A RESOLUTION BY A 4/5THS AFFIRMATIVE VOTE OF
THE MEMBERS OF THE CITY COMMISSION AFTER A
DULY ADVERTISED PUBLIC HEARING, RATIFYING,
APPROVING AND CONFIRMING THE CITY MANAGER'S
FINDING THAT AN EMERGENCY NEED EXISTED,
WAIVING COMPETITIVE SEALED BIDS, AND
APPROVING THE PURCHASE OF TWENTY (20)
MOTORCYCLES FROM SOUTHWEST CYCLE COMPANY,
INC., AT A TOTAL PROPOSED AMOUNT OF
$149,980.00, FOR THE DEPARTMENT OF POLICE;
ALLOCATING FUNDS THEREFOR FROM THE DEPARTMENT
OF GENERAL SERVICES ADMINISTRATION AND SOLID
WASTE/FLEET MANAGEMENT DIVISION, ACCOUNT CODE
NO. 420902-880; AUTHORIZING THE CITY MANAGER
TO INSTRUCT THE CHIEF PROCUREMENT OFFICER TO
ISSUE A PURCHASE ORDER FOR SAID VEHICLES.
WHEREAS, with the upcoming Summit of the Americas to be held
in the City of Miami, it is imperative that the Police
Department's motorcycle detail maintain its capabilities of
providing traffic control; and
WHEREAS, the current motorcycle fleet has exceeded the
patrol vehicle mileage life of seventy thousand (70,000) miles
and will be pulled out of service in September; and
WHEREAS, twenty (20) motorcycles will be immediately needed
for use by the motorcycle detail; and
WHEREAS, informal quotes were obtained from Palmetto
Kawasaki in the amount of $7,855.00 per motorcycle, Harley
Davidson in the amount of $8,865.00 per motorcycle and Southwest
Cycle Company, Inc. the lowest responsive and responsible bidder
in the amount of $7,499.00 per motorcycle; and

WHEREAS, funds for this purchase are available from the
Department of General Services Administration and Solid
Waste/Fleet Management Division, Account Code 420902-880;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. By an affirmative vote of 4/8ths of the members
of the City Commission, after a duly advertised public hearing,
the City Manager's written finding that an emergency need existed
is hereby ratified, approved and confirmed, the requirements for
competitive sealed bids are hereby waived, and the purchase of
twenty (20) motorcycles, from Southwest Cycle Company, Inc., in
the amount of $149,980.00, for the Department of Police, is
hereby approved, with funds therefor hereby allocated from the
Department of General Services Administration and Solid
Waste/Fleet Management Division, Account Code No. 420902-880.
Section 3. The City Manager is hereby authorized to
instruct the Chief Procurement Offioer -to issue a purchase order
for said vehicles.

It is respectfully recommended that the City Commission pass the
attached resolution ratifying, approving and 'confirming the
purchase of twenty (20) motorcycles on an emergency basis from
Southwest Cycle Company, Inc. a Non-Minority/Dade County vendor
located at 8966 Bird Road, Miami Florida 33166, at a total
proposed cost of $149,980.00 for the Department of General
Services Administration and Solid Waste/Fleet Management
Division.
The Department of General Services Administration and Solid Waste
and the Department of Police has determined a need to purchase
twenty (20) new motorcycles. With the upcoming Summit of the
Americas, it is imperative that the Motorcycle Detail maintain
its capabilities of providing traffic control. The motorcycle
fleet currently in use has exceeded the patrol vehicle mileage
life and will pulled from service in September. According to the
agreement between the Fraternal Order of Police and the City of
Miami any patrol vehicle that has exceeded its seventy thousand
70,000 mileage life or a five (5) year period must be retired
from service.
Informal quotes were received from three (3) vendors: Palmetto
Kawasaki in the amount of $7,855, Harley Davidson in the amount
of $8,865 and Southwest Cycle Company, Inc. the lowest responsive
and responsible bidder in accordance with specifications in the
amount of $7,499. Funds for this purchase are available from the
Department of General Services Administration and Solid
Waste/Fleet Management Division, Account Code No. 420902-880.

The Department of General Services Administration and Solid Waste
is requesting your approval in waiving the formal competitive
bidding process and authorizing the purchase of twenty (20)
motorcycles to be used by the Police Department's Motorcycle
Detail.
With the upcoming Summit of the Americas, it is imperative that

traffic control. The motorcycle fleet currently in use has
exceeded the patrol vehicle mileage life and will be pulled out
of service in September. According to the agreement between the

By your signature below, I will initiate a purchase order to
Southwest Cycle Company, Inc. in order to have these motorcycles
available as soon as possible. Ratification legislation will
follow at the earliest possible date.

Commission Chambers at City Hall, 3500 Pan American Drive, Miami,
Florida, for the purpose of hearing any objections by the City
Commission from any interested parties affected by a Resolution
ratifying the City Manager's action in waiving competitive sealed
bids and purchasing twenty (20) motorcycles on an emergency basis
due to the upcoming Summit of the Americas from Southwest Cycle
Company, Inc. a non -minority vendor, located in Miami, Florida.
Informal quotes were solicited and Southwest Cycle was the lowest
responsive and responsible bidder.
All interested persons are invited to appear and may be heard
concerning this item. Should any person desire to appeal any
decision of the City Commission with respect to any matter
considered at this hearing, that person shall ensure that a
verbatim record of the proceedings is made, including all
testimony and evidence upon which any appeal may be based.
