A RESOLUTION AUTHORIZING THE CITY MANAGER TO
ACCEPT A HOUSING OPPORTUNITIES FOR PERSONS
WITH AIDS (HOPWA) PROGRAM GRANT IN THE AMOUNT
OF $5,155,000 FROM THE UNITED STATES
DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT
(HUD); AUTHORIZING THE CITY MANAGER TO
EXECUTE THE NECESSARY CONTRACTS AND
AGREEMENTS, IN A FORM ACCEPTABLE TO THE CITY
ATTORNEY, FOR IMPLEMENTATION OF SAID PROGRAM;
FURTHER AUTHORIZING THE CITY MANAGER TO
ALLOCATE SAID FUNDS AND TO ENTER INTO
AGREEMENTS, IN A FORM ACCEPTABLE TO THE CITY
ATTORNEY, WITH AGENCIES AND METROPOLITAN DADE
COUNTY FOR THE PROVISION OF SERVICES TO
PERSONS WITH AIDS, SUBJECT TO CITY COMMISSION
APPROVAL AND APPLICABLE CITY CODE PROVISIONS.
WHEREAS, the Housing Opportunities For Persons With AIDS
(HOPWA) Program was created under the AIDS Housing Opportunity
Act, and revised under the Housing and Community Development Act
of 1992; and
WHEREAS, in February, 1994, U.S. HUD notified the City of
Miami of funding available in the amount of $5,128,000 under the
HOPWA Grant Program; and
WHEREAS, U.S. HUD issued a revised notification to the City
of Miami on April 14, 1994, increasing. said funding to
$5,155,000; and

WHEREAS, Section 606(d)(2) of the Housing and Community
Development Act of 1992 stipulates that the most populous unit of

1 general local government in an Eligible Metropolitan Statistical
Area (EMSA), not including county government, be the applicant
for this formula allocation grant; and
WHEREAS, in the Dade County EMSA, Miami is the most populous
city, and thereby the designated applicant for the 1994 HOPWA
Program grant funding; and
WHEREAS, the Department of Development and Housing
Conservation, in conjunction with the 1994 HOPWA Advisory Board
(HAB) (consisting of representatives from Dade County, the cities
of Hialeah and Miami Beach, Metro -Dade HIV Health Services
Planning Council, South Florida AIDS Network, Stanley C. Myers
Community Medical Center, Cure AIDS Now, The Miami Coalition For
the Homeless, Economic Opportunity Family Health Center, Better
Way, persons living with AIDS) and members of the public, worked
together to prepare and submit the HOPWA application for fiscal
year 1994 funding; and
WHEREAS, the consensus of opinion of the aforementioned
organizations during the preparation of the application was to
solicit applications for supportive services, long term rental

assistance, operating expenses, acquisition, rehabilitation
and/or new construction of permanent housing, housing
information, and referral services, fair housing counseling,
resource identification, development, planning coordination, and
linkages; and

WHEREAS, the organizations also determined to continue
funding the Dade County Department of Human Resources, Office of
Community Services, in the amount of $1,000,000, for the purpose
of providing short term housing finanoial assistance under the
auspices of the 1994 HOPWA Program; and
WHEREAS, in October, 1994, the City of Miami received HUD's
funding approval of the HOPWA application and the related HOPWA
agreement which, upon execution by both the City and HUD, will
enable U.S. HUD to obligate the $5,155,000 formula allocation
amount; and
WHEREAS, it is necessary for the City Manager to accept the
$5,155,000 HOPWA Grant and execute agreements for the
implementation of the Program;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The City Manager is hereby authorizedI/ to
accept the HOPWA Program Grant, in the amount of $5,155,000, from
HUD and to execute the necessary contracts and agreements, in a
form acceptable to the City Attorney, for implementation of said
Program.
The herein authorization is further subject to compliance
with all requirements that may be imposed by the City
Attorney, including but not limited to those prescribed by
applicable City Charter and Code provisions.

