HomeMy WebLinkAboutR-94-0817J-94-912 11/1/94 RESOLUTION NO. 94- 817 A RESOLUTION, BY A 4/5THS AFFIRMATIVE VOTE OF THE MEMBERS OF THE CITY COMMISSION AFTER A DULY ADVERTISED PUBLIC HEARING, RATIFYING THE CITY MANAGER'S FINDING THAT AN EMERGENCY NEED EXISTED, WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDS AND APPROVING THE INSTALLATION OF A PUBLIC ELEVATOR AT MIAMI CITY HALL, 3500 PAN AMERICAN DRIVE, FROM M.E.T. CONSTRUCTION, INC., IN THE AMOUNT OF $146,673.83, TOTAL BID OF THE PROPOSAL, FOR THE CITY HALL PUBLIC ELEVATOR PROJECT, B-6219, FOR THE DEPARTMENT OF PUBLIC WORKS; ALLOCATING FUNDS THEREFOR FROM PROJECT NO. 311040, AS APPROPRIATED BY THE FISCAL YEAR 1993-94 CAPITAL IMPROVEMENT ORDINANCE NO. 11139, IN THE AMOUNT OF $146,673.83 TO COVER THE CONTRACT COST AND $14,126.17 TO COVER THE ESTIMATED EXPENSES, FOR AN ESTIMATED TOTAL COST OF $160,800.00; FURTHER RATIFYING THE CITY MANAGER'S EXECUTION OF A CONTRACT WITH M.E.T. CONSTRUCTION, INC., FOR THIS PURPOSE. WHEREAS, Miami City Hall, located at 3500 Pan American Drive, did not have an elevator accessible to the general ' public thereby limiting access of disabled citizens and employees to second floor offices; and WHEREAS, the only existing elevator in City Hall, which was utilized primarily as a freight elevator, was damaged by Hurricane Andrew flood waters and did not meet current code requirements for the disabled; and CITY COMMISSION MEETING OF NOV 1 7 11194 Rocolution No. 9 - 817 WHEREAS, the Americans with Disabilities Act, (A.D.A.), requires that access be provided for all of our citizens to all public buildings and public places; and WHEREAS, the lack of a public elevator that meets all the requirements of the A.D.A., the State of Florida and the South Florida Building Code has been a major inconvenience to the public, disabled citizens and employees; and WHEREAS, the Department of Public Works designed and engineered a code complying, A.D.A. approved public elevator specifically for Miami City Hall; and WHEREAS, the Director of Public Works and the City Manager determined that the immediate construction of a code complying elevator at City Hall was essential to the life, health, welfare, safety and convenience of the city and all of its citizens; and WHEREAS, the decision was made by the City Manager to proceed on an emergency basis with construction of said elevator as permitted under Section 18-52.6 of the Miami City Code entitled "Emergency Purchases"; and WHEREAS, informal, competitive bids were solicited for City Hall Public Elevator Project, B-6219, with the lowest responsible and responsive bid submitted by M.E.T. Construction, Inc. in the amount of $146,673.83; and WHEREAS, funds to cover the cost of the contract with M.E.T. Construction, Inc. are available from monies already j appropiated in the 1993-94 Capital Improvement Ordinance No. 11139, Project No. 311040; and 94- 817 -2- NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this section. Section 2. By a 4/5ths affirmative vote of the members of the City Commission, after a duly advertised public hearing, the City Manager's written finding that a valid emergency need existed for the installation of a public elevator at Miami City Hall, 3500 Pan American Drive, in the amount of $146,673.83, total bid of the proposal, for the City Hall Public Elevator Project, B-6219, is hereby ratified, confirmed and approved, with funds therefor hereby allocated from Project No. 311040, as appropriated by the Fiscal Year 1993-94 Capital Improvement Ordinance No. 11139, in the amount of $146,673.83 to cover the contract cost and $14,126.17 to cover the estimated expenses, for an estimated total cost of $160,800.00. Section 3. The requirements for competitive sealed bids is hereby waived for the Department of Public Works for the above project. Section 4. The City Manager's execution of a contract in a form acceptable to the City Attorney, with M.E.T. The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. 