RESOLUTION NO. 9 4' 517
A RESOLUTION, WITH ATTACHMENTS, AUTHORIZING
AND DIRECTING THE CITY ATTORNEY TO INITIATE
CONDEMNATION PROCEEDINGS TO ACQUIRE FEE
SIMPLE TITLE TO REAL PROPERTY LOCATED AT 823
NORTHWEST 2ND AVENUE, 829 NORTHWEST 2ND
AVENUE, 833 NORTHWEST 2ND AVENUE, AND
841 NORTHWEST 2ND AVENUE, MIAMI, FLORIDA
(MORE PARTICULARLY DESCRIBED HEREIN);
DECLARING SAID ACQUISITION TO BE A PUBLIC
NECESSITY PURSUANT TO SECTION 163.330,
FLORIDA STATUTES, ENTITLED THE "COMMUNITY
REDEVELOPMENT ACT OF 1969" AND THE SOUTHEAST
OVERTOWN/PARK WEST REDEVELOPMENT PLAN;
FURTHER AUTHORIZING THE CITY ATTORNEY TO TAKE
ALL STEPS NECESSARY TO ACQUIRE SAID PROPERTY,
INCLUDING ENGAGING THE LAW FIRM OF WILLIAMS
AND CLYNE TO REPRESENT THE CITY OF MIAMI IN
SAID CONDEMNATION PROCEEDINGS, SAID
ACQUISITION SUBJECT TO RECEIPT OF FUNDS
THROUGH A FEDERAL URBAN INITIATIVES GRANT
FROM THE URBAN MASS TRANSIT ADMINISTRATION.
WHEREAS, in 1982, pursuant to Section 163.330, Florida
Statutes, entitled the "Community Redevelopment Act of 1969", the
City of Miami, Florida and Metropolitan Dade County established
the Southeast Overtown/Park West Community Redevelopment Project
(the "Project"); and
WHEREAS, the following property (the "Property"), as legally
described herein, is located within the Project area boundaries:

WHEREAS, based upon an appraisal report prepared by Luke A.
Ross, of Ralph Ross Real Estate Company, Inc. the City offered to
purchase the Property from its owners on or about June 24, 1993
and also offered to purchase the Property on or about June 6,
1994 (see Composite Attachment "A" ); and
WHEREAS, the owners of the property rejected the City's
offers (see Composite Attachment "B"); and
WHEREAS, the City is desirous of improving pedestrian access
to public amenities within the Project area; and
WHEREAS, the Property is needed to implement Phase II of the
Project and will be specifically used to develop an open space
public plaza connecting the 9th Street Pedestrian Mall with the
historic Lyric Theatre; and
WHEREAS, the Federal government through the Urban Mass
Transit Administration has earmarked a Federal Urban Initiatives
Grant for the acquisition of the Property; and

WHEREAS, pursuant to 163.375, Florida Statutes, the City has
the right to acquire by condemnation any interest in real
property, including a fee simple title thereto, which it deems
necessary for, or in connection with community redevelopment;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The City Attorney is hereby authorized and
directed to initiate condemnation proceedings to acquire fee
simple title to the following real property as legally described:
823 and 829 N.W. 2nd Avenue All of Lots 20, 21, and 28 of

Section 3. Pursuant to Section 163.330, Florida
Statutes, entitled the "Community Redevelopment Act of 1969" and
The Southeast Overtown/Park West Redevelopment Plan, the City
Commission hereby declares the acquisition of the subject

property to be necessary for the public purpose of developing an
open space public plaza connecting the 9th Street Pedestrian Mall
with the historic Lyric Theatre, thereby improving pedestrian
access to public amenities within the Southeast Overtown/Park
West Redevelopment Project area.
Section 4. The City is hereby further authorized to
engage the law firm of Williams and Clyne to represent the City
in the condemnation proceedings.
Section 5. The acquisition is hereby subject to receipt
of funds through a Federal Urban Initiatives Grant from the Urban
Mass Transit Administration.
Section 6. This Resolution shall become effective
immediately upon its adoption.

result of this undertaking, the City is desirous of purchasing
your property which is legally described as follows:

The acquisition is in accordance with Section 163.360, Florida
Statute titled Community Redevelopment Act of 1969.
Additionally, Metropolitan Dade County's Resolution No. R-39-81
permits the City to acquire land, in the community redevelopment
area, for commercial and residential redevelopment.
At the City's request, an appraisal report was prepared by Luke
A. Ross, of Ralph Ross Real Estate Company, Inc. Mr. Ross
determined the recommended fair market value for the
aforementioned property to be $130,927.
The City of Miami's offer to purchase this property is $130,927
pending Commission approval. If you are in agreement with the
City's purchase offer, please sign the bottom of this letter
where indicated, retain a copy for your records and return the
original to this office as soon as possible.
When your signed acceptance of the City's purchase offer is
received, a resolution will be prepared and presented to the
Miami City Commission for final approval of said acquisition.
Once Commission approval is received, an Agreement of Purchase

When your signed acceptance of the City's purchase offer is
received, a resolution will be prepared and presented to the
Miami City Commission for final approval of said acquisition.

This letter is to advise you that the offers made to purchase 823,
829 and 833 N.W. Second Avenue, Miami, Florida are hereby rejected.
We think you should give consideration to the fact that 801 N.W.
Second Avenue was purchased for around $21.56 per feet and the former
gas station owned by Mr. Sawyer had a serious pollution problem that
will cost a considerable amount of money to clear up. Plus the fact
there was the expense to tear it down and haul it away. Please also
consider the fact that 815 N.W. Second Avenue was purchased for around
$29.61 per foot which was also polluted from the gas station next to it.
Plus the fact there was the expense to tear down the building and haul
it.away. We therefore feel that our property is worth $36.50 per foot
based on the above sales that took place 3 to 4 years ago.

attached resolution authorizi,ig and directing the City Attorney
to irlitiaLe condemnation proccodingsa to acquire approximately
20,000 square feet of property at. the intersection Of NW 2nd
Avenue and NW 9th Street in the Overtown neighborhood for the
purpose of constructing a pedestrian plaza and public open
Space to link the 9th Street Pedestrian Mall to the Lyric;
Theater. The cost of acquisition aL $18 per equare foot of
approximately $350,000 will be funded through a $2,100,Onn
grant from the Pederal Department nf Transportation. The
balance of the Rands will be expended on the design and
construction of the 9th Street Mall between NW 3rd Avenue and
NW let Avenue.
BACKGROUND
The SE Uvertown/Park WewL Redevelopment Area Plan providers fr_
the cuat3Lruction of the 9th Street Pedestrian Mall between I 9
(NW .3rd Ave) and Biscayne Boulevard. The City of Miami,
compl.et-od construction of Phase I of the Mall between NW lot
Avenue and Miami. Avenue on July 28th of 1992 at a cost of
$2,200,000.
{ Metropolitan Dade county CuIlLacted the City of Miami in
November of 1993 to requeotr our participation in a Federal
Grant through tho Urban Initiat.iveR Project of the Urban Mass
Transportation Administration to construct the Overtown segment
of the Mall. On February 8th, 1994, the City Manager confirmed
by letter that the City would contribute $2u0, 000 in nldLching
funds from the Redevelopment Area Trust Fund and the right-of-
way along 9th SLreet to provide a 100 foot wide pedontrian mall
1 improvement provided the County Apoured the $2,100,000 grant to
