HomeMy WebLinkAboutR-94-0533J-94-513 7/5/94 RESOLUTION NO. 9 4` 533 A RESOLUTION AUTHORIZING AN INCREASE IN THE CONTRACT, IN AN AMOUNT NOT TO EXCEED $43,000.00, BETWEEN THE CITY OF MIAMI, FLORIDA AND HORIZON CONTRACTORS, INC., DATED JANUARY 13, 1994, FROM $64,555.42 TO $107,555.42 FOR THE PROJECT ENTITLED "OVERTOWN COMMUNITY DEVELOPMENT STREET IMPROVEMENT -PHASE ONE B-4553"; ALLOCATING FUNDS THEREFOR FROM PROJECT NO. 341181, AS APPROPRIATED BY CAPITAL IMPROVEMENT ORDINANCE NO. 11139; FURTHER RATIFYING THE CITY MANAGER'S WRITTEN FINDING THAT THE HEREIN INCREASE RESULTED FROM EMERGENCY CIRCUMSTANCES BY AN AFFIRMATIVE VOTE OF FOUR -FIFTHS OF THE MEMBERS OF THE CITY COMMISSION. WHEREAS, there exists a contract dated January 13, 1994, between the City of Miami, Florida, and Horizon Contractors, Inc., for construction of Overtown Community Development Street Improvement -Phase I, B-4553; and WHEREAS, the Director of Public Works, the Director for Community Development and the City Manager recommend the increase in said contract to cover the additional costs; and WHEREAS, the City Manager has made a written finding that a valid emergency existed for the work to continue to protect the health, safety and welfare of the citizens of the City; and WHEREAS, expenses in Capital Improvement Project No. 341181 were less than anticipated and sufficient funds are available for this increase; CITY F1e20}ution No. 94- 533 dm NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. After a properly advertised public hearing, the findings of the City Manager set forth in the Preamble to this Resolution are hereby ratified by an affirmative vote of four -fifths of the members of the City Commission, and are hereby incorporated by reference thereto and adopted herein as if fully set forth in this Section. Section 3. The contract between the City of Miami, Florida, and Horizon Contractors, Inc., dated January 13, 1994, for the project entitled "Overtown Community Development Street Improvement -Phase One B-4553", is hereby increased in an amount not to exceed $43,000.00, from $64,555.42 to $107,555.42, with funds therefor hereby allocated from Capital Improvement Project No. 341181, as appropriated by the 1993-94 Capital Improvement Ordinance No. 11139. REFERENCES Ce S y� V 1 O ENCLOSURES Cit lager Resolution REC01MENDATION It is respectfully recommended that the City Commission adopt the attached resolution authorizing an increase in the contract between Horizon Contractors, Inc. and the City of Miami for Overtown Community Development Street Improvement -Phase I, B- 4553, in the amount of $43,000.00: and further ratifying the City Manager's written finding that the increase resulted form emergency circumstances. BACKGROUND The Department of Public Works, in an effort to serve all residents of the City of Miami, has determined that it is now appropriate and in order for the City Commission to ratify the City Manager's decision to increase the contract dated January 13, 1994, between the City and Horizon Contractors, Inc., for construction of Overtown Community Development Street Improvement --Phase I, B-4553, in the amount of $43,000.00 for necessary extra work, and to ratify the City Manager's emergency finding that allowed the extra work to continue. The City Commission awarded a contract to Horizon Contractors, Inc., for the construction of Overtown Community Development Street Improvement• -Phase I, in the amount of $64,555.42 on January 13, 1994. Generally, the project consisted of constructing street improvements to N.W. Miami Court between N.W. 19 Street and N.W. 20 Street that included clearing and grading, construction of asphaltic pavement, concrete sidewalk, and curb and gutter and construction of storm drainage facilities. An alternate bid was received during bidding to extend the improvements one block to include the rebuilding of N.W. Miami Court from N.W. 18 Street to N.W. 19 Street, At the time of the award sufficient funds were not available for this work. Since that time Community Development funds have become available. 94- 533 �y_1 Honorable Mayor and Members of the City Commission Page 2 Underground and above ground utilities have been relocated on N.W. Miami Court. between 18 Street and 19 Street in preparation for or the rebuilding of this section of the project. The contractor is working on the base bid section, N.W. Miami Court between 19 Street and 20 Street. It is expedient for the safety and welfare of the surrounding; neighborhood to complete this work, and the additional Scope of Work was bid as an alternate, and since there are available funds for the work; that we allow Horizon Contractors, Inc. to proceed with the rebuilding of N.W. Miami Court, between 18, Street and 19 Street. The cost of the additional Scope of Work is $43,000.00 which includes repairs to an existing railroad crossing that has suffered severe deterioration. Expenses in Capital Improvement Project No. 341181 were less than anticipated, therefore, sufficient funds for the increase in contract for aforesaid additional work are available from monies already appropriated in the City's Capital Improvement Appropriation Ordinance 11139. 94- 533
