RESOLUTION NO. 9 g" 755
A RESOLUTION RESCINDING IN THEIR ENTIRETY
RESOLUTION NO. 89-154, AS AMENDED, AND
RESOLUTION NO. 94-90; AND SUBSTITUTING IN
LIEU THEREOF A NEW RESOLUTION ESTABLISHING
CRITERIA AND PROCEDURES FOR NEWSPAPERS WHICH
CITY DEPARTMENTS AND OFFICES ARE PERMITTED TO
USE FOR PUBLISHING PUBLIC NOTICES AND FURTHER
LISTING THE NAMES OF THE ONLY NEWSPAPERS
APPROVED FOR SAID USE.
WHEREAS, Motion 82-617, adopted July 22, 1982, established
certain criteria for newspapers which City departments and
offices were permitted to use for publishing public notices and
further listed the names of certain newspapers to be added to an
existing list of newspapers used for such notices; and
WHEREAS, Resolution No. 89-154, adopted February 9, 1989,
listed the names of the only newspapers which City departments
and offices are permitted to use for publishing public notices;
and
WHEREAS, Resolution No. 89-154 was amended by Resolution
No. 94-90, to reflect additions, deletions, or changes to the
list of newspapers approved; and
WHEREAS, certain other changes and/or deletions necessitate
the. recession of Resolution No. 89-154 and Resolution No. 94-90,
and require that the City Commission adopt a new resolution
establishing criteria, procedures, and listing the names of
newspapers to be used for public notices;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. Resolution No. 89-154, as amended, and
Resolution No. 94-90 are hereby rescinded in their entirety.
Section 3. The following criteria and procedures are
hereby established for newspapers to be used for publishing
public notices:
1. The newspapers must be well established in the
community and have been in continuous operation
for several years.
2. The newspaper must have a circulation of over
10,000.
3. The newspapers must be based in the City of Miami
with its primary circulation distributed within
City limits.
4. Any newspaper meeting the established criteria
that wishes to be included in the list of
newspapers used for publishing public notices may
notify the City Manager who will present said
request to the City Commission for consideration;
said newspaper shall present to the City a
certified statement of circulation. In lieu of
said certified statement, a sworn statement as to
circulation average for the last year and
specifically for the past two editions will be
accepted.
5. All newspapers approved by the City Commission
shall report to the City every six months the
amount of its last circulation, said amount to be
confirmed by the seller of the newsprint.
6. Unless specifically designated that a newspaper be
used on an ongoing basis, newspapers approved by
the City Commission shall be used on a rotating
and equitable basis providing they meet the
established criteria.

Section 4. Effective October 28, 1994, all City
departments and offices are hereby instructed to use only the
following newspapers for publishing public notices, absent any
legal emergency requiring placement of such notices elsewhere;
such usage for placement of courtesy notices; i.e., those notices
which are not legally required to be advertised, are required to
be submitted to applicable publications by City departments on a
rotational and equitable basis; all newspapers are hereby
required at all times to meet criteria and procedures established
in Section 3 hereinabove:

This - Resolution shall become effective
immediately upon its adoption.
Use of this newspaper is required when advertisement must comply with
the provisions of Florida Statutes, Section 166.041(3)(c)2b. Other use
of this newspaper must be specifically approved by the City Manager, or
his designee, after consideration of ad content and size of targeted
audience.
The herein authorization does not apply to any of the other oomminity
newspapers printed by the publisher of this newspaper.
