HomeMy WebLinkAboutR-94-0545RESOLUTION NO. 9 4 - 545 A RESOLUTION INCREASING THE COMPENSATION, IN AN AMOUNT NOT TO EXCEED $26,331, AND AUTHORIZING PAYMENT OF SAME TO THE LAW FIRM OF FINE, JACOBSON, SCHWARTZ, NASH, BLOCK & ENGLAND ("FINE JACOBSON") IN SATISFACTION OF SAID FIRM'S FINAL BILL FOR SERVICES RENDERED AS COUNSEL FOR THE CITY OF MIAMI BEFORE THE UNITED STATES BANKRUPTCY COURT, SOUTHERN DISTRICT OF FLORIDA, IN CONNECTION WITH THE CHAPTER 11 BANKRUPTCY PROCEEDINGS FILED BY MIAMI CENTER ASSOCIATES, LTD.; FURTHER AUTHORIZING THE ENGAGEMENT OF, AND PAYMENT TO, THE LAW FIRM OF' SEMET, LICKSTEIN, MORGAN, STERN, BERGER, FRIEND, BROOKE AND GORDON ("SEMET LICKSTEIN"), IN AN AMOUNT NOT TO f EXCEED $36,000, TO CONCLUDE REPRESENTATION OF THE CITY IN THE AFOREMENTIONED PROCEEDINGS; ALLOCATING FUNDS THEREFOR FROM THE CITY OF MIAMI'S SELF-INSURANCE AND INSURANCE TRUST FUNDS. WHEREAS, pursuant to Resolution No. 92--532, adopted September 10, 1992, the City Commission authorized the engagement and payment to the law firm of Fine Jacobson to serve as counsel in connection with the Chapter 11 bankruptcy proceedings filed by Miami Center Associates, Ltd. (MCA); and WHEREAS, pursuant to Resolution No. 93-420, adopted July 8, 1993, the City Commission authorized an increase in compensation to Fine Jacobson for the reasons described therein; and CITY COMMSSION ndEEMNG OF Resolution No. 94-- 545 WHEREAS, although Fine Jacobson reached the maximum levels of its authorized compensation, the firm continued to provide excellent services to the City pending authorization for additional funds by the City Commission; and WHEREAS, Fine Jacobson has been dissolved and submitted to the City its final invoice for legal fees in the sum of $26,331; and WHEREAS, the attorney at Fine Jacobson representing the City in these proceedings joined the law firm of Semet Lickstein, and in order to continue the representation of the City, the City Attorney authorized engagement of, and payments not to exceed $4,500, to the law firm of Semet Lickstein; and WHEREAS, Semet Lickstein has, through July 17, 1994, incurred legal fees in the sum of $21,000 and anticipates additional legal fees of $15,000 through completion of the representation; and WHEREAS, the representation of Semet Lickstein includes the bankruptcy case and a State Court action, both of which are anticipated to be dismissed as a result of the settlement recently approved by the City Commission; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. 94- 545 Section 2. An increase in compensation, in an amount not to exceed $26,331, and payment of same to the lave firm of Fine Jacobson in satisfaction of said firm's final bill for services rendered as counsel for the City of Miami before the United States Bankruptcy Court, Southern District of Florida, in connection with the Chapter 11 bankruptcy proceedings filed by Miami Center Associates, Ltd., are hereby authorized. Section 3. The engagement of the law farm of Semet Lickstein, and payment of fees to said firm, in an amount not to exceed $36,000, to conclude representation of the City in the aforementioned proceedings, are hereby authorized. Section 4. Funds for the hereinabove are hereby allocated from the City of Miami's Self -Insurance and Insurance Trust Funds. Section 5. This Resolution shall become effective immediately upon its adoption. PASSED AND ADOPTED this 26th day of July 1994.
