A RESOLUTION AUTHORIZING AN INCREASE, IN AN
AMOUNT NOT TO EXCEED $25,000.00, IN THE
CONTRACT BETWEEN THE CITY OF MIAMI, FLORIDA
AND HORIZON CONTRACTORS, INC. DATED
JANUARY 13, 1994, THEREBY INCREASING SAID
CONTRACT FROM $374,011.50 TO $399,011.50, FOR
THE PROJECT ENTITLED "ALLAPATTAH COMMUNITY
DEVELOPMENT STREET IMPROVEMENT -PHASE V,
B-4552"; ALLOCATING FUNDS THEREFOR FROM FUNDS
PREVIOUSLY APPROPRIATED BY CAPITAL
IMPROVEMENTS ORDINANCE NO. 11139, PROJECT
NO. 341181; RATIFYING, APPROVING AND
CONFIRMING BY AN AFFIRMATIVE VOTE OF
FOUR -FIFTHS OF THE MEMBERS OF THE CITY
COMMISSION, THE CITY MANAGER'S WRITTEN
FINDING THAT THE HEREIN INCREASE RESULTED
FROM EMERGENCY CIRCUMSTANCES.
WHEREAS, there exists a contract dated January 13, 1994,
between the City of Miami, Florida, and Horizon Contractors,
Inc., for construction of the project entitled "Allapattah
Community Development Street Improvement -Phase V, B-4552"; and
WHEREAS, the Director of Public Works, the Director of
Community Development and the City Manager recommend the increase
in said contract to cover the additional costs; and
WHEREAS, the City Manager has made a written finding that a
valid emergency existed for the work to continue to protect the
health, safety and welfare of the citizens of the City; and
WHEREAS, expenses for Capital Improvement Project No. 341181
were less than anticipated and sufficient funds are available for

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The City Manager's written findings that an
emergency existed thereby necessitating an increase for the
"Allapattah Community Development Street Improvement -Phase V"
project is hereby ratified, approved and confirmed by an
affirmative vote of four -fifths of the Members of the City
Commission.
Section 2. The contract between the City of Miami, Florida,
and Horizon Contractors, Inc., dated January 13, 1994, for
Allapattah Community Development Street Improvement -Phase V,
B-4552, is hereby increased in an amount not to exceed
$25,000.00, from $374,011.50 to $399,011.50, with funds therefor
allocated for said increase from funds previously appropriated by
Capital Improvements Ordinance, Project No. 341181.
Section 3. This Resolution shall become effective
immediately upon its adoption.

It is respectfully recommended that the City Commission adopt the
attached Resolution authorizing an increase in the contract
between Horizon Contractors, Inc. and the City of Miami for
Allapattah Community Development Street Improvement - Phase V, B-
4552, in the amount of $25,000.00; and further ratifying the City
Manager's written finding that the increase resulted from
emergency circumstances.
BACKGROUND
The Department of Public Works, in an effort to serve all
residents of the City of Miami, has determined that it is now
appropriate and in order for the City Commission to ratify the
City Manager's decision to increase the contract dated January
13, 1994 between the City of Miami and Horizon Contractors, Inc.
for construction of Allapattah Community Development Street
Improvement - Phase V, B-2987 in the amount of $374,011.50 on
January 13, 1994. Generally, the project consisted of street
improvements to NW 29 Street between NW 23 Avenue and NW 27
Avenue, NW 25 Avenue between NW 28 Street and NW 30 Street, and
NW 24 Avenue between NW 18 Terrace and NW 20 Street that included
clearing and grading, construction of asphaltic pavement,
concrete sidewalk, and curb and gutter and construction of storm
drainage facilities.
Additional funds are needed for the reconstruction of the Curtis
Park parking lot that abuts NW 24 Avenue including limerock base,
one inch asphalt pavement and concrete sidewalk and curbing. The
reconstruction of the existing parking lot is necessary to meet
the new improvements in NW 24 Avenue. It is expedient for the
safety and welfare of the surrounding neighborhood and since
there are funds available for the work, it is important that we
allow Horizon Contractors, Inc. to proceed with the
reconstruction of the Curtis Park parking lot. The cost of the
additional work is $25,000.00.
Sufficient funds for the increase in contract for aforesaid
additional work are available from monies already appropriated in
the City's C.I.P. Ordinance 11139 under Project 341181.

Based on information supplied to me by the Director of the
Department of Public Works, -I have found that an EMERGENCY
existed justifying additional work on the Allapattah Community
Development Street Improvement beyond the original scope -of the
project and an increase in the contract.
The reason for the emergency need and subsequent authorization to
perform additional work and increase in contract is as follows:
The City Commission awarded a contract to Horizon Contractors,
Inc. for the Allapattah Community Development Street Improvement,
Phase V, B-4552, in the amount of $374,011.50 on January 13,
1994. The work consists of street rebuilding, drainage and
right-of-way improvements on NW 29 Street between NW 23 Avenue
and NW 27 Avenue, NW 25 Avenue between NW 28 Street and NW 30
Street, and NW 24'Avenue between NW 18 Terrace and NW 20 Street.
