HomeMy WebLinkAboutR-94-06730 J-94-752 9/13/94 RESOLUTION NO 9 4- 673 A RESOLUTION, WITH ATTACHMENT(S), OFFICIALLY ACCEPTING THE CITY CLERK'S CERTIFICATION AND DECLARATION OF THE RESULTS OF THE SPECIAL MUNICIPAL ELECTION HELD ON SEPTEMBER 8, 1994, ATTACHED HERETO AND MADE A PART HEREOF, IN WHICH THE ISSUANCE IN AN AGGREGATE AMOUNT NOT EXCEEDING $25,000,000 FIRE FIGHTING, FIRE PREVENTION AND RESCUE FACILITIES BONDS OF THE CITY OF MIAMI, FLORIDA, AND THE LEVYING AND COLLECTION OF AD VALOREM TAXES TO PAY SUCH BONDS, WAS DISAPPROVED BY THE ELECTORATE. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Commission hereby officially accepts the City Clerk's Certification and Declaration of the results of the Special Municipal Election held on September 8, 1994, attached hereto and made a part hereof, in which the issuance in an aggregate amount not exceeding $25,000,000 FIRE FIGHTING, FIRE PREVENTION AND RESCUE FACILITIES BONDS of the City of Miami, Florida, and the levying and collection of ad valorem taxes to pay such bonds, was disapproved by the electorate. Section 2. The City Commission hereby declares: (a) with respect to said question of the issuance in an aggregate amount not exceeding $25,000,000 FIRE FIGHTING, FIRE PREVENTION AND RESCUE FACILITIES BONDS of the City of Miami, Florida, and the levying and collection of ad valorem taxes to C= COM USSION MEETING OF CC AIN1, D. S E P 2 2 #994 Resolution Na 94- 673 f � , 0 pay such bonds, said election was duly called and properly held and notice thereof was duly given in accordance with law and Ordinance No. 11134, adopted March 24, 1994, entitled: "AN ORDINANCE AUTHORIZING THE ISSUANCE, SUBJECT TO THE ELECTION HEREIN PROVIDED FOR, OF $25,000,000 FIRE FIGHTING, FIRE PREVENTION AND RESCUE FACILITIES BONDS OF THE CITY OF MIAMI, FLORIDA, FOR THE PURPOSE OF PAYING THE COST OF FIRE FIGHTING, FIRE PREVENTION AND RESCUE FACILITIES IN THE CITY OF MIAMI, INCLUDING CONSTRUCTION AND IMPROVEMENT OF FIRE STATIONS AND FACILITIES, ACQUISITION, MODIFICATION AND REFURBISHMENT OF RESCUE UNITS AND FIRE APPARATUS, ACQUISITION AND INSTALLATION OF COMPUTER, COMMUNICATION AND MANAGEMENT INFORMATION SYSTEMS, IMPROVEMENT OF FIRE TRAINING FACILITY, ACQUISITION OR MODIFICATION OF FIRE, RESCUE, EMERGENCY MEDICAL AND SAFETY EQUIPMENT, AND THE ACQUISITION OF ANY NECESSARY LAND AND OTHER EQUIPMENT, PROVIDING .FOR THE LEVY AND COLLECTION OF AD VALOREM TAXES TO PAY SUCH BONDS, PROVIDING FOR THE HOLDING OF A SPECIAL MUNICIPAL ELECTION IN THE CITY OF MIAMI, FLORIDA, ON SEPTEMBER 8, 1994, WITH RESPECT TO THE ISSUANCE OF SUCH BONDS."; (b) all steps in connection with said election were duly, regularly and lawfully taken and had; and all applicable provisions of the Constitution of Statutes of the State of Florida and of said Ordinance have been fully oomplied with; (o) the inspectors and olerks of eaoh election precinct in the City have duly made returns of the results of the election in each such precinot on the question submitted at said election; (d) at said election there was submitted to the qualified electors of the City of Miami, Florida, the following question: 94- 673 -2- % "Shall the City of Miami, Florida, issue Bonds in an aggregate amount not exceeding $25,000,000 under Ordinance No. 11134 to pay the cost of FIRE FIGHTING, FIRE PREVENTION AND RESCUE FACILITIES, at one time or from time to time and to mature not more than 20 years after the date of issuance of the respective bonds, with interest at -lawful statutory rates, payable from unlimited ad valorem taxes?" (e) the attached schedule correctly shows the number of each of the election precincts in the City of Miami, the number of electors entering the voting machine booths for the purpose of voting, the number of votes cast by qualified electors approving said question, and the number of votes cast by qualified electors disapproving said question; and (f) each qualified elector of the City of Miami was given the opportunity of voting for or against the question. Section 3. With respect to the question set forth above, it is hereby found and determined that 11,756 votes were cast by qualified electors in favor of the issuance in an aggregate amount not exceeding $25,000,000 FIRE FIGHTING, FIRE