THE DECISION OF THE ZONING BOARD AND GRANTING
A VARIANCE FROM ORDINANCE NO. 11000, AS
AMENDED, THE ZONING ORDINANCE OF THE CITY OF
MIAMI, FLORIDA, ARTICLE 4, SECTION 401,
SCHEDULE OF DISTRICT REGULATIONS, C-2 LIBERAL
COMMERCIAL, OFFSTREET PARKING REQUIREMENTS,
TO WAIVE FIFTY (50) OF SEVENTY SIX (76)
REQUIRED OFFSTREET PARKING SPACES FOR A
HEALTH CLINIC TO BE LOCATED AT 3090 SOUTHWEST
37TH AVENUE, MIAMI, FLORIDA, (MORE

FILE; SUBJECT TO A TIME LIMITATION OF TWELVE
(12) MONTHS IN WHICH A BUILDING PERMIT MUST
BE OBTAINED, AND FURTHER SUBJECT TO A REVIEW
BY THE DEPARTMENT OF PLANNING, BUILDING AND
ZONING ONE YEAR FROM THE DATE OF THIS
RESOLUTION, AND SUBSEQUENT REVIEW BY THE CITY
COMMISSION ONLY IF THE DEPARTMENT OF
PLANNING, BUILDING AND ZONING DETERMINES THAT
A PROBLEM EXISTS.
WHEREAS, the Miami Zoning Board at its meeting of June 20,
1994, Item No. 1, duly adopted Resolution No. ZB 51-94 by a four
to three (4-3) vote, constituting a denial of a variance, as
hereinafter set forth; and
WHEREAS, the applicant has taken an appeal to the City
Commission from the denial of the variance; and
WHEREAS, the City Commission after careful consideration of
this matter, and notwithstanding the decision of the Zoning
Board, finds that there are peculiar circumstances affecting this

parcel of land and that practicable difficulties and unnecessary
hardships do exist which would impair the owner's right to a
reasonable use of the property without the grant of a variance as
hereinafter set forth;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The decision of the Miami Zoning Board to
deny the variance from Ordinance No. 11000, as amended, the
Zoning Ordinance of the City of Miami, Florida, Article 4,
Section 401, Schedule of District Regulations, C-2 Liberal
Commercial, Offstreet Parking Requirements, to waive fifty (50)
of seventy-six (76) required offstreet parking spaces for a
health clinic to be located at 3090 Southwest 37th Avenue, Miami,
Florida, (more particularly described on Exhibit "A" attached
hereto and made a part hereof); zoned C-2 Liberal Commercial per
plans on file, subject to a time limitation of twelve (12) months
in which a building permit must be obtained and further subject
to a review by the Department of Planning, Building and Zoning
one year from the date of this Resolution, and subsequent review
by the City Commission only if the Department of Planning,

The center has served the Grove surrounding City of Miami community since
1970. In 1991, the center provided 19,304 visits to 8,928 medical and
2,038 dental patients. While the majority of patients are adults between
the ages of 20-64 years, 32% of these patients are Black, 44.4% Hispanic,
and 23.6% white, non —Hispanic. More than 39% are children under the age
of 15, and 4.8% are adolescents.
Coconut Grove Family Health Center operates one of the few teen pregnancy
prevention programs in Dade County. Staffed with an experienced, sympathetic
social worker, the program successfuly uses peer support groups to encourage
teens to avoid pregnancy.
In addition to basic health service (general medicine, OB/GYN, pediatrics,
dental) the Grove center offers special programs for vision and hearing
screening, Women —Infant —Children (WIC) nutrition support, sexually
transmitted diseases, and HIV/AIDS care.

