HomeMy WebLinkAboutR-94-0748Y' „ J-94-862 10/17/94 RESOLUTION NO. 9 4 748 A RESOLUTION AMENDING SECTION 3 OF RESOLUTION 94-487, ADOPTED JULY 14, 1994, WHICH ACCEPTED THE DONATION OF VACANT REAL PROPERTY LOCATED AT 1405 NORTHWEST 61 STREET, MIAMI, FLORIDA, MORE PARTICULARLY DESCRIBED AS LOTS 27 AND 28, BLOCK 10, ORANGE HEIGHTS, AS RECORDED IN PLAT BOOK 14, PAGE 62 OF THE PUBLIC RECORDS OF DADE COUNTY, FLORIDA, TO BE USED FOR THE EXPANSION OF AFRICAN SQUARE PARK; THEREBY INCREASING THE ALLOCATION BY $26,000 FOR A TOTAL ALLOCATION OF $38,000. WHEREAS, on July 14, 1994, the City Commission adopted Resolution 94-478 which accepted the donation of the property located at 1405 NW 61 Street, Miami, Florida (the "Property"), more particularly described as Lots 27 and 28, Block 10, Orange Heights, as recorded in Plat Book 14, Page 62 of the Public Records of Dade County, Florida, for the expansion of African Square Park; and WHEREAS, this Resolution provided an allocation of $12,000 to pay for costs associated with said acquisition including the payment of unpaid liens, recording fees, title insurance and related costs; and ` CITY COMMISSION I IdEETING OF OCT 2 7 "Pq4 Resolution No. 94- 748 WHEREAS, the City of Miami, Dade County and certain private individuals are currently holding certificates on this property totalling approximately $33,679; and WHEREAS, Dade County, as a certificate holder, has filed a tax deed application on the property with a public action scheduled for November 3, 1994; and WHEREAS, at the time Resolution 94-478 was adopted, it was the intent of the City of Miami to waive its outstanding liens and to pay all remaining liens held by third parties; and WHEREAS, Dade County has since advised the City of Miami that the City must pay all outstanding liens inclusive of those amounts owed the City, and Dade County will return all monies owed the City for the certificates it holds; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Section 3 of Resolution No. 94-478, adopted July 14, 1994, is hereby amended in the following particulars: 1/ "Section 3. The City Manager is authorized to expend an amount not to exceed $32,000 $38,000 of Nineteenth Year Community Development Block Grant funds, Project No. 331053, Account No. 589101-270, which exists as an available balance previously authorized by the City Commission for African Square Park, for payment of unpaid liens, recording fees, title insurance and related costs associated with the acceptance of this donation." 1/ The figure stricken through shall be replaced by the figure underlined. The remaining provsions are now in effect and remain unchanged. 9 4- 748 2 Section 3. This Resolution shall become effective immediately upon its adoption. On July 14, 1994, the City Commission adopted Resoi .on 94-478 which accepted the donation of the property located at 1405 KW 61 Street, Miami, Florida, for the expansion of African Square lark. This Resolution further provided an allocation of $12,000 to pay for costs associated with said acquisition including the payment of unpaid liens, recording fees, title insurance and related costs. The City of Miami, Dade County and certain private individuals are currently holding certificates on this property totalling $331679, A major portion of this amount, approximately $21,144 is being hall by the City for coats incurred for demolition and lot clearing. Dade County, as a certificate holder, has filed for a tax deed on the property and a public auction has been scheduled for November 3, 1994, At the time Resolutinn 94-478 vex adopted, it was the intent of the City to valve its outstanding liens and to pay all remaining liana hold by third parties. Dade County has since advised the City that it must pay all outstanding liens inclusive of those owed to the City. From this amount. Dade County will return approximately $21,144 to the City as payment for the eertifirwtes hold by the City. It is necessary at this time that the Resolution be amended to l.ncroace the allocation by $26,000 for a total allocation of $38#000 to cover the coxta of the outstanding liens.
