Section 1. The City Commission. hereby officially aocepts the City
Clerk's Certification and Declaration of the results of the Special Municipal
Election held on November 8, 1994, attadlsd hereto and made a part hereof, in
which the question of amending the City (darter to amend and delete provisions
regarding proposed projects improving or disposing of all. City property by:
Pi mi na.tj�g three proposal submission and referendum requirements for project
approval; establishing proposer prequalification, evaluation, approval and
protest procedures; prohibiting projects providing City less than fair market
value, except projects of community -based organizations and existing
exemptions; authorizing the City Commission to amend existing or future
contracts, after an advertised public hearing, was disapproved by the
electorate.

Section 2. The City Commission hereby declares:
(a) with respect to Charter Amendment No. 1, providing for
amendments and deletions to provisions regarding proposed projects improving
or disposing of all City property by: eliminating three proposal submission
and referendum requirements for project approval; establishing proposer
prequalification, evaluation, approval and protest procedures; prohibiting
projects providing city less than fair market value, except projects of
community -lased organizations and existing exemptions; authorizing the City
Commission to amend existing or future contracts, after an advertised public
hearing, said election was duly called and properly held and notice thereof
was duly given in accordance with law and Resolution No. 94-573, adopted
July 26, 1994, entitled:

(b) all steps in connection with said election were duly,
regularly and lawfully taken and had; and all applicable provisions of the
Constitution of Statutes of the State of Florida and of said Resolution have
been fully complied with;
(c) the inspectors and clerks of each election precinot in the
City have duly made returns of the results of the election in each such
precinct on the question submitted at said election;
(d) at said election there was submitted to the qualified
electors of the City of Miami, Florida, the following question:

by qualified electors approving said question, and the number of votes cast by

(f) each qualified fied elector of the City of Miami was given the
opportunity of voting for or against the question as set forth hereinabove.
Section 3. With respect to the question set forth in Section 2(d)
hereinabove concerning said Amendment, it is hereby found and determined, that
15 , 4 2 6 votes were cast by qualified electors in favor of the question; and
that 30,203 votes were cast by qualified i fied. electors against the question, and
the Commission hereby declares and certifies that the herein question of

I, MATTY HIRAI, City Clerk of the City of Miami, Florida, do
hereby certify that all necessary legal steps were taken in
connection with the conduct of a City of Miami Special Election
held on November 81 1994 including the following Logic and
Accuracy Tests:
I. PUBLIC LOGIC AND ACCURACY TEST CERTIFICATION OF THE
TABULATION EQUIPMENT
1. On Friday, November 41 1994, commencing at approximately
9:30 A.M., the Dade County Supervisor of Elections had
the tabulating equipment based in the Elections
Department, at the Stephen P. Clark Center, tested to
ascertain that the equipment would correctly count the
precinct and absentee ballot votes cast on election day.
2. Test results were compared with the predetermined totals
for each candidate and on each measure to ascertain that
the tabulating equipment was working in accordance with
predetermined standards, pursuant to requirements
established in Section 101.5612, Florida Statutes. The
performance and results of all required tests were
observed and the correctness of the program, precinct
header cards and test ballots, as well as any
replacement of said materials required by said tests,
were verified.
3. At the completion of this public Logic and Accuracy
test, the verified Logic and Accuracy report, HUB
console log, program microdisk (seal 0039435), and test
ballots with precinct header cards, were placed in the
custody of the Supervisor of Elections under seal number
0038542.

II. LOGIC AND ACCURACY TEST CERTIFICATION OF THE PRE- AND POST -
PRECINCT AND ABSENTEE BALLOT COUNTS
4. On Tuesday, November 8, 1994 (election day) commencing
at approximately 6:00 P.M., the Dade County Supervisor
of Elections had the tabulating equipment based in the
Elections Department at the Stephen P. Clark Center
tested to ascertain that the equipment had not been
tampered with and that it would correctly count the
precinct and absentee ballot votes cast on election day.
Seal number 0038542, used to secure the testing
materials, and seal 0039435, used to seal the program
microdisk, were broken in the presence of Dade County
and City of Miami representatives and the contents were
used following the procedures outlined in paragraph 2,
above, to complete the pre -count Logic and Accuracy
test.
5. At the completion of this pre -count Logic and Accuracy
test, all precinct ballots cast were counted. Except as
otherwise specifically set forth and declared in this
Certification, in our presence and sight, no ballot card
was removed from or added to any ballot card container,
ballot card tray or other segregation of ballots, and no
ballot card was in any manner altered or tampered with
by any person, and no person touched any ballot card
container, ballot card tray or ballot card, except the
person authorized to do so pursuant to F.S. 101.5614(1).
6. At the completion of the precinct and absentee ballot
count, the automatic tabulating equipment was again
tested to ascertain that the equipment correctly counted
the precinct and absentee votes cast on election day.
7. At the completion of this post -count Logic and Accuracy
test, all voted ballots with their precinct header cards
and duplicated and spoiled ballots were stored in card
cabinets under seal numbers: A21821, B21584, C21414,
D21503, E21710, F21367, G21690, H21290, I21101, J21694,
i K21987, L21588, N21446. In a cabinet under seal number
0038913, were stored the verified Logic & Accuracy
report, HUB console log, program microdisk (seal
0021091), and the test ballots with precinct header
cards.
All items, sealed as described above, were placed in the
custody of the Supervisor of Elections.

We, the undersigned County Court Judge, Chairman of the Board of County
Commissioners and Supervisor of Elections, constituting the Board of County
Canvassers appointed to act during this election, do, by our signatures hereto, certify
that to the best of our knowledge:
1. On November 4, 1994, commencing at approximately 9:30 a.m., the Supervisor of
Elections had the tabulating equipment based in the Elections Department at the
Stephen P. Clark Center tested to ascertain that the equipment will correctly count
the precinct and absentee ballot votes cast for all candidates and issues.
