RESOLUTION NO. 9 4- 740
A RESOLUTION AMENDING RESOLUTION 94-622,
ADOPTED SEPTEMBER 8, 1994, WHICH AUTHORIZED
THE CITY MANAGER TO NEGOTIATE AND ENTER INTO
A LEASE AGREEMENT ("LEASE") IN A FORM
ACCEPTABLE TO THE CITY ATTORNEY, WITH BEACON
PROPERTY MANAGEMENT CORPORATION, D/B/A
BEACON MANAGEMENT COMPANY OF MASSACHUSETTS
LIMITED PARTNERSHIP, AGENT FOR CRUZ
DEVELOPMENT & ASSOCIATES, LTD., FOR THE
CITY'S USE OF ROOFTOP SPACE AND AN INTERIOR
EQUIPMENT ROOM FOR CITY -OWNED COMMUNICATIONS
EQUIPMENT IN THE BISCAYNE VIEW APARTMENT
BUILDING, LOCATED AT 915 NORTHWEST 1 AVENUE,
MIAMI, FLORIDA, FOR A FIFTEEN (15) YEAR
PERIOD, WITH A FIVE (5) YEAR EXTENSION AT
THE CITY IS OPTION, AT AN ANNUAL RENT OF ONE
DOLLAR ($1.00); ALLOCATING FUNDS THEREFOR
FROM ACCOUNT NUMBER 420601-620; THEREBY
INCREASING THE ANNUAL RENT TO FOUR THOUSAND,
FOUR HUNDRED DOLLARS ($4,400.00) AND
ALLOCATING FUNDING FROM THE SAME ACCOUNT
NUMBER.
WHEREAS, City -owned microwave links, receptors, antennas,
etc., are presently housed in various locations including the
General Services Administration Central Communication Shop at
1080 N.W. 20 Street, Miami, Florida ("Motor Pool"); and
WHEREAS, due to the impending sale of the Motor Pool
property, it is reasonable and necessary to relocate and
consolidate the antenna communications equipment; and
WHEREAS, the Biscayne View Apartment building has been

identified by City staff as an ideal location for the relocation
and consolidation of the communications equipment due to its
height, capacity and close proximity to the Miami Police Central
District Station; and
WHEREAS, pursuant to Resolution No. 94-622 passed and
adopted on September 8, 1994, the City Commission authorized the
City Manager to enter into a Lease Agreement ("Lease"), in a form
acceptable to the City Attorney, with Beacon Property Management
Corporation, d/b/a Beacon Management Company of Massachusetts
Limited Partnership, agent for Cruz Development & Associates,
Ltd., for the City's use of rooftop space and an interior
equipment room for City -owned communications equipment in the
Biscayne View Apartments Building, located at 915 Northwest 1
Avenue, Miami, Florida, for a fifteen (15) year period with a
five (5) year extension at the City's option, at an annual rent
of One Dollar ($1.00) with funds therefor hereby allocated from
Account No. 420601-620; and
WHEREAS, Beacon Property Management Corporation has rejected
the City's offer of annual rent in the amount of One Dollar
($1.00) ;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference

thereto and incorporated herein as if fully set forth in this
Section.
Section 2. Section 2 of Resolution 94-622, adopted
September 8, 1994, Is amended in the following particulars
Section 2. The the City Manager is hereby authorized
to negotiate and enter into a Lease Agreement in a
form acceptable to the City Attorney, with Beacon
Property Management Corporation, d/b/a Beacon
Management Company of Massachusetts Limited
Partnership, agent for Cruz Development & Associates,
Ltd., for the City's use of rooftop space and an
interior equipment room for City -owned communications
equipment in the Biscayne View Apartment Building,
located at 915 Northwest 1 Avenue, Miami, Florida, for
a fifteen (15) year period, with a five (5) year
extension at the City's option, at .an annual rent of
Four Thousand, Four Hundred Dollars
($4,400.00); allocating funds therefor from Account
No. 420601-620.
Section 3. This Resolution shall become effective
immediately upon its adoption.
1 The figure stricken through shall be replaced by the figure
underlined. The remaining provisions are now in effect and
remain unchanged.

It is respectfully recommended that the City Commission amend
Resolution No. 94-622, adopted September 8, 1994, which
authorized the City Manager to negotiate and enter into a Lease
Agreement in a form acceptable to the City Attorney, with Beacon
Property Management Corporation, d/b/a Beacon Management Company
of Massachusetts Limited partnership, agent for Cruz Development
& Associates, Ltd., for the City's use of rooftop space and an
interior equipment room for City -owned communications equipment
in the Biscayne View Apartment Building, located.at 915 Northwest
1 Avenue, Miami, Florida, for a fifteen (15) year period, with a
five (5) year extension at the City's option, at an annual rent
of One Dollar ($1.00); allocating funds therefor from account
number 420601-620; thereby increasing the annual rent to Four
Thousand Four hundred Dollars ($4,400.00) and allocating funding
from the same account number.
BACKGROUND
City -owned microwave links, receptors, antennas, etc., are
presently housed in various locations including the General
Services Administration Central Communication Shop at 1080 N.W.
20 Street ("Motor Pool"). Due to the impending sale of the Motor
Pool property, it is reasonable and necessary to relocate and
consolidate the antenna communications equipment. The Biscayne
View Apartment building has been identified by staff as an ideal
location for the relocation and consolidation of the
communications equipment due to its height, capacity and close
proximity to the Miami Police Central District Station. The roof
of the building could replace the existing Transmission Tower
located at the Central Communication Shop. On September 8, 1994,
the City Commission passed and adopted Resolution 94-622 which
authorized the City Manager to negotiate and enter into a Lease
Agreement in a form acceptable to the City Attorney, with Beacon

Property Management Corporation, d/b/a Beacon Management Company
of Massachusetts Limited partnership, agent for Cruz Development
& Associates, Ltd. ("Beacon Property Management"), for the City's
use of rooftop space and an interior equipment room for City -
owned communications equipment in the Biscayne View Apartment
Building, located at 915 Northwest 1 Avenue, Miami, Florida, for
a fifteen (15) year period, with a five (5) year extension at the
City's option, at an annual rent of One Dollar ($1.00);
allocating funds therefor from account number 420601-620.
However, Beacon Property Management rejected the City's $1.00 per
year offer of rent stating that it has made other substantial
financial contributions to the City of Miami such as the use of
commercial space and free utilities in the Biscayne View
Apartment Building for the Downtown NET Service Center and the
Police Bicycle Detail Office.
Therefore, it is recommended that the'City Commission adopt the
attached Resolution amending Resolution No. 94-622, adopted
September 8, 1994, which authorized the City Manager to negotiate
and enter into a Lease Agreement in a form acceptable to the City
Attorney, with Beacon Property Management Corporation, d/b/a
Beacon Management Company of Massachusetts Limited partnership,
agent for Cruz Development & Associates, Ltd., for the City's use
of rooftop space and an interior equipment room for City -owned
communications equipment in the Biscayne View Apartment Building,
located at 915 Northwest 1 Avenue, Miami, Florida, for a fifteen
(15) year period, with a five (5) year extension at the City's
option, at an annual rent of One Dollar ($1.00); allocating funds
therefor from account number 420601-620; thereby increasing the
annual rent to Four Thousand Four Hundred Dollars ($4,400.00) and
allocating funding from the same account number.
