A RESOLUTION RESCINDING, IN ITS ENTIRETY,
RESOLUTION NO. 94--587, ADOPTED JULY 26, 1994
WHEREBY THE CITY COMMISSION ACCEPTED THE
PROPOSAL SUBMITTED BY VIRGINIA KEY MARINE
GROUP, INC. FOR THE UNIFIED DEVELOPMENT OF
THE VIRGINIA KEY BOATYARD PROPERTY LOCATED AT
3501 RICKENBACKER CAUSEWAY, MIAMI, FLORIDA,
SAID ACCEPTANCE CONTINGENT UPON APPROVAL OF
SAID PROPOSAL BY THE ELECTORATE OF THE CITY
OF MIAMI AT A SPECIAL MUNICIPAL ELECTION.
WHEREAS, the City Commission, pursuant to Resolution
No. 94-587, adopted July 26, 1994, accepted the proposal
submitted by Virginia Key Marine Group, Inc. for the Unified
Development of the Virginia Key Boatyard Property located at
3501 Rickenbacker Causeway, Miami, Florida, said acceptance
contingent upon approval of said Proposal by the electorate of
the City of Miami at a special municipal election; and
WHEREAS, due to procedural irregularities concerning the
Request for Unified Development Proposals for Virginia Key
Boatyard, said Proposal cannot be accepted and Resolution
No. 94-587 must be rescinded;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.

Section 2. Resolution No. 94-587, adopted July 26, 1994,
whereby the City Commission accepted the Proposal submitted by
Virginia. Key Marine Group, Inc. for the Unified Development of
the Virginia Key Boatyard Property, located at 3501 Rickenbacker
Causeway, Miami, Florida, said acceptance contingent upon
approval of said Proposal by the electorate of the City of Miami
at a special municipal election, is hereby rescinded in its
entirety.
Section 3. This Resolution shall become effective
immediately upon its adoption.

RECOMMENDATION
It is respectfully recommended that the City Commission adopt the attached Resolution,
rescinding, in its entirety, Resolution 94-587, adopted July 26, 1994 whereby the City
Commission accepted the proposal submitted by Virginia Key Marine Group, Inc. for the
Unified Development of Virginia Key property located at 3501 Rickenbacker Causeway,
Miami, Florida.
BACKGROUND
The issuance of the Request for Proposals on February 4, 1994 did not comply fully with
requirements of City Charter Section 29-13, City Owned Property, Sale or Lease -
Generally, as regards advertisement of the solicitation of proposals for the sale or lease of
the subject property. Lacking full compliance with such Charter provisions, the proposal
cannot be accepted.
On July 26, 1994, by Resolution the City Commission accepted the proposal submitted
by Virginia Key Marine Group, Inc. for the Unified Development of the Virginia Key
Boatyard located at 3501 Rickenbacker Causeway, Miami, Florida, said acceptance
contingent upon approval of said Proposal by the electorate of the City of Miami at a
special municipal election. Due to procedural irregularities concerning the Request for
Unified Development Proposals for Virginia Key Boatyard, said Proposal cannot be
accepted and Resolution No. 94-587 must be rescinded.
