RESOLUTION NO.
A RESOLUTION AUTHORIZING THE CITY MANAGER TO
EXECUTE THE NECESSARY DOCUMENT(S), IN A FORM
ACCEPTABLE TO THE CITY ATTORNEY, WITH MARINA
FERNANDEZ, FOR THE CREATION, FABRICATION AND
INSTALLATION OF ART WORK FOR THE NEW
MORNINGSIDE PARK RECREATION BUILDING AT A
COST NOT TO EXCEED $8,500.00; ALLOCATING
FUNDS THEREFOR FROM THE CAPITAL IMPROVEMENT
PROJECT NO. 331313, ENTITLED "MORNINGSIDE
PARK RENOVATIONS", AS APPROPRIATED BY
ORDINANCE NO. 11139, AS AMENDED.

WHEREAS, in accordance with Ordinance No. 11139, the Capital
Improvement Projects Ordinance and the Citywide Neighborhood Park
Renovation Program, the new recreation building in Morningside
Park is nearing completion; and
WHEREAS, pursuant to Section 18-6, Code of the City of
Miami, Florida, as amended, a minimum of 1.5% of funds for the
construction of new public buildings must be set aside for "Arts
in Public Places"; and
WHEREAS, with the participation of Morningside area
residents, the Morningside Civic Association and a local
architect, a competitive negotiations process, as provided under
Section 18-52.2, Code of the City of Miami, Florida, as amended,
entitled "Competitive Negotiations", was conducted under the

supervision of the Parks and Recreation Department and six (6)
artists were interviewed; and
WHEREAS, the interview committee ranked as number one, the
proposal and concept submitted by Marina Fernandez, a local
artist, with a studio located in Dade County at 1590 S.W. 76th
Court, Miami, Florida; and
WHEREAS, subsequent negotiations have resulted in the
proposed agreement for the artist to design, fabricate and
install two (2) 5-foot in diameter stained glass windows,
including framing and tempered outer glass, at a total cost not
to exceed $8,500; and
WHEREAS, funds for said art work are available from the
Capital Improvement Program, Project No. 331313, entitled
"Morningside Park Renovations";
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The City Manager is hereby authorized-/ to
execute the necessary documents, in a form acceptable to the City
Attorney, with Marina Fernandez for the creation, fabrication and
installation of art work for the new Morningside Park Recreation
The herein authorization is further subject to compliance with
all requirements that may be imposed by the City Attorney,
including but not limited to those prescribed by applicable
City Charter and Code provisions.

Building, at a cost not to exceed $8,500.00, with funds therefor
hereby allocated from the Capital Improvement Project No. 331313,
entitled "Morningside Park Renovations", as appropriated by
Ordinance No. 11139.
i Section 3. This Resolution shall become effective
immediately upon its adoption.
