A RESOLUTION, WITH ATTACHMENT(S), AMENDING
RESOLUTION NO. 93-226, ADOPTED APRIL 15,
1993, WHEREBY THE CITY AUTHORIZED THE CITY
MANAGER TO EXECUTE MEMORANDUMS OF AGREEMENT
BETWEEN THE CITY OF MIAMI, AND SEVERAL
MUNICIPALITIES FOR PURPOSES OF CREATING AN
URBAN SEARCH AND RESCUE TASK FORCE, THEREBY
AUTHORIZING THE CITY MANAGER TO EXECUTE A
MEMORANDUM(S) OF AGREEMENT WITH THE VILLAGE
OF KEY BISCAYNE AND ANY OTHER LOCAL
GOVERNMENTS, APPROVED BY THE FIRE CHIEF AND
THE CITY MANAGER, AS PARTICIPANTS IN SAID
TASK FORCE.
WHEREAS, Resolution No. 93-226, adopted April 15, 1993
authorized the City Manager to execute a Memorandum of Agreement
between the City of Miami and several local municipalities,
specifically, the cities of Coral Gables, Hialeah, and Miami
Beach, for the purpose of creating an Urban Search and Rescue
Task Force (the USAR); and
WHEREAS, the Village of Key Biscayne desires to participate
in the USAR Task Force also; and
WHEREAS, it is anticipated that in addition to the
aforementioned municipalities, other local governments will
request to participate in the USAR Task Force;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:

Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. Section 2 of Resolution No. 93-226 is hereby
amended in the following particulars: V

Federal sources.
The herein authorization is further subject to
compliance with all requirements that may be
imposed by the City Attorney, including but not
limited to those prescribed by applicable City
Charter and Code provisions."
Section 3. This Resolution shall become effective
immediately upon its adoption.
Underscored words and/or figures shall be added. The
remaining provisions are now in effect and remain unchanged.

MEMORANDUM OF 1
FOR. PARTICIPATTW ORGANIZATIONS
This Agreement entered into this __ day of _ , 1994, by and
between the City of Miami, a municipal corporation of the State of Florida,
(the City), and the Village of Key Biscayne, a municipal corporation of the
State of Florida, (the Participating Organization).

This Agreement delineate responsibilities and procedures for Urban Search and
Rescue (US&R) activities under the authority of "The Robert T. Stafford
Disaster Relief and Emergency Act," Public Law 93-288, as amended, 42 U.S.C.
S5121, et seq. and .relevant state authorities, or when otherwise properly
directed. This Agreement, (the "MOA") contains all the relevant text of a
similar MOA entered into between FEMA, the State, and the City. It is
included herein so that the Participating Organization is aware of the
obligations each party has to each other that may impact the Participating
Organization.
II . SODPE
The provisions of this MOA apply only to US&R Task Force activities performed
at the request of the Federal government according to the Federal Response
Plan (for Public Law 93-288, as amended), which may be provided at the option
of the City, the State, and the Participating Organization and .uz conjunction
with, or in preparation of, a Presidential declaration of a disaster or
emergency and upon activation as outlined below in section V. PROCEDURES.
Details concerning specific working relationships on various projects may be
appended to this MGA as they are developed.

A. Activation: the formal request by FEMA to a Sponsoring
Jurisdiction, via procedures outlined in section V. PROCEDURES, to
mobilize and respond. utilizing their task force. The Task Force
is to arrive at a designated point -of -departure within six (6)
hours of being activated.
B. Alert: the formal notification by FEMA to a Sponsoring
Jurisdiction, via procedures outlined in section V. PROCEDURES,
that an event has occurred or is projected to occur, and that the
Task Forces might be activated. Sponsoring Jurisdictions, placed
on alert by FEMA, should initiate activities which enhance their
capability to respond to a pending activation.
C. Associate Director: the Associate Director for the State and
Local Programs and Support Directorate, FEMA.
D. Departmr nt of Defense ([?PD_1j the DOD, to include the military and
civilian components. DOD is the primary agent for coordinating
US&R efforts under Emergency Support Function (ESF) #9, US&R, of
the Federal Response Plan.

