HomeMy WebLinkAboutR-94-0595J-94-573(b) 7/26/94 RESOLUTION NC9 4 ` 595 A RESOLUTION, WITH ATTACHMENT(S), REVERSING THE DECISION OF THE ZONING BOARD AND GRANTING A VARIANCE FROM ORDINANCE NO. 11000, AS AMENDED, THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, ARTICLE 4, SECTION 401, SCHEDULE OF DISTRICT REGULATIONS, C-2 LIBERAL COMMERCIAL, OFFSTREET PARKING REQUIREMENTS, TO WAIVE FIFTY (50) OF SEVENTY SIX (76) REQUIRED OFFSTREET PARKING SPACES FOR A HEALTH CLINIC TO BE LOCATED AT 3090 SOUTHWEST 37TH AVENUE, MIAMI, FLORIDA, (MORE PARTICULARLY DESCRIBED ON EXHIBIT "A" ATTACHED HERETO AND MADE A PART HEREOF); ZONED C-2 LIBERAL COMMERCIAL; PER PLANS ON FILE; SUBJECT TO A TIME LIMITATION OF TWELVE (12) MONTHS IN WHICH A BUILDING PERMIT MUST BE OBTAINED, AND FURTHER SUBJECT TO A REVIEW BY THE DEPARTMENT OF PLANNING, BUILDING AND ZONING ONE YEAR FROM THE DATE OF THIS RESOLUTION, AND SUBSEQUENT REVIEW BY THE CITY COMMISSION ONLY IF THE DEPARTMENT OF PLANNING, BUILDING AND ZONING DETERMINES THAT A PROBLEM EXISTS. WHEREAS, the Miami Zoning Board at its meeting of June 20, 1994, Item No. 1, duly adopted Resolution No. ZB 51-94 by a four to three (4-3) vote, constituting a denial of a variance, as hereinafter set forth; and WHEREAS, the applicant has taken an appeal to the City Commission from the denial of the variance; and WHEREAS, the City Commission after careful consideration of this matter, and notwithstanding the decision of the Zoning Board, finds that there are peculiar circumstances affecting this iiv �:', TCeN�t N' Sl {CITY Cor4XrsSION laETITIG OF JUL 2 F N94 ftomlution No. ,.94 595 parcel of land and that practicable difficulties and unnecessary hardships do exist which would impair the owner's right to a reasonable use of the property without the grant of a variance as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. In 1991, the center provided 19,304 visits to 8,928 medical and 2,038 dental patients. While the majority of patients are adults between the ages of 20-64 years, 32% of these patients are Black, 44.4% Hispanic, and 23.6% white, non —Hispanic. More than 39% are children under the age of 15, and 4.8% are adolescents. Coconut Grove Family Health Center operates one of the few teen pregnancy prevention programs in Dade County. Staffed with an experienced, sympathetic social worker, the program successfuly uses peer support groups to encourage teens to avoid pregnancy. TERMS AND AGREEMENT: Permittee is authorized to use parking spaces numbered 27-44 and 339-355 at the Douglas Road Metrorail Station Parking Lot. Uses other than as stated herein shall require the County's written consent. Metro -Dade Transit Agency (MDTA) does not warrant that Metrorail patrons will not, at times, use some of the above referenced parking spaces. The term of this Permit shall be for a one year period, commencing upon execution of Permit Agreement. Rental fee shall be Four hundred Thirty Dollars ($430.00) per month, to be paid in advance, without billing, due on the first day of each calendar month during the term of the Permit Agreement. Payment of rental fee for the first and last months of the Agreement, or any extension thereof, shall be prorated in accordance with the number of days this Agreement is in effect that month. The rent shall be made by check payable to the Metro -Dade Transit Agency Controller's Division - Accounts Receivable, P.O. Box 610791, Miami, Florida 33101-0791. 2. TERMINATION: The County, through the MDTA Director, may revoke this Permit at any time. Permitee may revoke this Permit by giving (30) days written notice to the County of its intention to do so. 3. RENEWAL: The County, through the MDTA Director, shall have the option to renew this Permit for consecutive one (1) year periods under_ the same terms, conditions, and provisions established herein, provided it is not then in default. The MDTA Director further reserves the option, upon written request by Permittee, to increase or decrease the quantity of parking spaces. In the event that additional parking spaces are added or subtracted during the term of this Permit, or any extension thereof, the monthly rental_ payment will be adjusted proportionately. 4. ASSIGNMENT: Permittee shall not assign this Permit Agreement. 5. LAWS, REGULATIONS, AND PERMITS: Permittee shall comply with all applicable statutes, ordinances, rules, orders, regulations, and requirements of the Federal, State, County,•or Municipal Governments. Permittee shall provide proof of compliance with all applicable required licenses, permits, and other legal requirements prior to execution of this Permit Agreement. 9 4 -- 595 6. INDEMNIFICATION: Permittee shall indemnify and hold the County harmless from and against all claims, liability, losses, and causes of action, costs and damages to persons or property which may arise out of the fulfillment of this Permit Agreement. SECURITY: It is expressly understood that Permittee is solely responsible for the personal safety of its employees, invitees, or any other persons entering the Permit Area in connection with this Permit, as well as any and all equipment and/or personal property installed or brought into the Permit Area. Additionally, ere met with Metro Bade County Transit Authority to secure a permit to utilize a maximum of 44 spaces in the surface parking lot directly across the street from the facility, end received a permit for parking on an annual basis to be re-newed each year. With these agreements, we are able to successfully supply 70 off street parking spaces to serve our project. We are faced vtith a hardship in the location that we are in due to the lack of available adjacent contiguous land for the development of additional off-street parking. The site is bounded by SV 37th Avenue to the East, Peacock Avenue to the South, Ski 37th W,4i to the Vest and Bird Road to the forth. The site is located in a C-2 commercial zone with commercial uses bordering the site on all sides. The site is uniquely located geographically in the City of Miami. Its strategic location to US 1, and adjacency to The Coral Gables Metro Rail Station ties it to major bus and jitney routes alloying for public access to Transportation for Patients as well as Employees. Coconut Grove Family health Center, Inc. is a "riot for Profit" Health Care Facility which serves all of Coconut Grove, South Miami, adjacent Miami neighborhoods, and the eastern most sectors of Coral Gables.