94- 817 -3- Construction, Inc., for the hereinabove installation project is further ratified, confirmed and approved. Construction Inc. in the amount of $146,673.83 for said elevator. BACKGROUND The Department of Public Works, in an effort to serve all residents of the City of Miami, has determined that it is now appropriate and in order for the City Commission to ratify the City Manager's decision to proceed with installation of a new code -complying elevator at City Hall. Prior to installation of the new elevator, City Hall did not have an elevator accessible to the general public. Consequently, access to the second floor was not available for disabled citizens and employees. The only existing elevator at City Hall was used primarily as a freight elevator and was out of service for a period of time after Hurricane Andrew due to water damage caused by hurricane flooding. Also, the existing freight elevator does not meet current code requirements for disabled passengers. The Americans With Disabilities Act (A.D.A) requires that access be provided for all of our citizens to all public buildings and places. The lack of a public elevator that meets all the requirements of the A.D.A., the State of Florida and the South Florida Building Code posed a major inconvenience to the general public and disabled citizens and employees. The Director of Public Works and the City Manager determined that the immediate construction of a code -complying elevator at City Hall was not only in the best interests of our citizens but was also essential to the health, welfare, safety and convenience of the City and all of its citizens. Therefore, the Department of Public Works proceeded with the design and engineering of a code complying, A.D.A. approved public elevator specifically for City Hall. 9 4 -- 817 `�'-/ The decision was made by the City Manager to proceed on an emergency basis with the construction of the aforesaid new elevator as permitted under Section 18-52.6 of the Miami City Code entitled "Emergency Purchases." Funds to pay for the cost of the new elevator are available from monies already appropriated in the Capital Improvement Ordinance No. 11139, Project No. 311040. The attached Resolution is necessary to accomplish the following: 1. Ratify the City Manager's decision to proceed on an emergency basis with installation of the new public elevator at City Hall. 2. Ratify the City Manager's acceptance of the bid of M.E.T. Construction, Inc. for said installation. 3. Allocate monies for said construction. 4. Ratify the City Manager's execution of an agreement with M.E.T. Odic City Manager ENCLOSURES Based on information supplied to me by the Director of the Department of Public Works, I have found that an emergency exists justifying additional work on the City Hall Elevator Project beyond the original project scope, thereby increasing- the contract cost. The reasons for the emergency need and subsequent authorization to perform the additional work are as••follows: 0n February 22, 1994, a contract for the City Hall Elevator Project was awarded to MET CONSTRUCTION, INC., in the amount of $141,000.00. During the construction phase of the project, which included demolition of portions of the existing basement and lobby floors, it became necessary to cease work operations due to excessive noise that disrupted normal business at City Hall. The contractor was directed by Public Works to continue his operations after normal work hours. The contractor is entitled to extra compensation due to the fact that this work restriction was not included in the original job specifications. Also, on several occasions the contractor was not allowed to perform work at the job site due to Code Enforcement Board, Zoning Board and Civil Service Board meetings held during daytime and evening hours. Additionally, an unforeseen emergency repair of an existing main electrical feeder further extended the contractual costs associated with the project. All of these factors justify an increase in the contract amount. Funds for these additional costs are available from the monies previously appropriated to the project, C.I.P. .#311040• The total increase in the contract amount will be $11,500.00. All interested persons are invited to appear and may be heard concerning the ratifying of the City Manager's written finding to provide a public elevator at the City of Miami's City Hall. Should any person desire to appeal any decision of the City Commission with respect to any matter considered at this hearing, that person shall ensure that a verbatim record of the proceedings is made, including all testimony and evidence upon which any appeal may be based.