E. Director: the Director of the Federal Emergency Management
Agency.
F. Disaster _Assista_n_ce Emplo_yee_jDAE- a temporary Federal employee,
hired under the provisions of the Robert T. Stafford Disaster
Relief Act
G. Disaster_' Medical. Assistance Team (DMAT) _ a functional unit
activated under the NDMS which provides austere medical care in a
disaster area or medical services at transfer points and reception
sites associated with patient evacuation.
H. Emergency Information and Coordination_Center EICC�_ a control
center located within FEMA headquarters in Washington, DC, which
provide inter -agency coordi-nation of assistance to emergency or
disaster areas.

J. Federal Response_ Plan_ the Federal Response Plan (for Public Law
93-288, as amended), establishes the basis for the provision of
Federal assistance to a State and its affected local governments
impacted by a catastrophic or significant disaster or emergency
which results in a requirement for Federal response assistance.
The Plan outlines the planning assumptions, policies, concept of
operations, organizational structures and specific assignments of
responsibility to the 27 Federal agencies and departments, grouped
into Emergency Support Functions (ESF), who will provide
coordinated response assistance to supplement State and local
response efforts.
K. FEMA: the Federal Emergency Management Agency.
L. Hard Match: FEMA's process of matching a Sponsoring
Jurisdictions cash expenditure with a cash reimbursement at a
predetermined ratio.
M. Incident Commander: the individual in charge of coordinating
response activities within a disaster site. Under normal
circumstances this individual will be an emergency manager from
the local cci munity responsible for incident activities including
the development and implementation of strategic decisions, and who
approves the request and allocation of resources.

N. National Disaster. Medical_§ystem (NDMS): a cooperative effort of
the Department of Health and Human Services (HHS), Department of
Defense (DQD), Department of Veteran Affairs (VA), FEMA, and State
and local governments and the private sector designed to care for
a large number of casualties resulting from either a domestic
disaster or an overseas war. The Public Health Service (PHS)
heads the program.
0. Nat io_nal Emergency Coordinat ing_ Center -NECCN_ a twenty four (24)
hour primary notification center located in Berryville VA.
P. Part icipating__Organization: a public, private, or individual
entity who has entered into an agreement with the Sponsoring
Jurisdiction to provide support (personnel, equipment, services or
funding) for the establishment of an US&R Task Force.
Q. Soft Match: FEMA-s process of matching any type of expenditure by
Sponsoring Jurisdiction with a cash reimbursement at a
predetermined ratio.
R. censoring Jurisdiction: the City of Miami, a municipal
corporation of the State of Florida; a public entity providing
official sanction to a FEMA-endorsed US&R Task Force. The City of
Miami Fire Department will be the administrating agency of the
US&R Task Force for the City.
S. State: the State of Florida. The Division of Emergency
Management will be the administrating agency of the US&R Task
Force for the State.
T. Task Force: a tactical component of the Federal Response Plan,
under ESF #9 - Urban Search and Rescue, ccaposed of 56 persons
divided into functional elements of search, rescue, medical,
technical support and management (refer to the FEMA US&R Response
System Manual).
U. Task Force Leader: a Sponsoring Jurisdictions representative
responsible for team training, equipment, mobilization and
tactical direction of the Task Force.
V. Urban Search and Rescue (US&R): the terse used to define the
strategy, tactics and operations for locating, providing medical
stabilization and treatment, and extrication of entrapped victims
encountered in natural and man-made disasters.
IV. RESPCNSIBIIa=
A. FD% agrees to:
1. Provide coordination, when appropriate, between the City, the
local public agency in who's jurisdiction the City's Task
Force has been sent, the State, and other relevant
governmental and private parties.
2. Provide limited funding and technical support for equipment
and training specifically aimed at preparing the City's Task
Force to be a fully operational Task Force as described in
FEMA's US&R Response System Manual (the US&R Manual). FEMA
will also provide assistance to the City in obtaining supplies
aria equipment f_r_am Federal and donor souzces for training and
use in disaster situations.
3. Provide full reimbursement of all costs incurred by the Task
Force, its Participating Organizations, and its Task Force
members as outlined in section VI. FINANCIAL AGREEMENT'S.
4. Provide document control at the Regional office ensuring that
all reports are directed to FEMA Headquarters, Federal
Response Division, SL-OE-FR-OP, Attn: US&R.
B. The State agrees to:
1. Maintain twenty four (24) hour alert capabilities, including a
point -of -contact or duty officer available at all times.
2. Implen-ent FED's alert and activation procedure by contacting
the City whenever called upon to do so by FEMA.
3. 'Provide limited funding, administrative, and technical support
for equipment, training, and staffing specifically aimed at
preparing the Task Force to be a fully operational Task Force,
as described in the US&R Manual.
4. Provide document control at the State office ensuring that all
reports are directed to their respective FEMA. Regional Point
of Contact.
C. Under Sport Function #91, of the Federal Response Plan,
DOD agrees to:
1. Provide all transportation of the Task Force between point -of -
departure, disaster sites and return to point -of -departure.
2. Provide logistical, maintenance, and other support to deployed
US&R Task Forces.
3. Coordinate the replacement and/or rehabilitation of expended,
damaged, lost, or destroyed Task Force equipment and supplies
used in the course of operations.
D. The City agrees to:
1. Provide an administrating agency, which will be the City of
Miami Fire Department, authorized to carry out the herein
agreed upon responsibilities of the City.
2. Recruit and organize an US&R Task Force, filling the positions
to the best of their ability according to the criteria and
guidelines described in the US&R Manual.

