WHEREAS, the Miami Zoning Board at its meeting of July 11, 1994, Item No. 11, duly adopted Resolution No. ZB 64-94 by a six to two (6-2) vote, granting the Special Exception as hereinafter set forth; and WHEREAS, the Zoning Board decision was appealed to the City Commission; and WHEREAS, the City Commission after careful consideration of this matter, and notwithstanding the decision of the Zoning Board, deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to reverse the decision of the Zoning Board and deny the Special Exception; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: raPSCINDED 44fiN-SBY: 7 %s% CITY COMMSSION MEET?NG OF S F P 2 2 1994 Resolution No, 9 4 - 71 to a Section 1. The decision of the Miami Zoning Board to grant a special exception from Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, Article 4, Section 401, Schedule of District Regulations, C-1 Restricted Commercial, Conditional Principal Uses, to allow an extended care facility for the property located at 3800-3850 West Flagler Street, Miami, Florida, legally described as Lots 5-20 and the North 20 feet of the East 60 feet of Lot 24, Block 2, STADLER GROVE ADDITION NO. 1, as recorded in Plat Book 12 at Page 42 of the Public Records of Dade County, Florida, zoned C-1 Restricted Commercial, is hereby reversed, the herein appeal is hereby granted, and the special exception is hereby denied. Such a facility is needed and it will be of overall benefit to the community. The site is along a major commercial arterial and has adequate parking, ingress,'pgress, lighting, drainage and all of the other factors as set forth in Sec. 1305 of Zoning Ord. 11000; however, there is some concern over the potentially adverse effects the use may have on the surrounding area; therefore the Planning, Building and Zoning Dept. is recommending approval with the following conditions: 1) the facility shall provide 24 hour security/supervision at all times; 2) client stay shall be temporary (not to exceed 30 days); 3) the facility shall be limited to nondangerous mentally ill; and 4) a c.b.s wall, to be approved by the Planning Div., shall be provided along the rear of the property, where it is adjacent to residential areas. The recommendation of approval is based on findings that upon compliance with the aforementioned conditions, the proposal will have no adverse impacts on the surrounding area. Due consideration shall be given to the location, scale, design, and screening of refuse and service areas to the manner in which refuse is to be stored; and to the manner and timing of refuse collection and deliveries, shipments, or other service activities, as such matters relate to the location and nature of uses on adjoining properties and to the location and character of adjoining public ways. 1305.4 Signs and lighting. Due consideration shall be given to utilities required, with particular reference to availability and capacity of systems, location of connections, and potentially adverse appearance or other adverse effects on adjoining and nearby property and the character of the area. 1305.6 Drainage Due consideration shall be given for drainage, with particular reference to effect on adjoining and nearby properties and on general drainage systems in the area. where major drainage volumes appear likely and capacity of available systems is found marginal or inadequate, consideration shall be given to possibilities for recharge of groundwater supply on the property, temporary retention with gradual discharge, or other remedial measures. 1305.7 Preservation of natural features. Due consideration shall be given to provision for the preservation of existing vegetation and geological features whenever possible. 1305.8 Control of potentially adverse effects generally. In addition to consideration of detailed elements indicated above, as appropriate to the particular class or kind of special permit and the circumstances of the particular case, due consideration shall be given to potentially adverse effects generally on adjoining and nearby properties, the area, the neighborhood, or the City, of the use or occupancy as proposed, or its location, construction, design, character, scale or manner of operation. Where such potentially adverse effects are found, consideration shall be given to special remedial measures appropriate in the particular circumstances of the case, including screening or buffering, landscaping, control of manner or hours of operation, alteration of use of such space, or such other measures as are required to assure that such potential adverse effects will be eliminated or minimized to the maximum extent reasonably feasible, and that the use of occupancy will be compatible and harmonious with other development in the area to a degree which will avoid substantial depreciation of the value of nearby property. Community based residential facilities, procedures. 934.2.1..Registration required. All existing,and proposed community based residential facilities shall register with the department of planning, building and zoning. Re• quired information for registration includes; 1. The name of the sponsoring organization, if any. 2. The name of the facility operator. 3. The street address of the facility. 4. The type of program to be offered by the facility. 5. The maximum number of persons who will live at the facility. 