RESOLUTION NO.
94- 761
A RESOLUTION CONCERNING ELIGIBILITY FOR
MEMBERSHIP FOR PARTICULAR CITY BOARDS,
THEREBY PROVIDING THAT THOSE PERSONS OWNING
REAL PROPERTY IN THE CITY OF MIAMI ARE
ELIGIBLE FOR MEMBERSHIP ON THE CITY OF MIAMI
COMMITTEE ON BEAUTIFICATION AND ENVIRONMENT,
THE CITY OF MIAMI, FLORIDA, HEALTH FACILITIES
AUTHORITY AND THE TAX-EXEMPT PROPERTY
STEERING COMMITTEE OF THE CITY OF MIAMI,
FLORIDA; MORE PARTICULARLY, BY AMENDING
SECTION 6 OF RESOLUTION NO. 77-482, SECTION 3
OF RESOLUTION NO. 79-93 AND SECTION 3(A) OF
RESOLUTION NO. 93-285.
WHEREAS, the City Commission wishes to amend the eligibility
requirements for membership on the Committee on Beautification
and Environment, the Health Facilities Authority and the Tax -
Exempt Property Steering Committee to provide that those persons
owning real property in the City of Miami are eligible for
membership to said boards;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1.. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.

Section 2. Section 6 of Resolution No. 77-482, adopted
June 7, 1977, concerning the City of Miami Committee on
Beautification and Environment is hereby amended in the following
particulars:I/
"Section 6. That each member must be a resident of
Miami or work or own reaproperty or a business
in the City of Miami."
Section 3. Section 3 of Resolution No. 79-93, adopted
February 22, 1979, concerning the City of Miami, Florida, Health
Facilities Authority is hereby amended in the following
particulars:I/
"Section 3. The City Commission will appoint five
(5) persons, who are residents of or own real
property in the City of Miami, to be designated as
members of the City of Miami, Florida Health
Facilities Authority. Of U16 Members 2trst
member shall serve for a period of two years-, one
shall serve for 3 years, and two shaaft serve f or t
years; t1i each case = until his or her successor
is appointed and has qualified."
Section 4. Section 3(A) of Resolution No. 93-285,
adopted May 13, 1993, concerning the Tax -Exempt Property Steering
Committee, is hereby amended in the following particulars:
"Section 3. Committee membership.
(A) The committee shall consist of five (5)
individuals as community representative members
whose residence or place of business are in the
City of Miami or who own real nrDnerty in the City
of Miami and which are appointed by the City

Underscored words and/or figures shall be added. The
remaining provisions are now in effect and remain unchanged.

Commission. Additionally, said Committee shall
consist of, in a nonvoting advisory and support
capacity, one representative each from the City
Manager's Office, the Budget Department, Finance
Department, Planning, Building & Zoning Department
and the City Attorney's Office. Three (3) of the
appointed community representatives shall serve an
initial term of two (2) years and two (2) of the
appointed community representatives shall serve an
initial term of three (3) years. The mayor and
each city commissioner shall each nominate one
community representative member for appointment to
the Committee. Upon expiration of the initial
terms, subsequent appointments shall be for two
(2) years. A member may be reappointed by the
City Commission for not more than three
consecutive terms. Appointments to fill a vacancy
shall be for the remainder of the unexpired term.
An appointed member's term shall immediately
expire, pending appointment of a successor, upon
the occasion of the City Commissioner who
appointed said member leaving office."
Section 5. The provisions of this Resolution shall
become effective thirty (30) days after adoption.

It is respectfully recommended that the City Commission
adopt the attached resolution to amend the eligibility
requirements for membership to the following boards, in
conformity with the general standards applicable to City boards,
as contained in Ordinance No. 11130, as amended, the Ordinance
with established the standards for creation and review of boards:
1. Committee on Beautification and Environment
2. Health Facilities Authority
3. Tax -Exempt Property Steering Committee
