RESOLUTION NO.

A RESOLUTION AUTHORIZING THE CITY MANAGER TO
NEGOTIATE AND EXECUTE THE NECESSARY
DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY
ATTORNEY AND IN COMPLIANCE WITH APPLICABLE
CITY CHARTER AND CODE PROVISIONS, ACCEPTING A
DONATION PROFFERED BY RANSOM EVERGLADES
SCHOOL ("SCHOOL") TO MAKE CAPITAL
IMPROVEMENTS, IN AN ESTIMATED VALUE OF
$40,000, TO THE SOFTBALL FIELD AT VIRGINIA
KEY PARK; FURTHER PERMITTING THE SCHOOL
REGULAR USE OF SAID FACILITY UNTIL SUCH TIME
AS SAID RECREATIONAL FACILITY IS REDEVELOPED;
STIPULATING THAT: (1) IMPROVEMENTS ARE
SUBJECT TO AND CONTINGENT UPON LIMITATIONS
AND REQUIREMENTS AS MAY BE IMPOSED BY THE
CITY, (2) THE SCHOOL PROVIDES LIABILITY
INSURANCE IN AN AMOUNT PRESCRIBED BY THE CITY
MANAGER OR HIS DESIGNEE, (3) THE FACILITY
WILL REMAIN AVAILABLE TO THE PUBLIC.
WHEREAS, Ransom Everglades School (School) has requested the
regular use of the ball field at Virginia Key Park for the
practices and games of its softball and baseball teams; and
WHEREAS, the proposed period of use would span from
mid -August to mid -May weekday afternoons (approximately 3 to 6
p.m.), and alternate Saturday mornings, subject to availability,
and at all other times the ball field would remain available to
the general public; and

WHEREAS, in return for said use, the School has offered to
make substantial capital improvements to the subject recreational
facility in an estimated value of $40,000; and
WHEREAS, the School has also offered to provide security and
liability insurance for its use of the facility; and
WHEREAS, Virginia Key Park is to be the subject of a Unified
Development Project (UDP) in the immediate future, and the School
understands and agrees that the term of its use of the ball field
would be subject to 30-day revocation by the city and further
limited by the implementation of the UDP; and
WHEREAS, it is recommended that the City Manager, or
designee, negotiate remaining terms and conditions for this use,
and execute the necessary documents for this purpose;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are incorporated herein as if fully
set forth in this Section.
Section 2. The City Manager is hereby authorized-`/ to
negotiate and execute the necessary documents, in a form
acceptable to the City Attorney and in compliance with applicable
City Charter and Code provisions, accepting a donation proffered
by Ransom Everglades School (School) to make capital
improvements, in an estimated value of $40,000, to the softball

Attorney, including but not limited to those prescribed by
applicable City Charter and Code provisions.

field at Virginia Key Park and permitting the School regular use
of said facility until until such time as said recreational
facility is redeveloped.
Section 3. It is hereby stipulated that: (1) the
hereinabove improvements are subject to and contingent upon
limitations and requirements as may be imposed by the city, (2)
the School provides liability insurance in an amount prescribed
by the City Manager or his designee, (3) the facility will remain
available to the public.
Section 4. This Resolution shall become effective
immediately upon its adoption.

Dear Cesar,
Thank you for meeting with Evelyn Greer and I regarding the use of city facilities by the
Ransom Everglades School. A you suggested, we met with Terry Griffin and Dianne
Johnson. We discussed the possibility not only of the using Peacock Park for girl's fast
pitch softball but also Virginia Key for boy's baseball. Today we are meeting with Ana
Sardina of Asset Management to discuss the latter. As you now, we would like to be
using both facilities at the beginning of the school year, if possible. Thus, it is necessary
for us to move at a brisk pace.
At this time I would like to request a personal appearance before the City Commission
before the i•ece.ss to discuss the use of the Virginia Key site. My understanding is that
there are meetings July 14th and July 21 st. Both dates are convenient.
As you know, we will be gone until the end of June, but I will update you about the status
of the negotiations as soon as I get back.
