RESOLUTION NO. 9 4 — 8
A RESOLUTION, WITH ATTACHMENTS, ACCEPTING THE
DONATION OF VACANT REAL PROPERTY LOCATED AT
1405 NORTHWEST 61 STREET, MIAMI, FLORIDA,
MORE PARTICULARLY AND LEGALLY DESCRIBED IN
EXHIBITS "A" AND "B" ATTACHED HERETO, TO BE
USED FOR THE EXPANSION OF AFRICAN SQUARE
PARK, SUBJECT TO EXAMINATION AND APPROVAL OF
THE ABSTRACT AND THE OPINION OF TITLE FOR THE
SUBJECT PROPERTY BY THE CITY ATTORNEY;
ALLOCATING FUNDS IN AN AMOUNT NOT TO EXCEED
$12,000 FROM THE COMMUNITY DEVELOPMENT BLOCK
GRANT FUNDS, PROJECT NUMBER 331053, INDEX
CODE 589101-270, FOR PAYMENT OF UNPAID LIENS,
RECORDING FEES, TITLE INSURANCE AND RELATED
COSTS ASSOCIATED WITH THE ACCEPTANCE OF THIS
DONATION.
WHEREAS, the owner of the property located at 1405 NW 61
Street, Miami, Florida (the "Property"), more particularly
described as Lots 27 and 28, Block 10, Orange Heights, as
recorded in Plat Book 14, Page 62 of the Public Records of Dade
County, Florida, is desirous of donating the Property to the City
of Miami; and
WHEREAS, the City Commission finds it in the best interest
of the citizens of Miami to accept the donation of the Property
for the expansion of African Square Park, for the purpose of
facilitating the provision of security and programmatic
activities at the park; and

WHEREAS, 1993-94 Capital Improvement Ordinance No. 11139, as
amended, adopted on April 14, 1994, Capital Project No. 331053 of
said Ordinance, appropriated sufficient monies for African Square
Park which may be used for payment of unpaid liens, recording
fees, title insurance and related costs associated with the
acceptance of this donation;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The donation of the vacant real property located
at 1405 Northwest 61 Street, Miami, Florida, more particularly
described in Exhibits "A" and "B" attached hereto, is hereby
accepted, subject to examination and approval of the abstract and
confirmation of an opinion of title for the subject property by
the City Attorney.
Section 3. The City Manager is authorized to expend an
amount not to exceed $12,000 of Nineteenth Year Community
Development Block Grant funds, Project No. 331053, Account No.
589101-270, which exists as an available balance previously
authorized by the City Commission for African Square Park, for
payment of unpaid liens, recording fees, title insurance and
related costs associated with the acceptance of this donation.

Section 4. This Resolution shall become erreczive
immediately upon its adoption.

Resolution Accepting
Donation of Property
It is respectfully recommended that the City Commission adopt the
attached resolution accepting the donation of vacant real property
located at 1405 NW 61 Street, Miami, Florida, to be used for
expansion of African Square Park, subject to examination and
approval of the abstract and the opinion of title for the subject
property by the City Attorney; allocating funds in an amount not to
exceed $12,000 from the Community Development Grant Funds, Project
No. 331053, Index Code 589101-270, for payment of unpaid liens,
recording fees, title insurance and related costs associated with
the acceptance of this donation.
BACKGROUND:
The Office of Asset Management and Capital Improvements has
prepared the attached legislation for consideration by the City
Commission. The owner of the property located at 1405 NW 61
Street, Miami, Florida, is desirous of donating this property to
the City of Miami. This property will be a great asset to African
Square Park and will facilitate in providing security and
programmatic activities at the park.
The Commission previously appropriated funds for African Square
Park which may be used for payment of unpaid liens, recording fees,
title insurance and related costs associated with the acceptance of
this donation. At this time there exists approximately $31,400 in
outstanding certificates on this property. A major portion of this
amount is associated with demolition and lot clearing liens held by
the City. Upon acceptance of the warranty deed for this property,
the City will waive the amounts due for the certificates held by
' the City and the City will pay all remaining certificates held by
third parties in order to obtain clear title to the property.