PREVENTION AND RESCUE FACILITIES BONDS of the City of Miami, Florida, and the levying and collection of ad valorem taxes to pay such bonds; that 15,362 votes were cast by qualified electors against the issuance of said bonds, and the Commission hereby declares and certifies that the question of such issuance and the levying and collection of a tax to pay such bonds was disapproved by the qualified electors of the City of Miami at such election and that the total number of votes on the question in said election in said voting precincts was 27,118; and that a majority of the votes on the question in said election in said voting precincts -3- 94- 67R h was not in favor of the. issuance in an aggregate amount not exceeding $25,000,000 FIRE FIGHTING, FIRE PREVENTION AND RESCUE FACILITIES BONDS and the levying and collection of ad valorem taxes to pay such bonds. Section 4. This Resolution shall become effective Immediately upon its adoption. PUBLIC LOGIC AND ACCURACY TEST CERTIFICATION OF THE TABULATION EQUIPMENT 1. On September 2, 1994 commencing at approximately 9:30 A.M., the Dade County Supervisor of Elections had the tabulating equipment based in the Elections Department at the. Stephen P. Clark Center tested to ascertain that the equipment would correctly count the precinct and absentee ballot votes cast for all candidates and issues. 2. Test results were compared with the predetermined totals for each candidate and issue and, pursuant to the requirements established in Section 101.5612, Florida Statutes, the performance and results of all required tests were observed and the correctness of the program, precinct header cards and test ballots, as well as any replacement of said materials required by said tests, were verified. 3. At the completion of this public logic and accuracy test, the verified logic and accuracy report, HUB console log, program microdisk (seal 0008177), and test ballots with precinct header cards, were placed in the custody of the Supervisor of Elections under seal number 0008466. 4 - 673 .� 1 II. LOGIC AND ACCURACY TEST CERTIFICATION OF THE PRE -'AND POST - PRECINCT AND ABSENTEE BALLOT COUNTS 4. On September 8, 1994, commencing at approximately 6 P.M., the Dade County Supervisor of Elections had the tabulating equipment based in the Election s.Department at the Stephen P. Clark Center tested to ascertain that the equipment would correctly count the precinct and absentee ballot votes cast for all candidates and issues. Seal number 0008466, used to secure the testing materials, and seal 0008177, used to seal the program microdisk, were broken in the presence of Dade County and City of Miami representative and the contents were used following the procedures of paragraph (2), above, to complete this pre -count logic and accuracy test. 5. At the completion of this pre -count logic and accuracy test, all precinct ballots cast were counted. Except as otherwise specifically set forth and declared in this Certification, in our presence and sight, no ballot card was removed from or added to any ballot card container, ballot card tray or other segregation of ballots., and no ballotcard was in any manner altered . nor tampered with by any person, and no person touched any ballot card container, ballot card tray or ballot card except the person authorized to do so pursuant to Section 101.5614, Florida Statutes. 6. At the completion of the precinct and absentee ballot count, the automatic tabulating equipment was again tested to ascertain that the equipment correctly counted the precinct and absentee votes cast for all candidates and issues. 7. At the completion of this post -count logic `and accuracy test, all voted ballots with their precinct header cards and duplicated and spoiled ballots were stored in card cabinets under seal numbers A-21395, B-21006, C-21216, D-210510, E-13956,'F-21031, G-21257, H-21001,'1-22678, J- 21020, K-8238, L-000810. In a cabinet under seal number 0008071, were stored the verified logic & accuracy report, HUB console log, program microdisk (seal 0008314), and under seal number 0008071, the test ballots with precinct header cards. All items, sealed as described above, were placed in the custody of the Supervisor of Elections.
