A RESOLUTION, WAIVING BY A 4/5THS AFFIRMATIVE
VOTE OF THE MEMBERS OF THE CITY COMMISSION,
FORMAL COMPETITIVE SEALED BIDDING PROCEDURES
FOR THE PROCUREMENT OF PAINTING SERVICES FOR
THE MIAMI SPRINGS GOLF COURSE CLUBHOUSE FROM
MANOLO HORTA PAINTING COMPANY; RATIFYING,
APPROVING AND CONFIRMING THE CITY MANAGER'S
FINDING THAT A VALID PUBLIC EMERGENCY EXISTS
JUSTIFYING SUCH WAIVER FOR SAID SERVICES;
ALLOCATING FUNDS THEREFOR IN A TOTAL AMOUNT
NOT TO EXCEED $13,500 FROM LOCATION NO. 45-
061, ACCOUNT NO. 417502-805102-340 ($600) AND
ACCOUNT NO. 311039-805101-340 ($12,900).
WHEREAS, the Miami Springs Golf Course Clubhouse recently
had its roof replaced which resulted in damage to the exterior
paint finish; and
WHEREAS, the diminished aesthetic value of the Clubhouse has
resulted in the cancelling of banquets and has prevented
potential clients from scheduling events resulting in a loss of

WHEREAS, in order to protect the health, safety and welfare
of the citizens of Miami, the City Manager found a valid public
emergency to exist justifying such waiver for said painting
services; and
WHEREAS, funds to cover the cost of said painting services
is available in a total amount not to exceed $13,500 from

OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. By a 4/5ths affirmative vote of the members
of the City Commission, after a duly advertised public hearing,
formal competitive sealed bidding procedures for the procurement
of painting services for the Miami Springs Golf Course Clubhouse
from Manolo Horta Painting Company is hereby waived, with funds
therefor hereby allocated in a total amount not to exceed $13,500
from Location No. 45-061, Account No. 417502-805102-340 ($600)
and Account No. 311039-805101-340 ($12,900).
Section 3. The City Manager's written finding that a
valid public emergency exists justifying such waiver for said
services is hereby ratified, approved and confirmed.
Section 4. This Resolution shall become effective
immediately upon its adoption.

RE: Emergency Painting at Miami Springs Golf Course
Gentelmen,
Please be advised as a resident of the City of Miami, a taxpayer in
the City, a vendor for the City, and as a member of the Cocoanut
Grove Village Council, I stongly object to waiving the formal
competitive bid process for painting the Miami Springs Golf Course
Clubhouse.
There is no emergency painting. The inter -office memorandum states
that during a roof replacement several months ago the paint finish
was damaged, and the asthetics of the Clubhouse was destroyed.
iThe length of time this has been known is not an emergency. Please
do not waive the competitive bid process and treat this as a normal
procurement.

It is respectfully recommended that the City Ccmission adopt the attached
Resolution , waiving by a 4/5ths affirmative vote of the members of the City
Commission, formal comrpetitive sealed bidding procedures for the procurement of
painting services for the Miami Springs Golf Course Clubhouse from Manolo Horta
Painting Company, a Hispanic vendor located within the limits of the City of
Miami; ratifying, approving and confirming the City Manager's finding that a
valid public emergency exists justifying such waiver for said services;
allocating funds therefor in a total amount not to exceed $13,500 from Location
No. 45-061, Account No. 417502-805102-340 ($600) and Account No. 311039-805101-
340 ($12,900).

The Office of Asset Management and Capital Improvements has prepared the
attached item for consideration by the Commission. The Miami Springs Golf
Course Clubhouse was in dire need of repainting on the exterior portion of the
premises. During a roof replacement a few months ago, the exterior paint finish
was damaged. Tar dripped from the roof destroying the aesthetics of the
Clubhouse.
As a consequence, the use of the facility has diminished resulting in a revenue
loss to the City. Banquets scheduled at the Clubhouse have cancelled and the
continued unattractiveness has prevented potential clients from scheduling
events at the Clubhouse.
Due to the demand for painting in the City in order to prepare the pools for the
summer, City staff was unavailable to perform this work. In an effort to
minimize revenue loss, it was determined to be in the best interest of the City
to procure these services on an emergency basis.
Informal quotes were solicited from three potential vendors. One vendor, Best
Property Services, chose not to bid on the project. The lowest vendor, whose
primary office is located outside the limits of the City, was Reyes and Son's
Painting Co., Inc. in the amount of $13,500. Manolo Horta Painting Company, a
vendor located within the City of Miami, bid in the amount of $14,500. In
accordance with City policy, since the bid of Manolo Horta Painting was within
10% of the lowest bid, they were offered and accepted the contract at the low
bid amount of $13,500.

The Miami Springs Golf Course Clubhouse is in dire need of

Due to excessive demand for painting in the City at this time, City
staff is not available to perform this work. Therefore, it is
recommended that you approve the emergency purchase of painting
services for the repainting of the Clubhouse in order to prevent
additional revenue loss.
We have requested informal. bids from three vendors; one of the
vendors, Best Property Services, chose not to bid on the project,
The two bids received were from Reyes and Son's Painting Co., Inc.,
a Dade County vendor, in the amount of $13,500 and from Manolo
Horta Painting Co., a Miami vendor, in the amount of $14,500. In
accordance with City policy, since Manolo Horta Painting is a Miami
vendor and within 1.0% of the lowest bid, they were asked and agreed
to do the work for the same amount as the lowest d, $13,500.

A public hearing will be held by the City Commission of the City
of Miami, Florida on July 14, 1994, at in the City
Commission Chambers at City Hall, 3500 Pan American Drive, Miami,
Florida, for the purpose of hearing any objections by the City
Commission from any interested parties affected by the City
Manager's action in waiving formal competitive sealed bid
requirements for the emergency procurement of painting services
for the Miami Springs Golf Course Clubhouse from Manolo Horta
Painting Company, in the amount of $13,500.
All interested persons are invited to appear and may be heard
concerning this item. Should any person desire to appeal any
decision of the City Commission with respect to any matter
considered at this hearing,• that person shall ensure that a
verbatim record of the proceedings is made, including all
testimony and evidence upon which any appeal may be based.