3. Register and qualify all medical personnel on the Task Force
through The U.S. Public Health Services (the "PHS"), as a
specialized DMAT. The City will enter into a separate NOU
with the PHS, the terms of which will be appended to this
Merprandwm as "Attachment B" when completed.
4. Provide training, with limited support and guidance from the
State and FEMA, to Task Force timbers. Training will be
consistent with the objectives of developing, upgrading, and
renewing skills as needed to meet and maintain qualifications
for the particular positions on the Task Force according to
the criteria and guidelines described in US&R Manual.
5. Maintain twenty four (24) hour Task Force alert capabilities,
including a 24-hour phone number and point -of -contact or duty
officer available at all times.
6. Develop, implement, and practice a Task Force personnel call -
out and equipment mobilization procedure with the objective of
being fully mobilized at a pre -designated point--of-departure
within six hours from time of activation as outlined in
section V. PROCEDURES.
7. Provide administrative, financial, and personnel management as
they relate to the Task Force. All original paperwork will be
filed with the City with copies, as outlined in section VIII.
REPORTING REQUIREMEMIfl S, sent via the State of FEMA, Federal
Response Division, SL-OE-FR-OP, Attn: US&R.
B. Develop, maintain and provide accountability for US&R-specific
equipment purchased with matching funds from FEMA.
9. Provide personnel and equipment for US&R-related training
exercises, as agreed upon with FEMA and the State, subject to
availability of such Task Force personnel and equipment which
will be based upon State and local requirements and priorities
at the time such personnel and equipment are needed. Requests
for City participation in sanctioned training will be provided
to the City in writing.
10. Employ its best efforts to pursue funding for Task Force
equipment and training. However, the City shall not incur any
liability for failure to secure funding for this project.
11. Maintain task force equipment in a state of readiness and
available for use by a Participating Organization on an
emergency basis, as agreed upon, and spelled out in the Task
Force Standard Operating Procedure.

E. The Participating Organization agrees to (fill in the appropriate
blanks and circle all items that apply):
1. Participate in the development of the US&R Task Force by
providing one or more of the following:
a. Representation on one or more of the following
committees:
b. one or more of the following US&R-related training
resources:
- instructors:
- training props and materials;
- facilities (training tower, classroom, meeting room;
drill grounds;)
other
2. Place on Loan US&R-related equipment and/or supplies, as
described in the US&R Manual, for the development of a
standing US&R Equipment Cache. Loaned equipment and supplies
shall be listed and identified on forms provided by the City.
3. Provide funds in the amount of , to be matched by
FEMA for the purchase of US&R-related equipment needed by the
Task Force for the development of a standing US&R Equipment
Cache as described in the US&R Manual.
4. Provide US&R related equipment and/or supplies, as described
in the US&R Manual, for mobilization and response within six
hours to a FEMA and/or State activation. Provided equipment
and supplies shall be listed and identified on forms provided
by the City.
5. Recruit and assist in staffing Task Force positions (at a
ratio of 3:1), according to criteria and guidelines described
in the US&R Manual. Provide and update the names and
personal background information of participating personnel on
forms provided by the City.
6. Register and qualify, through PHS as specialized DMAT
members, all participating medical personnel provided to the
Task Force. This includes a separate MDU with the PITS.
7. Provide and/or make personnel available as manpower permits
for US&R-related training which is contiguous with the
objectives of developing, upgrading, and renewing skills as
needed to maintain qualifications for the particular
positions on the Task Force according to the criteria and
guidelines described in the US&R Manual.

