HomeMy WebLinkAboutR-94-0495J-94-537 7/14/94 RESOLUTION NO. 9 4— 495 A RESOLUTION CONDITIONALLY RESCINDING RESOLUTION NO. 79-807, ADOPTED NOVEMBER 26, 1979, THER.= PROVIDING FOR THE REOPENING OF THAT PORTION OF JEFFERSON STREET SITUATED BETWEEN THE SOUTH RIGHT OF WAY LINE OF WASIM'GTON AVENUE AND THE NORTH RIGHT OF WAY LINE OF CHARLES AVENUE (A PRIVATE ROAD) , FOR A DISTANCE OF 377.39', SAID RESCISSION CONTINGENT UPON ALL COSTS CONCERNING SA:LD REOPENING BEING PROVIDED BY THE DADE COUNTY SCHOOL BOARD. WHEREAS, on November 26, 1979, the City Commission adopted Resolution No. 79-807 which vacated and. closed Jefferson Street between Washington and. Charles Avenues in conjunction with Tentative Plat No. 980 - Grand Avenue Park Amended.; and WHEREAS, said tentative plat was not approved by the City Commission and was not officially recorded in the records of Dade County, Florida; and WHEREAS, the Department of Public Works has determined that it is now in the best interest of the health, safety and welfaxe of the residents of the City of Miami to reopen Jefferson Street between Washington and Charles Avenues; and WHEREAS, the City Manager has recommended that costs for said reopening be provided by the Dade County School Board; NOW, THMUT ORE , BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI , FLORIDA: Section 1. The recitals ard findings gs contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Resolution No. 79-807, adopted November 26, 1979, whereby Jefferson Street between Washington and Charles Avenues were vacated and closed, is hereby conditionally rescinded and that portion of Jefferson of Street situated between the South Right/Way line of Washington Avenue and the North Right of Way line of Charles Avenue (a private road), for a distance of 377.39' is hereby reopened, said rescission contingent upon a1.1 costs concerning said reopening being provided by the Dade County School Board. Section 3. This Resolution shall become effective immediately upon its adoption. PASSED AND ADOPTED this 14th day of July 1994. Honorable Mayor and Members DATE JUL 1994 FILE of the City Commission SUBJECT Resolution Rescinding Resolution 79-807 FROM Ces d I o REFERENCES C I t ager ENCLOSURES Reso I ut Ion RECOMMENDATION It is respectfully recommended that the City Commission adopt the attached resolution rescinding Resolution No. 79-807 which closed and vacated Jefferson Street between Washington and Charles A.,enues. On November 26, 1979 City of Miami Commission adopted Resolution No. 79-807 authorizing the closure of Jefferson Street between Washington and Charles Avenues. This closure was Intended to support Tentative plat #980 - Grand Avenue Park Amended which has not been completed or officially recorded. In order to allow a safer and more efficient traffic pattern for school buses travelling to and from Francis Tucker Elementary School the reopening of Jefferson Street is recommended. This request is supported by the Lola B. Walker Homeowners Association and the Dade County School Board. Design and construction activities required for the physical reopening will be funded by the School Board and subject to approval by the Department of Public Works.
