A RESOLUTION TO TEMPORARILY RESTRICT VEHICULAR
ACCESS TO MARLER AVENUE AT ITS INTERSECTION
WITH DOUGLAS ROAD IN THE CITY OF MIAMI,
F49RIDA, SUBJECT TO THE PROVISIONS CONTAINED
WITHIN THIS RESOLUTION.
WHEREAS, Marler Avenue between Douglas Road and Plaza Street
is an undeveloped public right of way occupied by dense
vegetation; and
WHEREAS, Marler Avenue is insufficiently wide and
inadequately lighted to safely accommodate vehicular traffic; and
WHEREAS, a majority of property owners abutting Marler
Avenue with street addresses on Loquat Avenue have expressed
concern about unsafe conditions within this undeveloped right of
way and have petitioned the City to restrict vehicular access to
Marler Avenue at its intersection with Douglas Road; and
WHEREAS, the Police Department, Fire, Rescue and Inspection
Services Department and General Services Administration/Solid
Waste Department have been notified of the proposed vehicular
access restriction of Marler Avenue and have expressed no
substantial objection to the restriction of vehicular access to
Marler Avenue at its intersection with Douglas Road; and
WHEREAS, the proposed vehicular access restriction shall be
accomplished by the placement of a fence with a swing gate across

Marler Avenue at its intersection with Douglas Road and all
looking control shall be maintained by the City of Miami; and
WHEREAS, Section 54-17 of the Code of the City of Miami,
Florida, gives the City Commission the power, after a properly
advertised public hearing, to recommend that vehicular access to
particular street be prohibited at an intersection where such
prohibition is found to be in the best interest of the public;
and
WHEREAS, pursuant to due public notice, a public hearing was
held before the City Commission on this date as to any objections
to the implementation of prohibition of vehicular access to
Marler Avenue at its intersection with Douglas Road on a
temporary basis an no objections of substance were sustained by
the City Commission; and
WHEREAS, the City Commission finds that the herein
prohibition should be instituted until such time that Marler
Avenue is closed and vacated in accordance with the subdivision
regulations contained in Chapter 54.5 of the Code of the City of
Miami, Florida or until such time that the Director of the
Department of Public Works makes a finding that Marler Avenue
should be reopened to vehicular access; and
WHEREAS, the City Commission finds that the herein
prohibition is in the best interest of the public;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings set forth in the
Preamble to this Resolution are hereby adopted by reference and
incorporated herein as if fully set forth in this Section

Section 2. The restriction of vehicular access to Marler
Avenue at its intersection with Douglas Road in the City of
Miami, Florida, is hereby authorized and permitted on a temporary
basis, subject to the following conditions:
(a) the Department of Public Works shall design the
temporary fence and swing gate to prohibit vehicular
access;
(b) the looking control of the swing gate shall be
maintained by the City of Miami;
(c) the herein prohibition shall be instituted until such
time that Marler Avenue is closed and vacated in
accordance with the subdivision regulations contained
in Chapter 54.5 of the Code of the City of Miami,
Florida.
Section 3. This Resolution shall become effective
immediately upon its adoption.

to Marler Avenue at Douglas Road

The purpose of the November 17, 1994 public hearing is to hear
comments and consider a Resolution authorizing the restriction of
vehicular access to Marler Avenue at Its Intersection with
Douglas Road.
BACKGROUND:
Marler Avenue between Douglas Road and Plaza Street In South
Coconut Grove is an undeveloped public right of way occupied by
dense vegetation. The right of way is Insufficiently wide and
Inadequately lighted to safely accommodate vehicular or
pedestrian traffic.
A majority of the property owners abutting Marler Avenue with
street addresses on Loquat Avenue have expressed concern about
the unsafe conditions and have petitioned the City to restrict
access to Marler Avenue at Its intersection with Douglas Road.
Marler Avenue is currently not utilized to provide routine City
services and the Police, Fire, Rescue and inspection Services and
General Services Administration/Solid Waste Department have been
notified and have no substantial objection to the restriction of
access. The restriction may be accomplished by the placement of
a fence and swing gate across Marler Avenue with all locking
control maintained by the City to ensure emergency and utility
access.
It is respectfully recommended that the restriction to vehicular
access be Implemented on a temporary basis until such time that
the right of way is closed and vacated in accordance with the
platting process and subdivision regulations contained in the
City Code or until such time that the Director of the Public
Works Department makes a finding that Marler Avenue should be
reopened to vehicular access.

NOTICE OF PUBLIC HEARING
A public hearing will be held by the Commission of the City of
Miami, Florida, on November 17, 1994 at 10:00 a.m. In the City
Commission Chambers at City Hall, 3500 Pan American Drive, Miami,
Florida for the purpose of hearing objections from any
Interested parties affected by the RESTRICTION OF VEHICULAR
ACCESS TO MARLER AVENUE AT ITS INTERSECTION WITH DOUGLAS ROAD.
All Interested persons are Invited to appear and may be heard
concerning the restriction of vehicular access to Marler Avenue
at Its Intersection with Douglas Road. Should any person desire
to appeal any decision of the City Commission with respect to any
matter considered at this hearing, that person shall ensure that
a verbatim record of the proceedings is made, including all
testimony and evidence upon which any appeal may be based.
