A RESOLUTION BY AN AFFIRMATIVE VOTE OF 4/5THS
OF THE MEMBERS OF THE CITY COMMISSION, AFTER
A DULY ADVERTISED PUBLIC HEARING, WAIVING
FORMAL COMPETITIVE SEALED BID PROCEDURES FOR
THE REPAIR AND REPLACEMENT OF A STORM SEWER
LOCATED AT SOUTHEAST 8TH STREET AND SOUTH
BAYSHORE DRIVE, MIAMI, FLORIDA; RATIFYING,
APPROVING AND CONFIRMING THE CITY MANAGER'S
FINDING THAT AN EMERGENCY EXISTS JUSTIFYING
SUCH WAIVER FOR SAID SERVICES; AUTHORIZING
THE CITY MANAGER TO ACCEPT THE LOWEST
RESPONSIVE AND RESPONSIBLE BID FOR SAID
SERVICES AT SOUTHEAST 8TH STREET AND SOUTH
BAYSHORE DRIVE; ALLOCATING FUNDS THEREFOR, IN
AN AMOUNT NOT TO EXCEED $15,000, FROM PROJECT
NO. 352231 AS APPROPRIATED BY THE 1993-1994
CAPITAL IMPROVEMENT ORDINANCE NO. 11139, AS
AMENDED, FOR SAID REPAIR AND REPLACEMENT OF
SAID STORM SEWER; FURTHER AUTHORIZING THE
CITY MANAGER TO EXECUTE A CONTRACT, IN A FORM
ACCEPTABLE TO THE CITY ATTORNEY, WITH THE
SUCCESSFUL BIDDER.
WHEREAS, the City Manager has made a finding that a storm
sewer failure has occurred in an existing City of Miami storm
sewer, located at Southeast 8th Street and South Bayshore Drive,
Miami Florida, constituting a valid public emergency; and
WHEREAS, the nature of said emergency requires the immediate
repair and replacement of the storm sewer to protect the health,
safety and welfare of the citizens of the City of Miami; and

WHEREAS, the normally required procedures and scheduling
requirements for formal advertising, receipt of bids, award of
contract and processing of contracts will needlessly and unwisely
delay the repair and replacement of the storm sewer; and
WHEREAS, Sections 18-52.5 and 18-52.6 of the City Code make
provision for the emergency procurement of required goods and
services for public works projects and improvements; and
WHEREAS, the City Manager, and the Director of the
Department of Public Works recommend that informal bid procedures
be utilized to procure the needed services, equipment and/or
materials for said storm sewer replacement; and
WHEREAS, after receipt of informal bids, a contract for said
services, equipment and/or materials will be awarded to the
lowest responsible bidder by the City Manager;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings set forth in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The City Manager's finding that a valid public
emergency exists for the emergency repair and replacement of the

storm sewer located at Southeast 8th Street and South Bayshore
Drive, Miami, Florida, is hereby ratified, approved and
confirmed.
Section 3. By an affirmative vote of 4/5ths of the Members
of the City Commission, and after a duly advertised public
hearing, formal competitive sealed bid procedures for the
procurement of services, equipment and/or materials for the
repair and replacement of the storm sewer located at Southeast
8th Street and South Bayshore Drive, Miami, Florida, are hereby
waived.
Section 4. The City Manager is hereby authorized to accept
the lowest responsive and responsible bid for the necessary
repair and replacement said storm sewer.
Section 5. Funds therefor, in an amount not to exceed
$15,000, are hereby allocated from Project No. 352231 as
previously appropriated by the 1993-1994 Capital Improvement
Ordinance No. 11139, as amended.
Section 6. The City Manager is hereby authorized/ to
execute and/or issue the necessary documents, in a form
acceptable to the City Attorney, with the successful bidder for
said storm sewer repair and replacement.
Section 7. This Resolution shall become effective
immediately upon its adoption.
The herein authorization is further subject to compliance with
all requirements that may be imposed by the City Attorney,
including but not limited to those prescribed by applicable City
Code and Charter provisions.

RECOMMENDATION:
It Is respectfully recommended that the City Commission adopt the
attached Resolution ratifying the Clty Manager's written finding
that a valid emergency exists on S.E. 8th Street and South Bayshore
Drive and waiving formal competitive bidding procedures and
authorizing the City Manager to accept the lowest responsive and
responsible bid in an amount not to exceed $15,000.
BACKGROUND:
The Department of Public Works, in an effort to serve all residents
of the City of Miami, has determined that it is now In order for the
City Commission to ratify the City Manager's emergency finding
Justifying Informal bids and award of a contract in an amount not to
exceed $15,000. The reasons for the emergency finding are as
follows.
During and after a rainstorm, the west bound traffic lanes on S.E.
8th Street are severely flooded with stormwater due to a failed
stdrm sewer pipe line, causing the risk of an accident as drivers
swerve to avoid the water, or suffer the inconvenience of having
their cars "flood out" as they attempt to enter or exit the Sun Bank
parking garage. The sidewalk is also Impassible during and after a
rainstorm.
Funds for the execution of this protect are available from monies
already appropriated in the City's Capital Improvement
Appropriations Ordinance 11139.

NOTICE OF PUBLIC HEARING
A public hearing will be held by the Commission of the City of
Miami, Florida., on November 17, 1994 at 10:00 a.m. In the City
Commission Chambers at City Hall, 3500 Pan American Drive, Miami,
Florida for the purpose of hearing objections from any
Interested parties affected by the ratifying of the C.Ity
Manager's written finding that a valid emergency exists on S.E.
8th Street and South Bayshore Drive concerning stormwater
drainage and waiving formal competitive bidding procedures and
authorizing the City Manager to accept the lowest responsive and
responsible bid In an amount not to exceed $15,000.
All interested persons are invited to appear and may be heard
concerning the ratifying of the City Manager's written finding on
S.E. 8th Street and South Bayshore Drive concerning stormwater
drainage. Should any person desire to appeal any decision of the
City Commission with respect to any matter considered at this
hearing, that person shall ensure that a verbatim record of the
proceedings Is made, Including all testimony and evidence upon
which any appeal may be based.
