A RESOLUTION RESCINDING RESOLUTION
NO. 94-277, ADOPTED APRIL 14, 1994, WHEREBY
THE BID OF J.C.I. INTERNATIONAL, INC., WAS
ACCEPTED FOR THE PROJECT ENTITLED "CITYWIDE
SIDEWALK REPLACEMENT PHASE V B-4558" (THE
"PROJECT"); AUTHORIZING THE CITY MANAGER TO
NULLIFY THE CONTRACT BETWEEN THE CITY OF
MIAMI AND J.C.I. INTERNATIONAL, INC., FOR
SAID PROJECT BY REJECTING ALL BIDS RECEIVED
BY THE CITY IN CONNECTION WITH SAID PROJECT;
FURTHER, DIRECTING THE CITY MANAGER TO SEEK
NEW BIDS BASED ON SUCI•I SPECIFICATIONS AS HE
DEEMS APPROPRIATE AND TO BRING BACK SAID BIDS
TO THE CITY COMMISSION FOR REVIEW AND
APPROVAL.
WHEREAS, sealed bids were received October 7, 1993, for the
project entitled "CITYWIDE SIDEWALK REPLACEMENT PHASE V B-4558"
(the "Project"); and
WHEREAS, on April 14, 1994, the City Commission adopted
Resolution No. 94-277 accepting the bid of J.C.T. International,
Inc. and authorizing the City Manager to execute a contract with
said firm for the Project; and
WHEREAS, during the review process of this contract it was
determined that J.C.I. International, Inc. did not retain a valid
Certificate of Competency or State Contractor's Certificate of
Registration in the appropriate trade required for this work,
issued by the appropriate agency of Metropolitan Dade County, as
a prerequisite to the submission of their bid, as required by the
Instructions to Bidders; and

WHEREAS, the City Manager has determined that it is in the
best interest of the City of Miami that all bids received for the
Project, Bid No. 92-93-168, be rejected and the Project
readvertised;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings set forth in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. Resolution No. 94-277, adopted on April 14, 1994,
whereby the bid of J.C.I, International Inc., was accepted for
the project entitled "CITYWIDE SIDEWALK REPLACEMENT PHASE V
B-4558" (the "Project"), is hereby rescinded, and the City
Manager is hereby authorized to nullify the contract between the
City of Miami and J.C.I. International, Inc. for said Project.
Section 3. All bids received by the City of Miami in
connection with said Project are hereby rejected.
Section 4. The City Manager is hereby directed to seek new
bids based on such specifications as he deems appropriate and to
bring back said bids to the City Commission for review and
approval.

Section 5. This Resolution shall beoome effeotive
immediately upon its adoption.

RECOMMENDATION:
It Is respectfully recommended that the City Commission adopt the
attached resolution rescinding Resolution No. 94-277 and
authorizing the City Manager to nullify the contract between the
City of Miami and J.C.I. Internatlonai, Inc. for the Citywide
Sidewalk Replacement, B-4558. This project will be readvertlsed
at a later date.
BACKGROUND:
On October 7, 1998 at 11:00 a.m. the Clerk of the City of MIamI
received and publicly open and read sealed bids for "Cltywlde
Sidewalk Replacement Project Phase V B-4558". J.C.I.
Internatlonai, Inc. submitted the Iowest bid and, based on the
proposal and corporate documentation submitted with the bidding
package, the City Commission adopted Resolution No. 94-277 an
April 14, 1994 accepting the bid submitted by that firm and
authorizing the City Manager to execute a contract, in a form
acceptable to the City Attorney, with J.C.I. International, Inc.
During the processing of their contract, it was determined that
J.C.I. International, Inc. did not retain a valid Certificate of
Competency or State Contractor's Certificate of Registration in
the appropriate trade required for the work (In this case a Dade
County General Contractor or Engin gyring Contractors license)
issued by the appropriate agency of Metropolitan Dade County as a
prerequisite to the submission of their project as required by
the Instructions to Bidders.
Due to this failure to meet the proper license requirement, It is
respectfully recommended that the City Commission adopt the
attached resolution rescinding awarding Resolution No. 94-277 and
authorizing the City Manager to nullify the contract between the
City and J,C.I. International, Inc. for Cltywlde Sidewalk
Replacement Project Phase V B-4558.
Because 8 months have elapsed since receipt of bids for this
project, It Is in the best Interest o.f the City to reject all
bids received for this project and direct the Public Works
Department to readvertise the Cltywlde Sidewalk Replacement
Project Phase V B-4558.
