CITY OF MIAMI, CASE NO. 94-86; ALLOCATING FUNDS THEREFOR FROM THE CITY OF MIAMI`S SELF-INSURANCE AND INSURANCE TRUST FUND. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The engagement of Arthur England of the law firm of Greenberg, Traurig, in the amount of $20,000, for legal services for the Petition for Writ of Certiorari filed in the U.S. Supreme Court in the case of Bell, et al v. City of Miami, Case No. 94-86, is hereby authorized, with funds therefor hereby allocated from the City of Miami's Self -Insurance and Insurance Trust Funds. Section 2. This Resolution shall become effective immediately upon its adoption. As you will recall., on March 3, 1994, the Florida Supreme Court issued an opinion in City of Miami v. Bell, wherein the Court held that the City dial not have to pay retroactive pon,sion offset benefits to pensioners as a reautt of its earlier decision in Barra an v. Cif of ,Miami, 545 So. 2d 252 (Fla. 1989) . This favors opf'n%n save tie city approximately $5 million. I,Zanald Bell and the ten other claimant* whose caves were consolidated with Pell in the Supreme Court of Florida have filed a petition for writ of certiorari in the United States Supreme Court. They have asserted that their due process rights have been violated by virtue of the Supreme Court of Florida's decision.
