RESOLUTION NO. - 5
A RESOLUTION AUTHORIZING THE PAYMENT OF
ADDITIONAL FEES FOR THE LAW OFFICES OF
MoCRARY AND MOSLEY TO CONTINUE ITS
REPRESENTATION OF THE CITY OF MIAMI WITH
RESPECT TO THE ST. HUGH OAKS VILLAGE PROJECT;
ALLOCATING FUNDS THEREFOR, IN AN AMOUNT NOT
TO EXCEED $15,000, FROM CAPITAL IMPROVEMENT
PROJECT NO. 321024, ENTITLED "AFFORDABLE
RENTAL HOUSING PROGRAM."
WHEREAS, pursuant to Resolution No. 92-74, the City
Commission authorized the City Attorney to engage the services of
the Law Offices of McCrary and Mosley (the "Firm"), to prepare
condominium documents, closing documents and issue the policies
for the St. Hugh Oaks Project ("Project") for a fee not to exceed
$25,000; and
WHEREAS, fees paid to date for services rendered total
approximately $23,000; and
WHEREAS, additional legal services are required in an amount
not to exceed $15,000;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:

Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The payment of additional fees is hereby
authorized for the law offices of McCrary and Mosley to continue
its representation of the City of Miami with respect to the
St. Hugh Oaks Village Project, with funds therefor, in an amount
net to exceed $15,000, hereby allocated from Capital Improvement
Project No. 321024, entitled "Affordable Rental Housing Program."
Section 3. This Resolution shall become effective
immediately upon its adoption.

ENCLOSURES
Pursuant to Resolution No. 92-74, adopted by the City
Commission on February 13, 1992, 1 was authorized to engage the
Law Firm of McCrary, Blizzard and Mosley to prepare the
condominium documents, closing documents, and issue title
policies for the twenty-three (23) unit single family residential
condominium development for the St. Hugh Oaks Project, for a fee
not to exceed twenty-three thousand dollars ($23,000).
To date, the City has paid the Firm approximately $23,000
for legal services rendered, however, additional services are
needed from the Firm with respect to the Project, to include: (1)
obtaining State of Florida approval of the condominium documents,
(2) serving as escrow agent, (3) preparing the closing documents
for the sale of the condominiums and (4) issuing title policies.
Accordingly, I am hereby requesting authorization to pay the
Firm additional fees for such services, not to exceed $15,000.
The Department of Development and Housing Conservation has
informed this office that funds are available from Project No.
321024, entitled "Affordable Rental Housing Program" to pay for
the Firms continued representation of the City.