Services are provided by a team of family practice, internal medicine,
pediatric, and OB/GYN physicians with support from registered nurse
practitioners, nurses, nutritionists, health technicians, social workers,
and radiologists, pathologists, pharmacists, and health educators. The
teams are as multifaced as patient need requires. CGFHC. provide basic
health services. We also offer specialty care such as dental, dermatology,
immunology, audiology, ophthalmology, and even cardiology care when
neighborhood need warrants.
The Coconut Grove Family Health Center provides a "one —stop shopping" that
fosters patient satisfaction and compliance. In doing, the center reaches
a broader patient base and ultimately enhances community health.

PERMIT AGREEMENT

1.
TERMS AND AGREEMENT: Permittee is authorized to use
parking spaces numbered 27-44 and 339-355 at the Douglas
Road Metrorail Station Parking Lot. Uses other than as
stated herein shall require the County's written consent.
Metro -Dade Transit Agency (MDTA) does not warrant that
Metrorail patrons will not, at times, use some of the above
referenced parking spaces. The term of this Permit shall
be for a one year period, commencing upon execution of
Permit Agreement. Rental fee shall be Four hundred Thirty
Dollars ($430.00) per month, to be paid in advance, without
billing, due on the first day of each calendar month during
the term of the Permit Agreement. Payment of rental fee
for the first and last months of the Agreement, or any
extension thereof, shall be prorated in accordance with the
number of days this Agreement is in effect that month. The
rent shall be made by check payable to the Metro -Dade
Transit Agency Controller's Division - Accounts Receivable,
P.O. Box 610791, Miami, Florida 33101-0791.
2.
TERMINATION: The County, through the MDTA Director, may
revoke this Permit at any time. Permitee may revoke this
Permit by giving (30) days written notice to the County of
its intention to do so.
3.
RENEWAL: The County, through the MDTA Director, shall have
the option to renew this Permit for consecutive one (1)
year periods under_ the same terms, conditions, and
provisions established herein, provided it is not then in
default. The MDTA Director further reserves the option,
upon written request by Permittee, to increase or decrease
the quantity of parking spaces. In the event that
additional parking spaces are added or subtracted during
the term of this Permit, or any extension thereof, the
monthly rental_ payment will be adjusted proportionately.
4.
ASSIGNMENT: Permittee shall not assign this Permit
Agreement.
5.
LAWS, REGULATIONS, AND PERMITS: Permittee shall comply

regulations, and requirements of the Federal, State,
County,•or Municipal Governments. Permittee shall provide
proof of compliance with all applicable required licenses,
permits, and other legal requirements prior to execution of

INDEMNIFICATION: Permittee shall indemnify and hold the
County harmless from and against all claims, liability,
losses, and causes of action, costs and damages to persons
or property which may arise out of the fulfillment of this
Permit Agreement. Permittee shall pay all claims and

losses of any nature whatever in connection therewith
excepting only those due solely to the negligence of County
officers or employees, and shall defend all suits in the
name of the County when applicable, and shall pay all costs
and judgments which may issue thereon.
7. INSURANCE: Prior to commencement of this Permit Agreement,
the Permittee shall furnish to Metropolitan Dade County,
c\o MDTA Leasing Division, 111 NW First Street, Suite 910,
Miami, Florida 33142, Certificate(s) of Insurance which
indicate that insurance coverage has been obtained which
meets the requirements as outlined below:
Public Liability Insurance, on a comprehensive basis,
in an amount not less than $300,000 combined single
limit per occurrence for bodily injury and property
damage. Dade County must be shown as an additional
insured with respect to this coverage.
The insurance coverage required shall include those
classifications, as listed in standard liability insurance
manuals, which most nearly reflect the operations of the
Permittee.
Certificates will indicate no modification or change in
insurance shall be made without thirty (30) days written
advance notice to the certificate holder.
B. RIGHT OF ENTRY: The County, or any of its agents, shall
have the right to enter upon said premises during all
reasonable working hours to examine the same. Such entry
shall not unreasonably disturb the occupants thereof.
9. SECURITY: It is expressly understood that Permittee is
solely responsible for the personal safety of its
employees, invitees, or any other persons entering the
Permit Area in connection with this Permit, as well as any
and all equipment and/or personal property installed or
brought into the Permit Area. The County shall not in any
way assume responsibility for the personal safety of such
persons, equipment, or personal property in case of loss,
theft, damage, or any other type of casualty which may
occur. Any additional security desired by Permittee shall
be provided by Permittee at its sole cost and expense.
10. MAINTENANCE: Permittee, at its sole cost and expense shall
maintain the Permit Area in a clean and sightly condition
and shall not allow refuse or debris to accumulate.
11. SURRENDER AT EXPIRATION: Upon expiration or other
termination of this Permit, Permittee shall immediately
surrender possession of the Premises to County in