8. Implement and practice an internal Task Force personnel call -
out and equipment mobilization procedure, as developed with
the City, with the objective of being fully mobilized at a
pre --designated point -of -departure within six hours from the
time of official activation.
9. Maintain twenty four (24) hour Task Force member alert
capabilities, and provide to the City a 24-hour emergency
phone number and point--of--contact or duty officer available
at all times.
10. Provide administrative, financial, personnel management as
they relate to the Participating Organizations Task Force
Personnel and equipment. All original paperwork will be
filed with the Participating Organization with copies, as
outlined in section VIII. REPORTING REQUIREMENTS, provided
to the City.
11. Develop, maintain, and provide accountability for US&R
specific equipment purchased with matching funds from FEMA
through the City.
12. Provide the agreed upon personnel and equipment for US&R
related training exercises, subject to the availability of
such Task Force personnel and equipment which will be based
upon local requirements and priorities at the time such
personnel and equipment are needed.
F. The City and the Participating organization agree:
1. That funding acquired and identified for the purchase of Task
Force equipment and Task Force mad)er training will be
administered solely by the Sponsoring Jurisdiction.
2. That funding pursued and acquired in the name of the three
Participating Organizations (Coral Gables, Hialeah, and Miami
Beach) and the Sponsoring Jurisdiction, for task force
equipment purchases, will be to the benefit of the four
organizations.
3. In the event the four organizations agree in writing to
dissolve and disband the US&R Task Force, the Task Force
equipment will be appraised within 60 days, by a mutually
agreed upon appraiser, and a dollar value shall be placed on
each individual piece of equipment.
4. If the task force is dissolved, the equipment, as identified
in the Task Force equipment inventory, will be made available
for distribution to the four organizations based on the total
number of uniform firefighters represented on their
respective departments payroll at the time of signing of this
MDA.

5. The organizations will recieve equipment based on the
following percentages:
Department Manpower. Percentage
Miami 635 54%
Coral Gables 140 12%
Miami Beach 164 14%
Hialeah 236 20%
Total 1175 100%
6. If a participating organization withdraws their partcipation,
as provided for in the MOA, prior to a complete and agreed
upon dissolution of the US&R Task Force by all of the
Participating Organizations, their percentage will be
forfeited to the remaining organizations (sponsoring and
participating).
A. Alert & :Activation
1. Upon request from State governments for Federal disaster
assistance, or determination by FEMA that pre -positioning
US&R Task Forces is prudent, FEMA ,:.tall request the
activation of forces necessary to respond to the emergency or
disaster situation. Alert notifications can be initiated
independently by FEMA.
2. Alert and/or Activation notices shall be ccmm icated by the
EICC or NECC, through the appropriate State Emergency
Management Office, to the City-s pre -designated twenty four
(24) hour emergency point -of -contact.
3. Upon notification from the State of the Task Force s
activation, the City shall inform the State within a
reasonable time whether or not they will be responding to the
request, and if responding they shall activate their Task
Force via their pre -established and practiced personnel call -
out and equipment mobilization procedures.
B. Mobilization, Deployment, and Redeployment
1. The City shall mobilize and deploy their Task Force personnel
and equipment to the pre -designated point -of -departure for
pickup by DOD aircraft within six hours of official
activation.
2. Upon arrival at the mobilization center, DOD will provide an
on -ground briefing, maps, food and housing (as necessary),
and other items essential to the immediate deployment and
operation of the Task Force. DOD will supply a liaison
officer and a radio operator to each Task Force deployed to a
disaster site.

