the selection procedures were performed in accordance with the Consultants Competitive Negotiation Act as set forth in Section 287.055 of the Florida Statutes and Ordinance No. 9572, adopted February 10, 1983 and codified as Section 16-52.3 of the Code of the City of Miami; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The City Manager or his designee is hereby authorized`/ to negotiate a professional services agreement on behalf of the City of Miami with the team ranked first as set forth in Section 2 herein. In the event that the City Manager or his designee cannot negotiate an agreement which, in his opinion, is fair, competitive and reasonable with the team ranked first, then he is hereby authorized to formally terminate such negotiations. The City Manager or his designee shall then undertake negotiations with the team ranked second. In the event that he fails to negotiate a satisfactory agreement with the second team, then the City Manager or his designee is authorized to undertake negotiations with the third most qualified team. Section 4. The City Manager is hereby directed to present the negotiated agreement, in a form acceptable to the City Attorney, to the City Commission for its ratification and approval. The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. 94- 857 -4- Section S. PUBLIC NOTICE: CITY OF MIAMI, FLORIDA REQUEST FOR PROFESSIONAL SERVICES COCONUT GROVE PLANNING STUDY The City of Miami, is seeking the professional services of a qualified and experienced consulting team, with a general planning firm as the prime consultant, for the planning and preparation of a comprehensive plan for theCoconut Grove neighborhood in the City of Miami. The consulting team must have the ability to provide professional land use planning, urban design, historic preservation, architectural, landscape architectural services, implementation planning, and transportation engineering and planning. The professional services agreement for this project will result in a document which will assess current conditions and propose recommendations for an overall general plan for Coconut Grove. By Resolution 93-639, October 21, 1993, the City Commission authorized the acquisition of professional services, designated the Coconut Grove Planning Study as a Category B Project and appointed a Certification Committee of Joseph W. McManus, Deputy Director, Planning, Building and Zoning Department, Chairman; Santiago Jorge -Ventura, Deputy Director, Planning, Building and Zoning Department and Margot Ammidown, at that time with Metro Dade County, Historic Preservation Division, and appointed Sergio Rodriguez, Assistant City Manager (or his designee) as chairperson of the Competitive Selection 94-- 857 -2- Committee. Other public agenccy members of the Committee were designated by City procurement procedures; 15 members from Coconut Grove were also designated by the Commission at that time. The Competitive Selection Committee reviewed drafts of the Request for Qualifications (RFQ) on March 10, July 28th and August 3, 1994. Availability of the RFQ was advertised in the Herald on August 28, 1994 and the Florida Planner (September 1994). -The RFQ to provide Professional Services was released on September 1,'1994. 30 RFQ's were mailed out and four teams responded by the deadline on September 210 1994. WEEMS, the representatives of the Cocoanut Grove Village Counoil appeared before:`tb.e Commission on March 8S. 1993. to request a planning ,study and moratorium; and WHEREAS, pursuant to Notion 93-211. adopted March 25, 1993. the City Commission directed the City Manager to begin the process of preparing the plan. and identifying funds. determining the need for a moratorium; and i WHEREAS, on May 27, 1993, the City Commission Continued both items, direoting the City Manager to retain City Control of the consultant selection process and funds, and to return to the City Commission on June 29th, but no later than July 22; and WHEREAS, the City Manager recommends that the acquisition of planning services for the Coconut Grove. Planning Study be designated a:"Category B Projeot'-C"Project•) in accordance with the provisions of City Code Section 18-82.3; and WHEREAS, said City Code Section 18-E2.3 also requires. Inter aUA, the establishment of a Certification Committee'of not less than three professionals . qualified in the fields - of endeavor or practices involved'in'thi Projeot. to review the qualifications, performance data and related .information ` provided :-'-".by those responding to the City's Request for-Professionah`gervices; and WHEREAS, the City Manger recommends that -Sergio "Rodriguez, Director. Planning, Building -and Zoning Department, be appointed Chairperson of the Competitive Selection Committee, in accordance with the _provisions of City of Miami Code Section 18-82.3; and WHEREAS.. Florida Statutes and the City Code establish procedures for contracting for such professional services and also establish negotiation requirements with regard to the furnishing of such services; NOW, TEEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI. FLORIDA: Section 1. The recitals and findings Contained in the Preamble to this Resolution are hereby adopted by. reference thereto and lnoorporated herein as if fully set forth in this �v Section. First, let me say that this letter is not intended to challenge the processor to in any way suggest that the ranking, as presented in your letter. of October 24, be reconsidered by the city staff or commission. For one, after hearing the comments from some of the neighbors that participated as a part of the selection process, particularly the high level of distrust that was expressed with regard to the City's commitment and sincerity towards the area of Coconut Groveand its interests, it is quite evident that this is a process that will have a difficult road, at best., Simply stated, effective planning cannot take place in an environment that is full of mistrust, innuendo and sarcasm. There is no doubt in my mind that our company, and our team of consultants, did not have even the slightest opportunity to receive a fair and objective review from the neighbors. It is not by coincidence that if you analyze the score sheets and segregate the voting of the City of Miami staff from that of the residents, our firm would have received the highest ranking. This is just a footnote in a process which I'm sure was a difficult one for City staff. I wish you the best of luck in overseeing this planning effort. Sincerely, Willy A.
