Q 4 5 1 A RESOLUTION AUTHORIZING FINAL PAYMENT TO THE LAW OFFICES OF FINE, JACOBSON, SCHWARTZ, NASH, BLOCK AND ENGLAND ("FINE JACOBSON"), IN THE AMOUNT OF $171,199.5.1 FOR SERVING AS COUNSEL FOR THE CITY OF MIAMI BEFORE THE UNITED STATES DISTRICT COURT, IN CONNECTION WITH THE CASE OF PERRY L. ANDERSON, JR. VS. CITY OF MIAMI, JORGE L. FERNANDEZ, AND A. QUINN JONES, III, CASE NO. 92-0435-CIV- GRAHAM; ALLOCATING FUNDS THEREFOR FROM THE CITY OF MIAMI. ' S SELF --INSURANCE AND INSURANCE TRUST FUND. WHEREAS, the City Commission, pursuant to Resolution No. 92-247, adopted April 2, 1992, authorized employment of, and payment to, the law firm of Fine Jacobson, to serve as counsel for pretrial litigation services in connection with the case of Perry L. Anderson, Jr. vs. City of Miami, Jorge L. Fernandez, and A. Quinn Jones, III, Case No. 92-0435-CIV-GRAHAM; and WHEREAS, contingencies occurred which necessitated authorizing final payment to be paid to said firm; and WHEREAS, the law offices of Fine Jacobson reached the maximum level of its authorized compensation set forth in Resolution No. 93-421; and WHEREAS, additional funds are needed to compensate Fine Jacobson for the discovery and trial phases of this litigation; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: CITY coy s"1104 v,T 11C, OF J U N ROPAlut)on No,� f)4_�4 Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Final payment is hereby authorized in the amount of $171,199.51 to the law offices of Fine, Jacobson, Schwartz, Nash, Block and England ("FINE JACOBSON"), serving as counsel for the City of Miami before the United States District Court, in connection with the case of Perry L. Anderson, Jr., vs. City of Miami, Jorge L. Fernandez, and A. Quinn Jones, III, Case No. 92-0435-CIV-GRAHAM, for completion of discovery and trial phases, with .funds for said services hereby allocated from the City of Miami's Self -Insurance and Insurance Trust Fund. City of Miami, et al FROM A. nn,J nes, III Final Payment of Fine Jacobson City Atto ey REFERENCES Schwartz Nash & Block ENCLOSURES Attorneys' Fees The law firm of Fine Jacobson Schwartz Nash & Block (Fine Jacobson) was engaged in March, 1992 to represent the City of Miami, Jorge L. Fernandez and myself in connection with litigation wherein Mr. Anderson sought damages as a result of the City not providing him with private, legal counsel at his choosing and at the City's expense. This case was tried before The Honorable Michael Moore in November, 1993 which resulted in a jury award of $2,000,000.00 dollars against the City and $500,000.00 in punitive damages against Jorge L. Fernandez. The Commission had only authorized expenditures for pretrial and discovery phases as of November, 1993. The attached resolution seeks final payment for legal services rendered in connection with the trial of this matter and the filing of certain post trial motions. Your approval is being sought for final payment of Fine Jacobson's bill in the amount of $171,199.51. AQJ/rcl/P389 4- 451
