A RESOLUTION AUTHORIZING THE CITY MANAGER TO ISSUE AN INVITATION FOR BIDS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR THE SALE OF THE CIT:'-OWNED PROPERTY LOCATED AT 5500 NORTHWEST 17'PH AVENUE, MIAMI, FLORIDA, MORE PARTICULARLY DESCRIBED AS LOT 24, BLOCK 13, FLORA PARK ACCORDING TO THE PLAT THEREOF, RECORDED IN PLAT BOOK 5, PAGE 53 OF THE PUBLIC RECORDS OF DADE COUNTY, FLORIDA, SUBJECT TO APPLICABLE CITY CHARTER AND CODE PROVISIONS. WHEREAS, on May 27, 1993, the City Commission adopted Resolution No. 93-356 authorizing the City Manager to bid an amount not to exceed $79,000 at public sale for the property located at 5500 Northwest 17 Avenue, Miami, Florida; and WHEREAS, Resolution No. 93-356 further directed the City Manager to develop a plan for the effective utilization of the property; and WHEREAS, on June 17, 1993, at a judicial sale held by the Clerk of the County Court regarding Tiller Investment Company, Inc. vs. Billy Hardemon, et alp the City of Miami purchased the above described property; and WHEREAS, on February 17, 1994, the City Commission determined that an effective utilization of the property would not be feasible and deemed it in the best interest of the residents of the City of Miami for the City to divest its interest in the property; and WHEREAS, the City Commission instructed the City Manager to issue an Invitation for Bids for the sale of said property; 57Zn -u no*<e 1116on 1No, 94- 487 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The City Manager is hereby authorized11 to issue an Invitation for Bids, in a form acceptable to the City Attorney, for the sale of the City -owned property located at 5500 Northwest 17 Avenue, Miami, Florida, more particularly described as Lot 24, Block 13, Flora Park according to the Plat thereof, recorded in the Plat Book 5, Page 53 of the Public Records of Dade County, Florida, subject to applicable City Charter and Code provisions. REFERENCES ENCLOSURES JUL - 5 1994 FILE Resolution Authorizing an Issuance of Invitation to Bid for the Sale of Surplus Property It is respectfully recommended that the City Commission adopt the attached Resolution, with attachments, authorizing the City Manager to issue an Invitation for Bids for the sale of the city -owned property located at 5500 NW 17 Avenue, Miami, Florida, more particularly described as Lot 24, Block 13, Flora Park according to the Plat thereof, recorded in Plat Book 5, Page 53 of the Public Records of Dade County, Florida, subject to applicable City Charter and Code provisions. BACKGROUND: On May 27, 1993, the City Commission adopted Resolution No. 93-356 authorizing the City Manager to bid an amount not to exceed $79,000 at public sale for the above listed property. This resolution further directed the City Manager to develop a plan for the effective utilization of the property. On June 17, 1993, at a judicial sale held by the Clerk of the County Court regarding Tiller Investment Company, Inc. vs. Billy Hardemon, et al the City of Miami purchased the above described property. During its meeting of February 17, 1994, the City Commission determined that an effective utilization of the property would not be feasible and deemed it in the best interest of the residents of the City for the City to divest its interest in the property. In accordance with Section 18-80 of the city Code, two appraisals were sought for this property with the highest appraised value being $32,000. This property was offered to Metropolitan Dade County and the Dade County School Board at its appraised value. Neither party has expressed an interest in acquiring this property. Invitation to Bid documents may be obtained from the Office of Asset Management & Capital Improvements, 300 Biscayne Boulevard Way, Suite 400, Miami, Florida 33131. Each Bidder will be required to submit a good -faith deposit of three thousand two hundred dollars and zero cents ($3,200.00). Non -Successful Bidders will have their deposits refunded in full. The deposit submitted by Successful Bidder will be credited towards the purchase price after payment of the City's cost of conducting this competition. Prospective Bidders are alerted to the provisions of Ordinance No. 10062 - Minority/Women Business Affairs & Procurement Ordinance and Ordinance No. 3.0032 which implements the "First Source Hiring Agreement". Odio City Manager 94- 487 DESCRIPTION The City of Miami, through the Office of Asset Management & Capital Improvements, is soliciting bids for the sale of the property located at, 5500 N.W. 17 Avenue (the "Property"), Miami Florida, more particularly described as Tot 24, Block 13, Flora Park, according to the Plat thereof, recorded in Plat Book 5, Page 53 of the Public Records of Dade County, Florida, pursuant to Resolution No. _ , passed and adopted on The Property is a one (1) story building comprised of approximately 2,104 square feet occupying 5,250 square feet of City owned land. The Property is zoned C-1 Restricted Commercial. No Purchase and Sale Agreement is being required by the City of Miami as a condition to this purchase. If purchaser submits a