3. ROD shall provide transportation to and from the mobilization
center and the disaster site.
4. The US&R Task Force will operate within the guidelines and
constraints outlined in the US&R Manual.
5. Upon completion of the US&R mission, the Task Force shall be
redeployed to their original point -of -departure by DOD.
C . Managarent
I. Under Emergency Support Function (ESF) #9 - Urban Search and
Rescue, of the Federal Response Plan, D0D has the overall
management responsibilities of the Task Forces from their
activation to arrival at a declared disaster area, and from
deactivation until their return to their original point -of -
departure.
2. Tactical employment of US&R Task Forces will be passed frcm
DOD to the local or on -site Incident Commander within the
disaster area.
A. Future funding for training and equipment will be allocated as
determined by FEMA.
B. From the time of activation by FEMA until the Task Force is
returned to a state of readiness within the city, the City and
its Participating Organizations shall be fully compensated in
accordance with the current employee pay schedules, benefits,
and policies set forth by the City and its Participating
Organizations and/or State, as determined by the parties, and
agreed to by the Federal government. (See attaclamnt "A" for
current hourly rates of Task Force personnel pay schedules and
benefits.)
C. Any reasonable expense incurred by the City and the
Participating Organizations in filling a Task Force member's
position while the Task Force member has been activated, will
be paid for by FEMA. FEMA will reimburse the Partcipating
Organization (through the Sponsoring ,jurisdiction) and the
Sponsoring Jurisdiction, the normal and usual rates of pay and
back fill costs (excluding personnel costs associated with the
members of the medical team) accrued as a result of activation
of the task force by FEMA. MIA will not pay personnel costs
above the normal and usual rate for that position. It is
expressly agreed and understood by FEMA, the State, and the
City that such personnel.. costs reasonably include differential
overtime compensation if the organization is required to pay
such compensation costs in filling positions deemed critical
for public safety and well being.

D. Any, reasonable expense incurred by the City and its
Participating Organizations for the purpose of mobilizing the
Task Force in response to a Federal activation and/or alert and
denobilizing (returning the Task Force to a state of readiness
within the City) shall be paid for. by FEMA.
E. Medical Team personnel shall be registered as a Disaster
Medical Assistance 'ILam nK-�nk--r_s under the guidelines of the PHS
"National Disaster Medical. System." (See attachment "B" - PHS
MW). All medical team personnel, including employees of the
Sponsoring Jurisdiction, are subject to the pay schedule and
Federal benefits established through the National Disaster
Medical System. FEMA continues to work with the PHS to
establish more equitable pay schedules for medical team
personnel.
F. Task Force members shall. be reimbursed for travel and per diem
costs in accordance with Federal travel regulations, unless
otherwise authorized.
G. Task Force members shall be reimbursed for reasonable personal
costs of operations and maintenance incurred in conjunction
with disaster operations.
H. Task Force organizational materials, equipment, and supplies
consumed while providing requested assistance shall be
reimbursed to the City on a replacement basis. Replacement
and/or rehabilitation requests shall be submitted to DOD prior
to demobilization.
I. Rehabilitation or replacement costs of non -expendable
operational equipment will be reimbursed if the piece of
equipment was used at a disaster site or on disaster exercises,
as authorized by FEMA. FEMA will consider_ on a case -by -case
basis the replacement of lost or stolen equipment, provided the
equipment was not lost or stolen as a result of negligence on
the part of the Task Force or its personnel.
J. No Task Force or any individual Task Force member_ shall be
reimbursed by FEND for costs incurred by activations outside
the scope of this MOA.
K. The city shall act as central agent for the submission of all
reimbursement claims to FEMA via the State, and the
disbursement of all compensations from FEMA regarding all FEMA-
sanctioned Task Force Activities.

