A RESOLUTION RATIFYING, APPROVING AND
CONFIRMING THE CITY MANAGER''t EMERGENCY
ACTION IN MAKING A PAYMENT TO THE OFFICE OF
THE ATTORNEY GENERAL, DEPARTMENT OF LEGAL
AFFAIRS, FOR THE STATE OF FLORIDA, IN THE
AMOUNT OF $37,118.52 FOR REIMBURSEMENT OF THE
WYNWOOD COMMUNITY ECONOMIC DEVELOPMENT
CORPORATION SAFE NEIGHBORHOOD CAPITAL
IMPROVEMENT GRANT; ALLOCATING FUNDS THEREFOR
FROM SPECIAL PROGRAMS AND ACCOUNTS,
NO. 921002-321.
WHEREAS, the City of Miami, Florida, received the Wynwood
Community Economic Development Corporation Safe Neighborhood
Capital Improvement Grant from the State of Florida in the amount
of $95,200.100in connection with the implementation of the Safe
Neighborhood Improvement District ("SNID") Project; and
WHEREAS, the Wynwood Community Economic Development
Corporation ("WCEDC") was the sub -recipient of these grant funds;
and
WHEREAS, based on a review of the City's Independent
Auditors' Report and other materials submitted to the State's
Office of the Attorney General, Department of Legal Affairs
("Offioe") regarding the grant expenditures, the Office
determined that several expenditures were unallowable for reason,

such as, no supporting documentation to evidence that the
expenditure was incurred to benefit the project, insufficient
documentation of time spent on the project, expenditures incurred
after the close of the.grant period, etc.; and
WHEREAS, as a result of said determination, the Office
requested reimbursement from the City in the amount of $37,118.52
on or before August 13, 1994; and
WHEREAS, in order to meet the reimbursement deadline imposed
by the Office, a check in the amount of $37,118.52 was forwarded
to the Office on August 3, 1994;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The emergency action of the City Manager in
making a payment to the Office of the Attorney General,
Department of Legal Affairs, for the State of Florida, in the
amount of $37,118.52 for reimbursement of the Wynwood Community
Economic Development Corporation Safe Neighborhood Capital
Improvement Grant, with funds therefor hereby allocated from
Special Programs and Accounts, No. 921002-321, is hereby
ratified, approved and confirmed.
Section 3. This Resolution shall become effective
immediately upon its adoption.

It is respectfully requested that the City Commission adopt the attached resolution
ratifying the City Manager's emergency action in making a payment to the State of
Florida at the request of the Office of the Attorney General in the amount of $37,118.52
for reimbursement of the Wynwood Community Economic Development Corporation
Safe Neighborhood Capital Improvement Grant with funds being allocated from Special
Programs and Accounts, Account No. 921002-321.
The Wynwood Community Economic Development Corporation (WCEDC) was the sub -
recipient of a $95,200 Safe Neighborhood Capital Improvement Grant received by the
City from the State of Florida for the implementation of the Safe Neighborhood
Improvement District (SNID) project. Based upon a review of the City's Independent
Auditors' report and other materials submitted relative to WCEDC's expenditures of
these grant funds, the State concluded that several expenditures by WCEDC were
considered unallowable for reasons such as, no supporting documentation to evidence
that the expenditures were incurred to benefit the project, insufficient documentation of
time spent on the project, expenditures incurred after the close of the grant period, etc.
As a result of this determination, on July 13, 1994 the Office of the Attorney General
requested reimbursement from the City of $37,118.52 on or before August 13, 1994. In
order to meet this deadline a check was forwarded to the Office of the Attorney General
on August 3, 1994.

Attached please find our response and a letter from the Attorney
General for the State of Florida requesting reimbursement of
$37,118.52 relative to the Wynwood Community Economic Development
Corporation (WCEDC) Safe Neighborhood Capital Improvement Grant.
WCEDC was the sub -recipient of these grant funds and as stated in
the attached letter, several expenditures by the sub -recipient
were considered unallowable for reasons such as no supporting
documentation to evidence that the expenditures were incurred to
benefit the project.
At this time, I am remitting the reimbursement amount within the
thirty (30) days allotted by the State and will seek City
Commission ratification in September. I will also pursue the
collectability of these funds from the sub -recipient upon meeting
with our outside counsel, to be scheduled by the City Attorney.
