WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDS AND APPROVING THE ACQUISITION OF A SERVICE MONITOR FROM MOTOROLA j COMMUNICATIONS AND ELECTRONICS, INC., THE SOLE SOURCE PROVIDER FOR THIS EQUIPMENT, FOR THE DEPARTMENT OF GENERAL SERVICES ADMINISTRATION AND SOLID WASTE/COMMUNICATIONS DIVISION, AT A PROPOSED ESTIMATED COST OF $23,850.00, ALLOCATING FUNDS THEREFOR FROM z THE GENERAL SERVICES ADMINISTRATION AND SOLID t WASTE ACCOUNT CODE NO. 420601-840; AUTHORIZING THE CITY MANAGER TO INSTRUCT THE CHIEF PROCUREMENT OFFICE TO ISSUE A PURCHASE ORDER FOR THIS ACQUISITION. WHEREAS, the Department of General Services Administration and Solid Waste/ Communications Division request that competitive bidding be waived for the purchase of a service monitor to repair the City's Trunked Type I, II and DVP/DES radios manufactured by Motorola at a proposed estimated cost of $23,850.00; and WHEREAS, the City has no choice, nor does any other city, state, federal or government agency which has purchased a Motorola Trunked Communications System, because at this time there exists no compatibility between any rival service monitors; and WHEREAS, the Chief Procurement Officer has adopted a finding aZ'Y1� C��oiks-MSYON C-rP r r' If Qlf Resolution No. 94- 638 that Motorola Communications and Electronics, Inc. is the only vendor able to provide the service monitor as specified by the department that will be used to maintain the Motorola Smartnet System and Digital Voice Protection (DVP) equipment; and WHEREAS, the finding of the Chief Procurement Officer has been approved and adopted as the finding of the City Manager; and WHEREAS, the City Manager and the Chief Procurement Officer recommend that the requirements for competitive formal sealed bids be waived and the procurement of this system Motorola Communications and Electronics, Inc. as the sole source, be approved; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY I OF MIAMI, FLORIDA Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. By a 4/5ths affirmative vote of the members of the City Commission, after a duly advertised public hearing, the City Manager's written finding that Motorola Communications and Electronics, Inc., is the sole source provider of a compatible i service monitor, required by the City, is hereby ratified. Section 3. The requirements for competitive sealed bids is hereby waived and the Department of General Services I Administration and Solid Waste's request for the acquisition of a 1 service monitor, at a total proposed cost of $23,850.00, is hereby approved, with funds therefor hereby allocated from the i 044 UJ8 i } Department of General Services Administration and Solid Waste/Communications Division Account Code No. 420601-840. Section 4. The City Manager is hereby authorized to instruct the Chief Procurement Officer to issue a purchase order for this equipment. Section 5. Lauderdale, Florida at a proposed amount of $23,850.00. The monitor will be used to maintain the Motorola SMARTNET System and Digital Voice Protection (DVP) equipment and is only available from Motorola. BACKGROUND The Department of General Services Administration and Solid Waste, Communications Division is in need to purchase a Motorola Service Monitor to maintain the Motorola SMARTNET System and Digital Voice Protection (DVP) equipment. This equipment is sold to government agencies directly through a Motorola representative and not through normal retail outlets due to the internal system. At this time, the City has no other choice than to purchase the above mentioned monitor, the same as any other city, state, federal or government agency who owns a Motorola Trunked Communications System, as there is no other compatible monitor available. The Chief Procurement Officer has made a determination that Motorola Communications and Electronics, Inc. is the sole source provider of this equipment. Funds for this acquisition are available from the Department of General Services Administration and Solid Waste, Account Code No. 420601-840.
