A RESOLUTION, WITH ATTACHMENTS, AUTHORIZING THE CITY MANAGER TO MAKE PURCHASE OFFERS, AS SPECIFIED HEREIN, AND EXECUTE AGREEMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, WITH THE OWNERS OF THREE (3) VACANT PARCELS OF LAND LOCATED WITHIN THE CITY'S COMMUNITY DEVELOPMENT TARGET AREAS AND MORE PARTICULARLY AND LEGALLY DESCRIBED IN THE ATTACHED EXHIBIT "A", FOR A TOTAL PURCHASE PRICE OF $34,000, SAID PARCELS TO BE USED FOR THE DEVELOPMENT OF AFFORDABLE HOUSING FOR LOW AND MODERATE INCOME FAMILIES IN CONNECTION WITH THE SCATTERED SITE AFFORDABLE HOMEOWNERSHIP DEVELOPMENT PROGRAM; ALLOCATING FUNDS THEREFOR FROM THE COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM PURSUANT TO RESOLUTION NO. 93-444 UNDER PROJECT NO. 705214; AUTHORIZING THE CITY ATTORNEY TO PROCEED TO CLOSE ON THE SUBJECT PARCELS AFTER EXAMINATION OF THE ABSTRACTS AND CONFIRMATION OF TITLE. WHEREAS, there exists a severe shortage of affordable standard housing in the City of Miami for families and individuals of low and moderate income; and WHEREAS, pursuant to Resolution No. 93-944, adopted July 8, 1993, the City Commission directed the City Manager to reallocate $500,000 in unexpended Community Development Block Grant funds for the purpose of acquiring suitable housing sites throughout the City of Miami; and WHEREAS, several surveys have been conducted in an effort to identify locations in the target areas where the expenditure of these funds would have maximum impact in reversing disinvestment (DRAM Z E D CITY COIF ssIO,x MEETING OF JU N 0 9 1994 RawUSM N& 4— 385 and deterioration while, at the same time, increasing housing resources; and WHEREAS, three (3) parcels in Edison/Little River, Model City, and Coconut Grove Target Areas have been identified and recommended for the development of affordable housing for low and moderate income families; and WHEREAS, once acquired, the assembled sites will be developed by the City of Miami under the City's Scattered Site Affordable Homeownership Development Program or made available to a not -for -profit housing corporation for the purpose of developing affordable housing units in the Target Areas; and WHEREAS, the City of Miami is interested in acquiring the three (3) parcels of land as hereinabove specified and more particularly and legally described in the attached Exhibit "A" for the development of such housing; and WHEREAS, appraisals have been obtained and efforts to secure the properties for valid public and municipal purposes through negotiation should be undertaken by the City; and WHEREAS, funds are available in the total amount of $34,000 from Community Development Block Grant funds for land acquisition costs in connection with the Program; and WHEREAS, the amounts set forth in Exhibit "A" are reasonable and in keeping with the costs of acquiring property through the normal negotiation process; and NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: 34- 385 -2- Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Land acquisition funds, previously authorized by the City Commission, pursuant to Resolution No. 93-444 under Project Number 705214, in the amount of $34,000 are hereby allocated from the Community Development Block Grant Program. Section 4. The City Manager is hereby authorized 1 to execute an Agreement of Purchase and Sale ("Agreement"), in a form acceptable to the City Attorney, for each of the subject properties at the costs stated in Exhibit "A", and to disburse 1 The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. 34- 385 -3- the sum(s) of money in accordance with the City Commission's authorization and the Agreement. Section 5. The City Attorney is hereby authorized to proceed to close on said properties after receiving confirmation of marketable and insurable title pursuant to the Agreement. Section 6. MAY 31 1994 FILE of the City Commission SUBJECT Resolution Authorizing Acquisition of Three Parcels of Vacant Land Cesar H..Od' FROM : REFERENCES: City Manas City Commission Agenda V` ENCLOSURES: j Item - June 9, 1994 It is respectfully recommended that the City Commission adopt the attached Resolution authorizing the acquisition of three (3) parcels of vacant real property located in the Edison/Little River, Model City, and Coconut Grove Community Development Target Areas, for the purpose of developing new single family, owner - occupied housing units under the City's Scattered Site Affordable Homeownership Development Program. Based on a negotiated purchase settlement with the respective property owners, purchase offers in the total amount of $34,000 have been accepted by the owners. The Department of Development and Housing Conversation recommends ratification of ' the attached resolution authorizing the acquisition of three (3) parcels of vacant real property located in the Edison/Little River, Model City, and Coconut Grove Community Development Target Areas for the purpose of developing new single family, owner -occupied housing units under the City's Scattered Site Affordable Homeownership Development Program. The City contracted with two (2) independent appraisers to determine fair market value for the subject properties. In view of the need to provide affordable housing opportunities to low and moderate income families in the Edison/Little River, Model City, and Coconut Grove neighborhoods, City Commission ratification of the attached resolution is recommended. i c72 94- 385