ANALYSIS There is no hardship to justify the requested variance to waive fifty (50) of seventy six (76)
required parking spaces for this health center use in an existing structure. Although the use
is compatible with the area and will be beneficial, the parking deficit could have an adverse
impact on the surrounding area. Since a portion of this proposal is new construction, it should

Acknowledging that we had a deficiency in the required parking we met with Mr. Clark
Cook of The City of Miami Department of Off Street Parking in regards to having
parking meters along the project perimeter deactivated and made available for use by
the Health Center. Additionally, ere met with Metro Bade County Transit Authority to
secure a permit to utilize a maximum of 44 spaces in the surface parking lot directly
across the street from the facility, end received a permit for parking on an annual
basis to be re-newed each year. With these agreements, we are able to successfully
supply 70 off street parking spaces to serve our project. We are faced vtith a hardship
in the location that we are in due to the lack of available adjacent contiguous land for
the development of additional off-street parking. The site is bounded by SV 37th
Avenue to the East, Peacock Avenue to the South, Ski 37th W,4i to the Vest and Bird
Road to the forth. The site is located in a C-2 commercial zone with commercial uses
bordering the site on all sides. The site is uniquely located geographically in the City of
Miami. Its strategic location to US 1, and adjacency to The Coral Gables Metro Rail
Station ties it to major bus and jitney routes alloying for public access to
Transportation for Patients as well as Employees. Coconut Grove Family health Center,
Inc. is a "riot for Profit" Health Care Facility which serves all of Coconut Grove, South
Miami, adjacent Miami neighborhoods, and the eastern most sectors of Coral Gables.
This facility serves a twVet population vithin a radius of five miles or more of it's
location. The canter serves black,ehite, end hispanic clients daily with a percentage of
earth ethnic group served at 41 % for Black patients 15% for Vhite patients, and 44% for

Hispanic patients. Specific servicu provide for Vomen and Went Care progra w,
Obstetrics and Gynecology, Pediatrics, BIVAADS a Dentistry program and Full service
lab, i-Rap and other psaient related activities. The Conter primarfly trees the poor,

and place it in as commercial area wheys, the impact will not be as severe. Vith the use
of the added spaces (presently under utilized) at the Metro Rail site, the impact related
to congestion will be less than is currently being experienced. The use will be very
compatible with its new neighborhood and surroundings in the commerciaally zoned
area.

building used for manufacturing. The existing parking lot does not
have enough area to provide offstreet parking. This petition is to
request that 50 of the required 76 spaces be allowed to be offsite.

There is ample parking space in the Douglas Road Metrorail Station.
There are many more than 50 spaces at the'northern end of the station
which are rarely used and would be ideal for use by the health center
patients as they are immediately adjacent to the proposed main entrance.
There is also parking available in front of the health center which is
not used for parking at all presently.
(a) The variance, if granted, is the minimum variance that will make possible the

There is plentiful offsite parking adjacent to the site.
Without that offsite parking an important use for the community,
a family health center, could not be built.

There is also parking available in front of the health center which is
not used for parking at all presently.
(e) The variance, if granted, is the minimum variance that will make possible the
reasonable use of the land, building, or structure in that:
There is plentiful offsite parking adjacent to the site.
Without that offsite parking an important use for the community,
a family health center, could not be built.