6. The governmental authorization to operate the facility. 9342.1.1. Official map and registration file. The department of planning, building and zoning inspections shall provide and maintain an official map that shows the location of all existing community based residential facilities and a registration file. 934.2.2. Special Exception required. Unless otherwise specifically permitted in residential districts (see schedule of district regulations), as licensed by FHRS within specified capacities, all proposed community based residential facilities are permissible only by Special Exception with city commission approval, subject to the following require- ments and limitations: 9$4;2.2.1. Measurement shall be made from the nearest point of the site of the existing facility to the nearest point of the site of the proposed facility. 934.2.2.2. Recreation open space. Recreation open space shall be provided in accord with the following schedule: 1. Two hundred (200) square feet for each resident under eighteen (18) years of age. 2. One hundred fifty (150) square feet for each resident eighteen (18) years of age or older. All such recreation space shall be appropriately landscaped and buffered for the comfort, convenience and enjoyment of the residents with due consideration for adjacent properties. 934.2.2.3. Yards for facilities with more than fifty occupants. The rear and interior or side yards of facilities with more than fifty (50) occupants shall be screened with a solid textured wall, fence or compact hedge with a minimum height of five (5) feet, 934.2.2.4. Interior space. Unless occupants are related by blood or marriage, or below the age of six (6) or over the age of eighty (80), occupancy shall be limited to one (1) person per room, except that, where rooms are a minimum of two hundred (200) square feet in area, occupancy may be two (2) persons per room, if divided by a (low) partition. 934.212.5. Of fstreetparking. One (1) offstreet parking space for each staff member and one (1) offstreet parking space for each four (4) residents shall be provided. A reduction in required occupant offstreet parking shall be permissible, provided findings are made that clearly show such reduction is reasonable based on such factors as facility proximity to mass transit, location of occupant employment area, occupant auto ownership, facility visitation policy, and the like. 934.2.2.6. Limitations on signs. Signs shall be limited to a nameplate not exceeding two (2) square feet for each street frontage. 934.3. Certificate of use not transferable, new ownership by Special Exception with city com- mission approval. The extended care the site is sorely needed to serve the mental illness and will fill an acute need We are aware of the opposition of the home owners and business people in the immediate vicinity but we are also aware, as the result of our advocacy efforts, of the acute shortage of facilities for the treatment of persons with mental illness. We feel that such opposition to the facility is based on misinformation and lack of understanding of the problems, conduct, and actions of persons suffering from mental illness. Persons suffering from mental illness, including those with drug dependency problems, POSE FAR LESS OF A THREAT TO A COMMUNITY IF THEY ARE RECEIVING TREATMENT THAN IF THEY ARE WANDERING THE STREETS WITHOUT TREATMENT. Most of the unfortunate incidents reported in the news media regarding mentally ill persons are perpetrated by persons not receiving treatment for their mental illness. Health Center has been housed In its present location since 1979, providing ;invaluable services to the community at large, and to the immediate neighborhood. It is located about 1 and one hall' blocks from the Little Havana police station, and the neighborhood 'NET office, which has been in existence for approximately two and a half years. In this time, there has never been a complaint from a neighbor regarding Miami Mental Health Center, Inc., 2141 S.W. 1st Street. On the contrary, the Center has contributed to the integrity of the neighborhood because one of the things that It does is to attempt to get, homeless people who show up in the area, sleeping in the doorways of local businesses, into treatment, or hooked up with programs which oan help them. In so doing, these homeless people are removed from the street and from public view. Let me emphasize that these people are not here because of the Miami Mental Health Center, but are here just as they are in every area of the City where there are businesses. The Miami Mental Health Center has also helped the Little Havana Neighborhood by organizing business people and neighbors to declare on the social services needs and the need for services for families and children in the area. This resulted in the Annie Casey Found'atxon choosing the Little Havana Area for allooation of a great deal of grant dollars, for services which will result in stronger families, less grime, and less' juvenile delinquency. The Center also participates in the Crime Watoh Project, as is as Interested in any other good neighbor in the prevention of crime and delinquency. Although we will be sorry to see the center move, we understand its need for an upgraded site, and can unequivocally reassure the neighbors of the projected, new site, that they will be an asset to their community.
