HomeMy WebLinkAboutR-94-0745F I J-94-830 10/17/94 RESOLUTION NO. 9 4- 745 A RESOLUTION RESCINDING RESOLUTION NO. 92-565, ADOPTED SEPTEMBER 24, 1992, WHEREBY THE BID OF LEADEX CORPORATION, WAS ACCEPTED FOR THE PROJECT ENTITLED "DORSEY PARK RECREATION AND REHABILITATION BUILDING B-6201-A (THE "PROJECT")"; AUTHORIZING THE CITY MANAGER TO NULLIFY THE CONTRACT BETWEEN THE CITY OF MIAMI AND LEADEX CORPORATION FOR SAID PROJECT, AND REJECTING ALL BIDS RECEIVED BY THE CITY IN CONNECTION WITH SAID PROJECT; FURTHER, DIRECTING THE CITY MANAGER TO SEEK NEW BIDS BASED ON SUCH SPECIFICATIONS AS HE DEEMS APPROPRIATE AND TO BRING BACK SAID BIDS TO THE CITY COMMISSION FOR REVIEW AND APPROVAL. WHEREAS, sealed bids were received August 6, 1992, for the project entitled "DORSEY PARK RECREATION AND REHABILITATION BUILDING B-6201-A"; and WHEREAS, on September 24, 1992, the City Commission adopted Resolution No. 92-565 accepting the bid of Leadex Corporation and authorizing the City Manager to execute a contract with said firm for the Project; and WHEREAS, since the original date, August 6, 1992, and due to economic consequences of Hurricane Andrew, Leadex Corporation was unable to maintain the Base Bid for the above Project; and WHEREAS, the City Manager has determined that it is in the best interest of the City of Miami that all bids received for the Project, Bid No. 93-94-123, be rejected and the Project readvertised; CITY COMMISSION, MEETrt,G OF 0r.. T 2 7 1p94 Resolution No, 94- 745 e NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings set forth in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Resolution No. 92-565, adopted September 24, 1992, whereby the bid of Leadex Corporation, was accepted for the project entitled "DORSEY PARK RECREATION AND REHABILITATION BUILDING B-6201-A (the "Project")", is hereby rescinded, and the City Manager is hereby authorized to nullify the contract between the City of Miami and Leadex Corporation for said Project. Section 3. All bids received by the City of Miami in connection with said Project are hereby rejected. Section 4. The City Manager is hereby directed to seek new bids based on such specifications as he deems appropriate and to bring back said bids to the City Commission for review and approval. . Section 5. QU N J ES , -if I CITY ATTO i Y GMM/ms/bs /M4677 -3- 9a- 745 CITY OF MIAMI, FLORIDA INTER -OFFICE MEMORANDUM TO: Honorable Mayor and Members DATE: of the City Commission SUBJECT FROM : REFERENCES CesarPer o city ENCLOSURES RECOMMENDATION OUT 1_8 1994 FILE Resolution for Dorsey Park Recreation and Rehabilitation Building, B-6201-A Resolution It is respectfully recommended that the City Commission adopt the attached resolution rescinding Resolution No. 92-565 and authorizing the City Manager to nullify the contract between the City of Miami and Leadex Corporation for the Dorsey Park Recreation and Rehabilitation Building, B-6201-A. This project will be readvertised at a later date. BACKGROUND On August 6, 1992 at 11:00 a.m. the Clerk of the City of Miami received and publicly open and read sealed bids for "Dorsey Park Recreation and Rehabilitation Building B-6201-A". Leadex Corporation submitted the lowest bid and, based on the proposal and corporate documentation submitted with the bidding package, the City Commission adopted Resolution No. 92-565 on September 24, 1992 accepting the bid submitted by that firm and authorizing the City Manager to execute a contract, in a form acceptable to the City Attorney, with Leadex Corporation. During the processing of their contract, It was determined that Leadex Corporation was unable hold their price on the Base Bid because the price escalations that -resulted from Hurricane Andrew. Due to this circumstance, it Is respectfully recommended that the City Commission adopt the attached resolution rescinding awarding Resolution No. 92-565 and authorizing the City Manager to nullify the contract between the City and Leadex Corporation for Dorsey Park Recreation and Rehabilitation Building B-6201-A. Because two years have elapsed since the original receipt of bids for this project, It Is in the best Interest of the City to reject all bids received for this project and for the Public Works Department to be directed to readvertise and receive new bids on the Dorsey Park Recreation and Rehabilitation Building Project B-6201-A. 94- 745 011
