A RESOLUTION, WITH ATTACHMENT(S), OFFICIALLY
ACCEPTING THE CITY CLERK'S CERTIFICATION AND
DECLARATION OF THE RESULTS OF THE SPECIAL
MUNICIPAL ELECTION HELD ON SEPTEMBER 8, 1994,
ATTACHED HERETO AND MADE A PART HEREOF, IN
WHICH THE ISSUANCE IN AN AGGREGATE AMOUNT NOT
EXCEEDING $28,000,000 POLICE HEADQUARTERS AND
CRIME PREVENTION FACILITIES BONDS OF THE CITY
OF MIAMI, FLORIDA, AND THE LEVYING AND
COLLECTION OF AD VALOREM TAXES TO PAY SUCH
BONDS, WAS DISAPPROVED BY THE ELECTORATE.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The City Commission hereby officially accepts
the City Clerk's Certification and Declaration of the results of
the Special Municipal Election held on September 8, .1994,
attached hereto and made a part hereof, in which the issuance in
an aggregate amount not exceeding $28,000,000 POLICE HEADQUARTERS
AND CRIME PREVENTION FACILITIES BONDS of the City of Miami,
Florida, and the levying and collection of ad valorem taxes to
pay such bonds, was disapproved by the electorate.
Section 2. The City Commission hereby declares:
(a) with respect to said question of the issuance in
an aggregate amount not exceeding $28,000,000 POLICE HEADQUARTERS
AND CRIME PREVENTION FACILITIES BONDS of the City of Miami,
Florida, and the levying and collection of ad valorem taxes to

pay such bonds, said electionwas duly called and properly held
and notice thereof was duly given in accordance with law and
Ordinance No. 11133, adopted March 24, 1994, entitled:
"AN ORDINANCE AUTHORIZING THE ISSUANCE,
SUBJECT TO THE_ELECTION HEREIN PROVIDED FOR,
OF $28,000,000_POLICE HEADQUARTERS AND CRIME
PREVENTION FACILITIES BONDS OF'THE CITY OF
MIAMI, FLORIDA, FOR THE PURPOSE OF PAYING THE
COST OF POLICE AND CRIME PREVENTION
FACILITIES IN THE CITY OF MIAMI, FLORIDA (THE
"CITY"), INCLUDING THE RENOVATION OF THE
POLICE HEADQUARTERS BUILDING AND ACQUISITION
OF PROPERTY ADJACENT THERETO, THE ACQUISITION
AND INSTALLATION OF COMMUNICATION AND
COMPUTER EQUIPMENT AND FACILITIES, THE
PROVISION OF FACILITIES FOR TRAINING,
PROPERTY STORAGE (STORING AND SAFEGUARDING
IMPOUNDED VEHICLES, WEAPONS, INSTRUMENTS AND
RECORDS, AND MATERIALS HELD AS EVIDENCE) AND
OTHER POLICE PURPOSES AND THE ACQUISITION OF
ANY NECESSARY LAND AND OTHER EQUIPMENT,
PROVIDING FOR THE LEVY AND COLLECTION OF AD
VALOREM TAXES TO PAY SUCH BONDS, PROVIDING
FOR THE HOLDING OF A SPECIAL MUNICIPAL
ELECTION IN THE CITY OF MIAMI, FLORIDA, ON
SEPTEMBER 8, 1994, WITH RESPECT TO THE
ISSUANCE OF SUCH BONDS.";
(b) all steps in connection with said election were
duly, regularly and lawfully taken and had; and all applicable
provisions of the Constitution of Statutes of the State of
Florida and of said Ordinance have been fully complied with;
(c) the inspectors and clerks of each election
precinct in the City have duly made returns of the results of the
election in each such precinct on the question submitted at said
election;
(d) at said election there was submitted to the
qualified electors of the City of Miami, ,Florida, the following
question:

"Shall the City of Miami, Florida, issue
Bonds in an aggregate amount not exceeding
$28,000,000 under Ordinance No. 11133 to pay
the cost of POLICE AND CRIME PREVENTION
FACILITIES, at one time' or from time to time
and to mature not more than 20 years after
the date of issuance of the respective bonds,
with interest at lawful statutory rates,
payable from unlimited ad valorem taxes?"
(e) the attached schedule correctly shows the number
of each of the election precincts in the City of Miami, the
number of electors entering the: voting machine booths for the
purpose of voting, the number of votes cast by qualified electors
approving said question, and the number of votes cast by
qualified electors disapproving said question; and
(f) each qualified elector of the City of Miami was
given the opportunity of voting for or against the question.
Section 3. With respect to the question set forth above,
it is hereby found and determined that 11,281 votes were cast by
qualified electors in favor of the issuance in an aggregate
amount not exceeding $28,000,000 POLICE AND CRIME PREVENTION
FACILITIES BONDS of the City of Miami, Florida, and the levying
and collection of ad valorem taxes to pay such bonds; that 16,609
votes were cast by qualified electors against the issuance of
said bonds, and the Commission hereby declares and certifies that
the question of such issuance and the levying and collection of a
tax to pay such bonds was disapproved by the qualified electors
of the City of Miami at such election and that 'the total number
of votes on the question in said election in said voting
precincts was 27,890; and that a majority of the votes on the
question in said election in said voting. precincts was not in

favor of the issuance in an aggregate amount not exceeding
$28,000,000 Police Headquarters and Crime Prevention Faoilities
Bonds,.and the levying and collection of ad valorem taxes to pay
such bonds.
Section 4. This Resolution shall become effective
immediately upon its adoption.