Purchase and Sale Agreement, it may be rejected by the City of Miami. The conveyance that may be awarded to the successful bidder will be by statutory form warranty deed as prescribed by 689.02, Florida Statute. The warranty will except the following: (1] conditions, limitations, restrictions and easements of record; [2] zoning and other governmental regulations; [3] special assessments for 1994 and subsequent years; [4] the property and its contents is sold "as is." No representations or warranties whatsoever as to the condition of the property or its contents are made. Express warranties implied warranties of fitness for a particular purpose and habitability are hereby disclaimed. Prospective bidders are alerted that any purchase and sale agreement which is negotiated pursuant to this Invitation to Bid will be in accordance with the provisions of said sections. Qualifications: Prospective Bidders shall have no record of pending lawsuits or criminal activities and shall not have conflicts of interest which may be of embarrassment to the City of Miami. This latter qualification may be satisfied by submission of a notarized affidavit to this effect with the proposal submission. The information submitted will be subject to confirmation. One Bid: Only one Bid from an individual, firm, partnership, corporation or joint venture will be considered in response to this Invitation to Bid. If it is found that a Bidder is interested in more than one bid, all bids in which such a Bidder is interested will be rejected. In the event that there is a discrepancy between the price written in words and the price written in figures, the former shall govern. Rejection of Bid: The right is reserved by the City of Miami to waive any irregularities in any bid, to reject any or all bids, or to readvertise for bids, if desired. In making such j determination, the City's consideration shall include, but not be limited to, the requirements as described in the REQUIREMENTS section. i Withdrawal of Bid: Any bid may be withdrawn prior to the final time for receipt, as scheduled in the Public Notice, provided however that after the final time for receipt any bid withdrawn will forfeit its security deposit which will become the property of the City and the bidder waives all claims with respect thereto. The City will provide- no direct or indirect financing for the acquisition of this property. i G r Z_6 94- 487 i Interpretation of Bid Documents: Each Bidder shall thoroughly examine the Bid Documents and judge for him/herself all matters relating to the location and character of the services he/she agrees to perform. If the Bidder should be of the opinion that the meaning of any part of the Bid Documents is doubtful, or obscure, or contains errors or omissions, he/she is invited to request clarification from the Office of Asset Management & Capital Improvements, prior to submission of his/her bid. Acceptance and Award: After evaluating the bids, a sale shall be considered, in accordance with provisions of Section 18.80 of the City of Miami. Code. Successful Bidder will receive an official letter from the City of Miami notifying him/her of t'e acceptance of this bid and awarding him/her the privilege o2. executing a Purchase Agreement to be prepared by the City. Any bid which is incomplete, conditional, obscure or which contains irregularities of any kind, may be cause for rejection of the bid at the sole discretion of the City. In the event of default of Successful Bidder, or his/her refusal to enter into a purchase agreement with the City of Miami, the City reserves the right to accept the bid of any other Bidder or readvertise using the same or revised documentation, at its sole discretion. 9 4 - 487 IV REQUIREMENTS Successful Bidder will be requiredto submit fully executed, the Declaration form included in the Invitation to Bid documents. Successful Bidder will be required_to submit a fully executed Bid Form which is included in this package. Successful. Bidder will. be recquir.ed to submit a narrative in support or explanation of the Bidder's financial resources available for the acquisition of the Property as well as indicate the method of payment, accompanied by any relevant documentation, i.e, letters, financial statements, etc. (Please attach this narrative to the Ieclaration Form and mark it "Exhibit A") Successful Bidder will be required to pay all costs, including but not limited to appraisals, surveys and advertising expenses incurred by the City in the process of this Invitation to Bid. The City reserves the right to require in any contract document such terms and conditions as he deems necessary for the proper protection of the City of Miami. The City reserves the right to require submission of the following documents: a) Personal Financial Statement b) Personal History Form c) Personal/Corporate Income Tax Report for last two years d) Corporate Balance Sheet less than ninety days old e) Current Business Income and Expense Statement The City reserves the right to require submission of a background check on all employees working for Successful Bidder.
