WHE on November 23, 1993, pursuant to Resolution
o. 491 amended on March 30, 1994, by Resolution

located adjacent to and immediately west of Miami Marine Stadium

"Property"), would best be accomplished by the ni

ancillary marine -related retail uses; and
WHEREAS, on January 27, 1994, pursuant to ution
No. 94-46, the City Commission authorized ua of
Request for Unified Development Proposal r a res an th
marine -related retail and recreation es Virginia y Basin,
selected a certified public accounting an po d members
of a review committee to evalu the pr als their duties
are prescribed by local law; and
WHEREAS, the Request f nif Development Proposals for
Virginia Key Basin w d o ebru 4, 1994, and contained
specific evaluatio riteria to b ed by the oertified public
accounting firm an he review lammittee; and
WHEREA un 1994,,F`;arsuant to the published date for
receipt a propos o posal (the "Proposal") was received
by the C Vir is Key Marine Group, Inc. (the "Proposed
Le�'"), in respo to the Request for Unified Development

EAS, e Proposed Lessee proposed to operate a boatyard,
nd marine -related retail facility on the Property,

WHEREAS, the certified public accounting firm rendered its
written report to the City Manager analyzing the Proposal based

proposed financial strategies, and assessed comparatively, 4
short and long-range economic and fiscal return to the C a
evaluated the economic feasibility of the proposed d opmex�

WHEREAS, the review committee received the es en on of
the Proposed Lessee and, after extensive ana s a se
of the Proposal, rendered a written repo o the Ci Manager
containing an evaluation of the Propo ba on the pecific
evaluation criteria in the Request for osa included
the experience of the devel m lud ng, without
limitation, experience on si ' r p ets, pability of the
development team, the Proposed see inanoial capability and
level of financial co the anc 1 return to the City,
overall project desi and exten f ority participation; and
WHEREAS, the Ci Manager, ter taking into consideration
the findings e c e lie accounting firm, those of
the evalu on o review committee, including personal
interv' s ed w the Proposed Lessee, is recommending
the ceptance o th oposal; and
WHE in accordance with the City's Unified Development
Pro proceW&outlined in Charter Section 29-A(c) and Code
Q
- .9, the City Manager has transmitted to the City
his recommendation including the written reports, from
ementioned certified public accounting firm and review
committee; and

i WHEREAS, inasmuch as only one proposal was received, th
City is prohibited from entering into a lease agreement wi he
Proposed Lessee unless the electorate at a referendum roves
such lease; and
WHEREAS, the City Commission finds that the osa in
the best interest of the public and direc hat pe
municipal election be held to allow the vot an opport ty to
approve or disapprove a lease agreement k th oposed ssee;
NOW, THEREFORE, BE IT RESOLVED BY THE ISS HE CITY
OF MIAMI, FLORIDA:
Section 1. The recit an ndings tained in the
Preamble to this Resolution ar ere adopted by reference
thereto and incorporat e in as fu1 y set forth in this
Section.
Section 2. In cordance h the provisions of the City
Charter (Cha 847, lorida, 1925, as amended), a
special mun ipal n is hereby called and directed to be
held the of ami, Florida, from 7:00 A.M. until
7:0 M. o Tu October 4, 1994, for the purpose of
'tti o the qualified electors of the City of Miami for
the' roval disapproval of the City Manager's authorization
exec ase agreement with Virginia Key Marine Group, Inc.
"Prop sed Lessee"), to operate a boatyard, restaurant, and
marine- elated retail facility on City -owned waterfront property
of approximately 5.41 acres located adjacent to and immediately
est of Miami Marine Stadium on the southerly shoreline of the
Marine Stadium Basin, Miami, Florida, more commonly known as the

"Virginia Key Boatyard Property", for a term of 20 years, subje
to City's receipt of minimum rent totaling $5,720,000 over sai
term, and Proposed Lessee making capital and pment
investments of $3,566,943, said lease being subj to
additional requirements, if any, as may be determined b ity

Section 3. Said special municipal tion sha e h d

This proposed referendum provides an opportunity
for the electorate to authorize a proposed lease of
City -owned property located adjacent to and immediately
west of Miami Marine Stadium on the southerly shoreline
of the Marine Stadium Basin, Miami, Florida, more
commonly known as the "Virginia Key Boatyard Property".

Due to procedural irregularities concerning the Request for
Proposals ("RFP") for a lease agreement for the boatyard,
restaurant, and marine -related retail facility proposed for the
"Virginia Key Boatyard Property", the proposed referendum calling
for a special municipal election on October 4, 1994 (Resolution
No. 94-588, adopted July 26, 1994), cannot, at this time, be
submitted to the electorate.
Resolution No. 94-588 is herewith submitted to you only to
complement your records and reflect the July 26th action of the
City Commission, however you are hereby advised that said
Resolution is not to -be transmitted to the Supervisor of
Elections of Metropolitan Dade County or advertised. in any
newspapers.
Legislation to rescind said Resolution and other appropriate
items, if necessary, will be prepared and submitted to the City
Manager for placement on the September 8, 1994 City Commission
Agenda.

and providing for a special municipal election to be held October 4, 1994, for the purpose of
submitting to the qualified electors of the City of Miami, Florida, for their approval or disapproval
of the City's entering Into a lease agreement with Virginia Key Marina Group, Inc. to operate a
boatyard, restaurant, and marine related retail facility on City -owned waterfront property of
approximately 5.41 acres located adjacent to and Immediately west of Miami Marine Stadium urn
the southerly shoreline of the Marine Stadium basin, Miami, Florida, more commonly known as
the "Virginia Key Boatyard property", subject to Virginia Key Marine Group, Inc. making a Capital
and Equipmont Investment of no lees than $3.6 million and paying to the City a minimum annual
rent of $470,660 per year for a term no longer than 20 years and sublet to such additional
requirements, if any, as may be detemnined by the City Commission-, deaignating and appointing
the City Clerk as the Official 11r:presentativ+e of tha City Commission with respect to the use of
voter registration books and records; further directing the City Clerk to cause a certified copy of
the herein Resolution to be delivered to the Supervisor of Elections of Metropolitan bade County,
Florida, not less than 46 days prior to the date of such municipal election.
The Department of Development & Housing Curiserwation recommends the approval of aitteiched
Resolution for tine purpose of placing the proposed lease agreement, between the City and
Virginia Key Marina Group, inc., for the votors' approval at the October 4, 1094 municipal
election.
On June 6, 1994, the Virginia Key Marine group, Inc. aubmitted a development proposal In
response to the City's unified development request for proposals, issued on February 4, 1994, for
the redevelopment of the City -owned waterfront property, generally known as the Virginia Key
Boatyard. The proposed development calls for a capital investment of $3.6 million and a
minimum annual rent payment of $286,000. Upon approval of the City Commission and Miami
voters, the City shall negotiate a lease agreement with the Virginia Key Marine Group, Inc. for the
Implementation of the proposed project.