L. All, equipment purchased under this MOA will become the property
of the City, unless it was received in the name of the
Sponsoring Jurisdiction and Participating Organizations
jointly. It will then be jointly owned and distributed if the
Task.Force is dissolved under the terms and conditions outlined
in Section IV (F) hereof. Equipment purchased and supplied by
a Participating Organization is the property of that
organization on loan to the Task Force. The equipment supplied
by the Participating Organization may be withdrawn from use by
the Task Force upon advance written notice.
M. A11 financial conmitments herein are made subject to the
availability of funds and the continued mutual agreements of
the parties.
N. With the exception of medical team personnel, those individuals
who are not employees of the Sponsoring Jurisdiction will be
either brought onto the Sponsoring Jurisdiction or the State s
payrolls as contingent employees for purposes fo consolidated
billing. If the State or the Sponsoring Jurisdiction cannot
accomplish this, FEMA will register these individuals as
federal employees in conjunction with the National US&R
Program.
A. Under Section 305 of the Stafford Act, Task Force members and
their employing agencies, performing a function under the
authority of PL 93-288, as amended, are not liable for any
claim based upon the exercise or performance of or the failure
to exercise or perform that function.
B. Task Force
members, to
include the task force
leaders, search,
rescue and
technical
teams are considered Federal employees
when activated. Task
force members will remain employed by
their respective sponsoring or participating
organization for
salary and
assessments
of other benefits; but
upon activation,
they will
become Federal employees for the
tort liability
purposes of
the Federal
Tort Claims Act.
C. Task Force members engaged in activities outlined in terms of
this MQA will be afforded the same protection [under the
Federal Tort claims act and the Federal Employees' Compensation
Act (FECA)] against personal liability, death, or injury as are
regular Federal employees for actions taken within the scope of
their Federal employment. Federal benefit payments made in
reference to this section will be paid to the City or its
participating organizations to offset the obligations paid to
their injured/dead personnel and their beneficiaries.

A. The City will submit quarterly financial statements and
activity reports to the state, to be forwarded to the FEMA
Regional Office, then to FEMA Headquarters, in accordance with
instructions provided by the State.
B. The City will submit in writing to the State all. personnel
changes as they relate to the composition of the Task Force.
This includes information of personnel training and
qualification upgrades. As new members are admitted to
position on the Task Force the relevant portions of the
qualifications list will also be submitted to the State. The
State in turn will forward this information to the FIM
Regional Office who will then forward the information to FEMA
Headquarters.
C. A copy of the PHS MX will be submitted by the City via the
State to FEMA, Federal ResponEe Division, SL.-OE-FR-OP, Attn:
US&R.
D. Verification of the Task Force member credentials, as they
relate to the criteria outlined in the US&R Manual, will be
submitted by the City to FEMA via the State on an annual basis
and at other times as requested by 11 MA.

A. This MOA will end on December 31, 1995, at which time all
parties may agree to renew the association. Renewal will be
based on evaluation of the City's ability to conform with
procedures, training and equipment standards as described in
the US&R Manual.
B. This Memorandum may be modified or amended only on written
agreement of all parties, and all amendments will be attached
hereto. This MQA may be terminated by any party upon thirty
(30) days written notice.
C. FEMA complies with the provisions of Executive Order 11246 of
September 24, 1965, as amended; and with the rules, regulations
and relevant orders of the Secretary of Labor which prohibits
discriminate against any employee or applicant for employment
on the grounds of race, color, religion, sex, or national
origin. In addition, use of Federal facilities, supplies and
services will be in compliance with regulations prohibiting
duplication of benefits and guaranteeing nondiscrimination.
Distribution of supplies, processing of applications, provision
of technical assistance and other relief and assistance
activities shall be accomplished in an equitable and impartial
mariner without discrimination on the grounds of race, color,
religion, nationality, sex, age, or economic status.

RECOMMENDATION:
It is respectfully recommended that the City Commission adopt the
attached Resolution amending Resolution No. 93-226, adopted April
15, 1993, authorizing the City Manager to execute an agreement
with the Village of Key Biscayne , as well as other
municipalities or units of local government which may request to
participate in the local Urban Search and Rescue (USAF'.) Task
Force, as determined by the Fire Chief and the City Manager.
BACYCROUND:
The Dc.:)artment of Fire --Rescue has been approached by the Village
of Key Biscayne with request to participate in the development of
the Urban Search and Rescue Task Force. With the potential for
further catastrophic events the City Manager and the Fire Chief
have determined that there is a demonstrated need for specialized
USAR capabilities and enhancement of overall disaster
preparedness in Dade County by the inclusion of the Village of
Key Biscayne in the development and support of the USAR Task
Force.
The Agreement will provide the necessary guidelines to coordinate
the Task Force and will become part of and an attachment to the
agreement entered into between the City, the State and FEMA.
There are no anticipated costs associated with the execution of
this document.