Section 3. The City Manager is further authorizedl/ to
allocate said funds and to enter into agreements, in a form
acceptable to the City Attorney, with agencies for the provision
of services to persons with AIDS, including allocating $1,000,000
of said HOPWA Program grant funds to Metropolitan Dade County to
provide short term housing financial assistance, subject to City
Commission approval and applicable City Code Provisions.
Section 4. This Resolution shall become effective
immediately upon its adoption.

It is respectfully recommended that the City Commission adopt the
attached resolution authorizing the City Manager to accept a
grant in the amount of $5,155,000 from the U.S. Department of
Housing and Urban Development in connection with ' the
implementation and administration of the Housing Opportunities
for Persons With AIDS (HOPWA) Program. The attached resolution
further authorizes the City Manager to execute all the necessary
agreements and documents required in order to implement the
Program. In addition, the attached resolution also authorizes the
City Manager to execute an agreement with Metropolitan Dade
County for the provision of short term housing financial
assistance to low income persons with AIDS in the amount of
$1,000,000.
BACKGROUND
The Department of Development and Housing Conservation recommends
ratification of the attached resolution authorizing the City
Manager to accept a grant in the amount of $5,155,000 from the
U.S. Department of Housing and Urban Development in connection
with the implementation and administration of the Housing
Opportunities for Persons With AIDS (HOPWA) Program. The attached
resolution further authorizes the City Manager to execute all the
necessary agreements and documents required in order to implement
the Program.
The Housing Opportunities for Persons With AIDS (HOPWA) Program,
which was established under the AIDS Housing Opportunity Act of
1992, stipulates in the final rule that the most populous unit of
general local government in an eligible metropolitan statistical
area (EMSA), not including county government, is required to be
the applicant for this formula allocation grant. With the City of
Miami being the most populous city in the Dade County EMSA, the
City was designated the applicant for the 1994 HOPWA Program. On
February 17, 1994, U.S. HUD notified the City of Miami of fiscal
year 1994 HOPWA funding availability in the amount of $5,128,000,
which was subsequently increased to $5,155,000.

In order to secure public input on how the 1994 HOPWA Program
funds should be utilized, the City administration enlisted
representatives of Dade County, the cities of Hialeah and Miami
Beach, Metro Dade HIV Health Services Planning Council, South
Florida AIDS Network, Stanley C. Myers Community Medical Center,
Cure AIDS Now, The Miami Coalition For the Homeless, Economic
Opportunity Family Health Center, Better -Way, and People With
AIDS Coalition to be on the 1994 HOPWA Advisory Board (HAP).
Intentionally, some of these representatives are HIV+ or have
AIDS. In addition, the meetings of the HOPWA Advisory Board were
advertised and members of the public were invited to participate
and comment on the use of the 1994 HOPWA Program Funds.
The Department of Development and Housing Conservation, taking
into consideration the input of the 1994 HOPWA Advisory Board,
submitted the City's 1994 HOPWA application to U.S. HUD on
July 18, 1994.
Subsequently, in October of 1994, the City of Miami was notified
that its HOPWA application has been approved by U.S. HUD for
funding in the amount of $5,155,000 for the purpose of providing
services to persons with AIDS. The 1994 HOPWA program funding is
being recommended for the following eligible activities under the
HOPWA Program:
1. Short term housing financial assistance.
2. Long term rental assistance.
3. Operation & acquisition, rehabilitation, conversion, or
new construction.
4. Emergency housing financial assistance.
5. Operations (Utilities) assistance.
6. Resource identification, coordination, planning,
development and linkages.
7. Special needs grants.
8. Housing information and referral services.
9. Fair housing counseling/client advocacy.

Adoption of the attached resolution authorizes the City Manager
to accept the $5,155,000 in 1994 HOPWA Program funding from the
U.S. Department of Housing and Urban Development and to execute
all the necessary agreements and documents required in order to
implement and administer the Program.
