RESOLUTION NO. 9 4 - 582
A RESOLUTION RATIFYING, AFFIRMING, AND
CONFIRMING THE AWARD OF A CONTRACT BY THE
CITY MANAGER TO THE LOWEST RESPONSIBLE AND
RESPONSIVE BIDDER AND AUTHORIZING THE CITY
MANAGER TO PROCEED AS EXPEDITIOUSLY AS
POSSIBLE WITH THE CONSTRUCTION FOR THE
PROJECT ENTITLED "DOWNTOWN STREET
IMPROVEMENTS SIDEWALK REBUILDING - PHASE 2,
B-4578", SAID PROJECT TO BE COMPLETED PRIOR
TO THE SUMMIT OF THE AMERICAS HEMISPHERIC
CONFERENCE IN DECEMBER, 1994; ALLOCATING
FUNDS THEREFOR, IN AN AMOUNT NOT TO EXCEED
$592,000, FROM CAPITAL IMPROVEMENTS PROJECT
NO. 341135, AS APPROPRIATED BY ORDINANCE
NO. 11139; AUTHORIZING THE CITY MANAGER TO
EXECUTE THE NECESSARY DOCUMENT(S), IN A FORM
ACCEPTABLE TO THE CITY ATTORNEY, AS MAY BE
REQUIRED FOR SAID' PURPOSE; INSTRUCTING THE
CITY MANAGER TO ADVISE EACH COMMISSIONER OF
SAID AWARD, PURSUANT TO THIS RESOLUTION,
IMMEDIATELY FOLLOWING AWARD OF SAID BID.
WHEREAS, the Summit of the Americas Hemispheric Conference
will be held in Miami during December, 1994; and
WHEREAS, the State of Florida, Metropolitan Dade County and
the City of Miami are cooperating to expedite certain
improvements to our public rights -of -way before said Summit is
held; and
WHEREAS, the City of Miami plans to rebuild several sections
of sidewalk and curb and gutter in the downtown area pursuant to
the project entitled ."Downtown Street Improvements Sidewalk
Rebuilding - Phase 2, B-4578"; and

WHEREAS, receipt of bids by the City Clerk for said project
is scheduled for August 2, 1994; and
WHEREAS, there are no City Commission Meetings scheduled
during the month of August, and the project must be started as
soon as possible to assure completion by December;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The award of a contract by the City Manager
to the lowest responsible and responsive bidder is hereby
ratified, affirmed and confirmed, and the City Manager is hereby
authorized to proceed as expeditiously as possible with the
construction for the project entitled "Downtown Street
Improvements Sidewalk Rebuilding - Phase 2, B-4578", said project
to be completed prior to the Summit of the Americas Hemispheric
Conference in December, 1994, with said funds therefor, in an
amount not to exceed $592,000, hereby allocated from Capital
Improvement Project No. 341135, as appropriated by Ordinance
No. 11139.
Section 2. The City Manager is hereby authorized`/ to
execute the necessary dooument(s), in a form acceptable to the
City Attorney, as may be required for said purpose.
The herein authorization is further subject to compliance
with all requirements that may be imposed by the City
Attorney, including but not limited to those prescribed by
applicable City Charter and Code provisions.

Section 3. The City Manager is hereby instructed to
advise each Commissioner of said award, pursuant to this
Resolution, immediately following award of said bid.
Section 4. This Resolution shall become effective
immediately upon its adoption.

RECOMMENDATION
It is respectfully recommended that the City Commission authorize
the City Manager to award a contract for Downtown Street
Improvements - Sidewalk Rebuilding - Phase 2 B-4578 to expedite
completion of said improvements before the Summit of the Americas
in December, 1994.
BACKGROUND
The State of Florida, Metropolitan Dade County, and the City of
Miami are expediting certain street improvements in an attempt to
complete said improvements before the Summit of the Americas in
December, 1994. The City intends to construct improvements in
the downtown area in the project entitled "Downtown Street
Improvements - Sidewalk Rebuilding Phase 2. Bids for these
improvements will be received by the City Clerk on August 2,
1994.
In order for construction to commence in August, it is requested
that the City Commission authorize the City Manager to award a
contract to the lowest responsible and responsive bidder after
bids after bids are reviewed by the Department of Public Works,
and to authorize said low bidder to proceed as soon as possible
with the aforesaid improvements.
The City Commission will be notified in writing concerning the
successful bidder before construction commences.

The project consists of the removal and replacement of approximately 105,000 square
feet of concrete sidewalk and 15,000 linear feet of curb and gutter in the area
bordered by North 14 Street Biscayne Boulevard, the Miami River and N.W. 7 Avenue.
Construction includes the following; clearing and grading, pruning and removing tree
roots and limbs if necessary, constructing new concrete curb and gutter, constructing
new 4" and 6" concrete sidewalk, and flexible pavement restoration or construction.
Bidders will furnish a bid bond in accordance with Resolutions No. 86-983 and No. 87-
915. For clarification of technical issues as presented in documents and
specifications, please contact Leonard Helmers, P.E. Chief Civil Engineer, at (305)
579-6865. prospective bidders will be required to submit, with their bid, a copy of
the appropriate Certificate of C vUetency, as issued by Dade County,in accordance with
Chapter 10 of the metropolitan Dade County Code, which authorizes the bidder to
perform the proposed work.
All bids shall be sutmi.tted in accordance with the Instructions to Bidders and
Specifications. New City regulations will require each bidder to submit proposals in
duplicate originals. Plans and specifications may be obtained from the Office of the
Director of Public Works, 275 N.W. 2 Street, 3rd Floor, Miami, Florida, 33128, on or
after July 12, 1994. If bidders wish, a set of specifications will be mailed to them
by writing to the Department of Public Works and including a separate check for8.
There will be a �20 deposit required for the first set of specifications. Additional
sets may be purchased for a fee of $20 per set and this is not refundable. Deposits
will be refunded only upon the return of one set of specifications to the Department
of Public Works, unmarked and in good condition within two (2) weeks after the opening
of the bids.
Bidders are alerted to the provisions of Ordinances Nos. 10062 and 10538 regarding
allocation of contracts to minority vendors, contractors and subcontractors. All
bidders must submit an Affirmative Action Plan with their bids.
The City of Miami has adopted Ordinance No. 10032, which implements the "First Source
Hiring Agreement." The object of this ordinance is to provide employment
opportunities to City of Miami residents on contracts resulting in the creation of new
permanent jobs. Contractors may be eligible for wage reimbursement under this
program. For further information contact the Department of Public Works, City of
Miami, at (305) 579-6856.
Proposal includes the time of performance, and specifications contain provisions for
liquidated damages for failure to ccrnplete the work on time. The City Commission
reserves the right to waive any informality in any bid, and the City Manager may
reject any of all bids, and readvertise (B-4578, Req.2544).