I, MATTY HIRAI, City Clerk of the City of Miami, Florida, do
hereby certify that all necessary legal steps were taken in
connection with the conduct of a City of Miami Special Election
held on September 8, 1994 including the following Logic and
Accuracy Tests:
I. PUBLIC LOGIC AND ACCURACY TEST CERTIFICATION OF THE
TABULATION EQUIPMENT
1. On September 2, 1994 commencing at approximately 9:30
A.M., the Dade County Supervisor of Elections had the
tabulating equipment based in the Elections Department
at the Stephen P. Clark Center tested to ascertain that
the equipment would correctly count the. precinct and
absentee ballot votes cast for all candidates and
issues.
2. Test results were compared with the predetermined totals
for each candidate and issue and, pursuant to the
requirements established in Section 101.5612, Florida
Statutes, the performance and results of all required
tests were observed and the correctness of the program,
precinct header cards and test ballots, as well as any
replacement of said materials required by said tests,
were verified.
3. At the completion of this public logic and accuracy
test, the verified logic and accuracy report, HUB
console log, program microdisk (seal 0008177). and test
ballots with precinct header cards, were placed in the
custody of the Supervisor of Elections under seal number
0008466.

IT. LOGIC AND ACCURACY TEST CERTIFICATION OF THE PRE --AND POST -
PRECINCT AND ABSENTEE BALLOT COUNTS
4. On September 8, 1994, commencing at approximately 6
P.M., the Dade County Supervisor of Elections had the
tabulating equipment based in the Elections Department
at the Stephen P. Clark Center tested to ascertain that
the equipment would correctly count the precinct and
absentee ballot votes cast for all candidates and
issues.
Seal number 0008466, used to secure the testing
materials, and seal 0008177, used to seal the program
microdisk, were broken in the presence of Dade County
and City of Miami representative and the contents were
used following the procedures of paragraph (2), above,
to complete this pre -count logic and accuracy test.
5. At the completion of this pre -count logic and accuracy
test, all precinct ballots cast were counted. Except as
otherwise specifically set forth and declared in this
Certification, in our presence and sight, no ballot card
was removed from or added to any ballot card container,
ballot card tray or other segregation of ballots, and no
ballot card was in any manner altered or tampered with
by any person, and no person touched any ballot card
container, ballot card tray or ballot card except the
person authorized to do so pursuant to Section 101.56141
Florida Statutes.
6. At the completion of the precinct and absentee ballot
count, the automatic tabulating equipment was again
tested to ascertain that the equipment correctly counted
the precinct and absentee votes cast for all candidates
and issues.
7. -At the completion of this post -count logic and accuracy
test, all voted ballots with their precinct header cards
and duplicated and spoiled ballots were stored in card
cabinets under seal numbers A-21395, B-21006, C-21216,
D-21051, E-13956, F-21031, G-21257, H-21001, 1-22678, J-
21020, K-8238, L-000810. In a cabinet under seal number
0008071, were stored the verified logic & accuracy
report, HUB console log, program microdisk (seal
0008314), and under seal number 0008071, the test
ballots with precinct header cards.
All items, sealed as described above, were placed in the
custody of the Supervisor of Elections.

sought to authorize issuance of $25,000,000 General
Obligation Bonds for Miami fire fighting/prevention/rescue
facilities, which appeared on the ballot for said Special
Election, and hereby declare that said question was
DISAPPROVED by the electorate.

We, the undersigned County Court Judge, Chairman of the Board of County
Commissioners and Supervisor of Elections, constituting the Board of County
Canvassers appointed to not during this election, do, by our signatures hereto, certify
that to fe best of our knowledge:
1. On September 2, 1004, commencing at approximately 9:30 a.m., the Supervisor of
Elections had the tabulating equipment based in the Elections Department at the
Stephen P. Clark Center tested to ascertain that the equipment will correctly count
the precinct and absentee ballot votes cast for all candidates and issues.

5. At the completion of this pre -count logic and accuracy test, all precinct ballots east

Certification, in our presence and sight, no ballot card was removed from or added
to any bailot card container, ballot card tray or other segregation of ballots, and no
ballot card was in any manner altered 'or tampered with by any person, and no
person touched any ballot card container, ballot card tray or ballot card, except a
person authorized to do so pursuant to Section 101.5614, Florida Statutes.
6. At the completion of the precinct and absentee ballot counts, the automatic
tabulating equipment was again tested to ascertain that the equipment correctly
counted the precinct and absentee votes cast for all candidates and issues.

ENCLOSURES:
The City of Miami Special Election concerning proposed issuance
of: (a) facilities bonds for construction of new police and crime
prevention facilities (including renovation of present
headquarters); as well as (b) proposed issuance of facilities
bonds to' pay for the construction of fire fighting, fire
prevention and rescue facilities, will be held on September 8,
1994. It will be in order for the City Commission to accept the
City Clerk's Certification and Declaration of Official Results of
said election at the meeting presently scheduled for September
22, 1994.
In your agenda packet, you will find copies of pertinent
documents as follows:
(1) City Clerk's Certification and Declaration of Official
results of City of the Miami Special election held on
September 8, 1994;
(2) A Certification from the Metropolitan Dade County Supervisor
of Elections in connection with the County's Logic and
Accuracy Tests;
(3) A computer printout of the complete precinct -by -precinct
breakdown showing the results of said elections; and
(4) A proposed Resolution officially accepting the City Clerk's
Certificate and Declaration of Election Results.
