J-94-835 10/17/94 RESOLUTION NO.-94- 819 A RESOLUTION BY AN AFFIRMATIVE VOTE OF 4/5THS OF THE MEMBERS OF THE CITY COMMISSION AFTER A DULY ADVERTISED PUBLIC HEARING, WAIVING FORMAL COMPETITIVE SEALED BID PROCEDURES FOR THE WIDENING OF THE VIRGINIA KEY COMPOST FACILITY SERVICE ROAD B-6216A, LOCATED AT THE NORTH END OF VIRGINIA KEY, MIAMI, FLORIDA; RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING THAT AN EMERGENCY EXISTS JUSTIFYING SUCH WAIVER FOR SAID SERVICES; AUTHORIZING THE CITY MANAGER TO ACCEPT THE LOWEST RESPONSIVE AND RESPONSIBLE BID FOR SAID SERVICES AT THE VIRGINIA KEY COMPOST FACILITY SERVICE ROAD; ALLOCATING FUNDS THEREFOR FROM THE FY '94 RECYCLING AND EDUCATION GRANT, ACCOUNT NO. 421304-197006-340, IN AN AMOUNT NOT TO EXCEED $98,645 FOR SAID WIDENING; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE AND/OR ISSUE THE NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, WITH THE SUCCESSFUL BIDDER. WHEREAS, the widening of the Virginia Key Compost Facility Service Road must commence within the time frame established by the FY '94 Recycling and Education Grant; and WHEREAS, the City Manager has made a finding that an emergency exists in accomplishing the necessary construction within said time frame, constituting a valid public emergency; and WHEREAS, the normally required procedures and scheduling requirements for formal advertising, receipt of bids, award of contract and processing of contracts will needlessly and unwisely delay construction of the widening of the service road; and CITY COYM47SSION MEETrNG OF NOV 1 7 1994 Resolution No. 94- 819 WHEREAS, Sections 18-52.5 and 18-52.6 of the City Code make provision for the emergency procurement of required goods and services for public works projects and improvements; and WHEREAS, the City Manager, and the Director of the Department of Public Works recommend that informal bid procedures be utilized to prooure the needed services, equipment and/or materials for said service road widening; and WHEREAS, after receipt of informal bids, a contract for said services, equipment and/or materials will be awarded to the lowest responsible bidder by the City Manager; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings set forth in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The City Manager's finding that a valid public emergency exists justifying the waiver of formal competitive sealed bid procedures for the widening of the Virginia Key Compost Facility Service Road is hereby ratified, approved and confirmed. Section 3. By an affirmative vote of 4/5ths of the Members of the City Commission, and after a duly advertised public competitive ublic hearing, formal sealed bid procedures for the procurement of services, equipment and/or materials for the widening of the service road located the Virginia Key Compost Facility, Miami, Florida, are hereby waived. 94- 819 -2- Section 4. The City Manager is hereby authorized to accept the lowest responsive and responsible bid for the necessary construction of the widening of the service road. Section 5. Funds therefor, in an amount not to exceed $98,645, are hereby allocated from the FY '94 Recycling and Education Grant, Account No. 421304-197006-340. Section 6. The City Manager is hereby authorized/ to execute and/or issue the necessary documents, in a form acceptable to the City Attorney, with the successful bidder for said widening of the service road. BACKGROUND: The Department of Public Works, in an effort to serve all residents of the City of Miami, has determined.that It Is now in order for the City Commission to ratify the City Manager's emergency finding !e Justifying Informal bids and award of a contract in an amount not to exceed $98,645. The reasons for the emergency finding are as follows. The Department of General Services Administration and Solid Waste Is in need of expanding the service road for the Virginia Key Compost Facility. Presently, this service road is extremely narrow for truck access Into and out of the facility. To alleviate the problem, the service road- must be widened to safely accommodate truck traffic. In order for construction to commence within the time frame established by the FY '94 Recycling Education Grant, It is requested that the City Comml-ssion authorize the City Manager to award a contract to the lowest responsible and responsive bidder after bids are reviewed by the Department of Public Works, and to authorize said low bidder to proceed as soon as possible with the aforesaid Improvements. k 94- M(Z TO FILE CITY OF MIAMI, FLORIDA INTER -OFFICE MEMORANDUM DATE . Construction of the widening of the service road must commence within FY '94 to avoid the loss of funding for this project from the FY '94 -Recycling and Education Grant. The emergency Justifies the selection of a contractor by Informal bid. The department of General Services Administration and Solid Waste are in need of expanding the service road for the Virginia Key Compost Facility. Presently, this service road is extremely narrow for truck access Into and out of the facility. To alleviate the problem the service road must be widened to safely accommodate truck traffic. Such conditions indicate the need for extraordinary measures to protect the health, safety and welfare of the community and City employees. In order to Initiate the construction as soon as possible, formal competitive sealed bid procedures shall be waived for the procurement of contracting services required for said emergency pursuant to sections 18-52.5 and 18-52.6 of the City Code. Informal bids shall be obtained and a contract shall be awarded by the City Manager to the lowest responsive and qualified bidder. All costs for the project wlII be funded from the FY '94 Recycling and Education Grant 421304-197006-340.
